Spearfish City Council Board of Adjustment Date: November 6, 2017 Minutes Dana Boke called the meeting of the Spearfish Board of Adjustment to order at 6:40 PM on Monday, November 6, 2017 in the Council Chambers of the Municipal Services Centre with the following members present: Boke, Clark, Hodgs, Jacobs, Klarenbeek, Lee and Schmit. Also present were City Administrator Harmon, Finance Officer Dutton, City Planner Watson, City Attorney Davis and Administrative Assistant Weber. Resolution 2017-33 – City Planner Watson described a variance request from Bill Termes at 625 E. Illinois. Planning Commission recommended approval. Boke opened the public hearing at 6:46 PM. There were no oral or written statements and the public hearing was closed at 6:46 PM. Lee moved, Hodgs seconded and all voted to approve Resolution 2017-33 to consider a setback variance at 625 Illinois Street. RESOLUTION NO. 2017-33 A RESOLUTION GRANTING A VARIANCE TO 625 ILLINOIS STREET, SPEARFISH, LAWRENCE COUNTY, SOUTH DAKOTA WHEREAS, the owner of the following-described real property has requested a variance from the north property line setback in order to construct an open porch: Lot 12 Block 35 of the Original Town Plat, City of Spearfish, Lawrence County, South Dakota, as shown on the Plat thereof recorded in Plat Book 1, Page 73, in the Office of the Lawrence County Register of Deeds, and WHEREAS, the City of Spearfish Board of Adjustment has reviewed the record and has concluded that the applicant has satisfied the criteria for receiving the variance requested, NOW THEREFORE, BE IT RESOLVED by the Board of Adjustment of the City of Spearfish, Lawrence County, South Dakota, that the above-described property is hereby granted a variance to Appendix A. Zoning Article V. Section 2.A.3 of the Revised Ordinances of the City of Spearfish and shall be allowed to construct an open porch in accordance with the plans and specifications attached hereto as Exhibit A. No other improvements are permitted by this variance. This variance shall be deemed to run with the land for so long as the porch exists but shall terminate automatically if the house is demolished or the property is otherwise redeveloped.
