Spearfish City Council Regular Session Minutes July 3, 2017 The Spearfish City Council met at 5:30 PM on Monday July 3, 2017. Mayor Boke presided and called the meeting to order. All stood and recited the pledge of allegiance. Roll Call was taken with the following members present: Clark, Hodgs, Jacobs, Klarenbeek and Schmit. Lee was absent. Also present: Finance Officer Dutton, City Attorney Davis, Police Chief Rotert, Fire Chief Sachara, Police Lieutenant Dean, Assistant Fire Chief Mathis, Human Resource Director Friedel and Legal Intern Hoffman. Order of Business – Klarenbeek moved, Jacobs seconded and all voted to approve the order of business. There were no potential conflicts-of-interest declared. At 5:31 Jacobs moved, Hodgs seconded and all voted to adjourn to executive session to discuss the qualifications of a prospective employee pursuant to SDCL 1-25-2(1) and to consult with legal counsel about contractual matters pursuant to SDCL 1-25-2(3). Council returned to regular session at 5:43 PM. Consent Agenda – Schmit moved, Hodgs seconded and all voted to approve the Consent Agenda as follows: A. Request authorization to move Gale McAnlis to Water/Wastewater Utility Operator I, effective July 10, 2017. B. Request authorization to hire Thomas Karp as part-time (not benefit eligible) Public Works/Parks Laborer, grade 9, step 1, $13.72 per hour, effective 7/5/2017. C. Request authorization to hire Logan Rank as a temporary/seasonal Recreation Facility Janitorial, $9.50 per hour, effective 7/5/2017. D. Request authorization to hire the following temporary Rally Officers at a grade 18, step 1, $21.40 per hour, effective 8/4/2017. To include State per diem for meals and lodging: John Murphy, Mike Apland, Josh Thompson, Keith Mutschler, and Scott Mickelson. E. Authorize Mayor Boke to appoint Drew Skjoldal to Planning Commission with term effective from July 18, 2017 to December 31, 2021. F. Approve a special malt beverage license for Queen City Liquor for the Black Hills Beer Run on September 17th from 12:00 p.m. to 5:00 p.m. at the Spearfish Pavilion. G. Raffle – Zonta Club of Spearfish plans to raffle a Hawaiian vacation – trip to Kaanapali, Maui (used from May 1, 2018-December 15, 2018). Trip includes 7 nights lodging, airfare up to $3,000, $500 spending stipend – or $2000 cash alternative. Tickets are $25 each with ticket sales from 7/4/17 to drawing on 12/1/17. Proceeds to benefit local service organizations and Northern Hills charities. J. Raffle – Spearfish Nutrition Site plans to raffle two tickets to see Jewel at Deadwood Mountain Grand on Friday October 13th plus miscellaneous other small donated items. Tickets are $1.00 each or six for $5.00 with ticket sales from July 4, 2017 to drawing on December 28, 2017. Proceeds to benefit Spearfish Nutrition Site – Meals on Wheels. K. Approve Minutes of City Council Regular Session dated June 19, 2017. L. Approve Minutes of City Council Special Sessions dated June 13, 2017, June 14, 2017, June 15, 2017 and June 16, 2017. HUMAN RESOURCES Contract – Hodgs moved, Klarenbeek seconded and all voted to approve and authorize the Mayor to sign Employment Contract with candidate for the position of City Administrator. Start date for Michael Harmon will be September 5, 2017. BIDS AND PROPOSALS Proposals – Schmit moved, Clark seconded and all voted to accept proposals from Rapid Fire Protection Inc. ($14,501) and ClimateControl Systems and Services ($24,402) totaling $38,903, for Police Department server room re-model. Budgeted in 214 (911). LEGAL AND FINANCE Amendment – Hodgs moved, Klarenbeek seconded and all voted to approve and authorize the Mayor to sign "Second Amendment to Real Estate Purchase Agreement" between the City and NWE concerning the purchase of the former McLaughlin Sawmill. Resolution 2017-16 – Schmit moved, Jacobs seconded and all voted to approve Resolution 2017-16 - Miscellaneous Fees. FIRE DEPARTMENT Request – Schmit moved, Klarenbeek seconded and all voted to deny request for overtime pay for exempt employees, when ordered for incidents to be paid through SD State Wildland Fire Co-Op Agreement. Schmit, Klarenbeek and Hodgs cited concerns with the request. Fire Chief Sachara requested Council review and revisit the Wildland Fire program. PLANNING AND ZONING 1010 Christensen Drive – Hodgs moved, Klarenbeek seconded and all voted to approve Resolution 2017-17 - Voluntary Annexation. RESOLUTION NO. 2017-17 A RESOLUTION OF ANNEXATION TO EXTEND THE BOUNDARIES OF THE CITY OF SPEARFISH, SOUTH DAKOTA, BY ANNEXING LANDS MORE SPECIFICALLY DESCRIBED HEREIN: WHEREAS, The City of Spearfish has conducted an analysis of the territory where a petition for voluntary annexation has been submitted, and has determined the resources necessary to serve the annexed territory exist; and, WHEREAS, the territory described herein adjoins and is contiguous to the existing boundaries of the City of Spearfish and is not separated from the existing City by any significant physical barriers, and annexation is natural and reasonable and the municipal body hereby created constitutes a homogenous and unified entity; and, WHEREAS, the City of Spearfish has held public hearings and considered all testimony regarding said annexation; and, WHEREAS, the City of Spearfish has fully complied with all statutory requirements of SDCL Chapter 9-4 required and precedent to this Resolution. Resolution 2017-18 – Jacobs moved, Schmit seconded and all voted to transfer the entirety of Block 47 Original Town plat into the Thoen Stone Addition. RESOLUTION NO. 2017-18 A RESOLUTION TO TRANSFER TERRITORY WITHIN THE ORIGINAL TOWN PLAT INTO THE THOEN STONE ADDITION WHEREAS, the territory described herein is located within the Original Town Plat of the City of Spearfish as shown on the Plat thereof recorded in Plat Book 1, Page 73, in the Office of the Lawrence County Register of Deeds, WHEREAS, the territory described herein is to be platted in the future and will thus include areas located within the Thoen Stone Addition to the City of Spearfish. WHEREAS, the City of Spearfish now desires to simplify the process for recording future plats involving the territory described herein and wishes to identify all territory as being located within the Thoen Stone Addition. NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Spearfish, Lawrence County, South Dakota, that the following described territory be transferred from the Original Town Plat to the Thoen Stone Addition: (See Exhibit A, attached to this resolution for general location). 1. All of Block 47 including the vacated alley of the Original Town Plat of the City of Spearfish as shown on the Plat thereof recorded in Plat Book 1, Page 73, in the Office of the Lawrence County Register of Deeds. 2.
