Spearfish City Council Regular Session Minutes March 19, 2018 The Spearfish City Council met at 5:30 PM on Monday, March 19, 2018. Council President Hodgs presided and called the meeting to order. All stood and recited the pledge of allegiance. Roll Call was taken with the following members present: Clark, Hodgs, Jacobs, Klarenbeek, Lee and Schmit. Mayor Boke was absent. Also present: City Administrator Harmon, City Planner Watson, Finance Officer Dutton, City Attorney Davis, Public Works Administrator Johnson, Police Chief Rotert, Fire Chief Sachara, Streets Superintendent Riopel, Fire Code Official Deaver, Assistant Police Chief Jacobs, Finance Admin Assistant Weber and Public Works Administrative Assistant Schneringer. Jacobs moved, Klarenbeek seconded and all voted to approve the order of business. There were no declarations of any potential conflicts-of-interest. Consent Agenda – Schmit moved, Clark seconded and all voted to approve the Consent Agenda as follows: A. Add the following to the 2018 Volunteer List: Fire Department – David Schumm, Kyle Gremse; Library – Janie McAmis, Christopher Avison, Amber Jensen; Recreation Center – Manuel Plaza. B. Move Cindy Schneringer, Public Works Administrative Assistant to a grade 12, step 2, $16.39 per hour, effective 3/11/2018. Due to successful completion of Cindy’s 6-month in training period. C. Raffles:  Spearfish Area Chamber of Commerce plans to raffle a total of $12,500 in cash prizes ($10,000, $1,500, $1,000 – first, second and third prize). Tickets are $50 each with ticket sales from May 1-drawing on September 27, 2018.  Spearfish Cooperative Preschool plans to raffle a variety of baskets (garden, outdoor grilling, book, etc.) Tickets are $2 each with ticket sales from March 28-April 13, 2018.  Spearfish Area Chamber plans to hold 50/50 drawings at after hours Mixers in 2018. Tickets are $1 each or 6 for $5 with ticket sales only at the event. Dates for 2018 mixers can be found in meeting packet or on the Chamber website.  South Dakota Backcountry Hunters and Anglers plan to raffle 2 Yeti VIP Packages (tickets) to Total Archery Challenge June 22-24 at Terry Peak. Tickets are $10 each or three for $20 with drawing on 5-15-2018. G. Approve the following Special Event Permits:  Children’s First Spring Sprint – Saturday April 21, 2018 - 8:00am – 9:00am. Route: Starting at Children’s First going through Lions, Brady, City Park, Campground and back.  Nick Sukstorf Memorial Bike Ride – Sunday June 3, 2018 - 9:00am – 6:00pm - Jorgensen Park to Campground and back.  Matthews Opera House Festival in the Park – July 20 – July 22, 2018 – Spearfish City Park H. Approve Minutes of City Council Regular Session dated March 5, 2018. I. Accept Monthly Financial Reports dated February 28, 2018. ITEMS FROM VISITORS Proclamation – Dan Hodgs, on behalf of Mayor Boke proclaimed the Month of March 2018 as Intellectual and Developmental Disabilities Awareness Month. Presentation – 2017-2018 Spearfish Leadership class presented their team project. HEARINGS License – Chairman Hodgs opened a public hearing at 5:42 PM to consider an application from Jenni Tucker with Level Wine Bar for the transfer for an on-off sale malt beverage and on-off sale wine license from Bryan Johnson with Level, LLC located at 604 N. Main St. There were no oral or written comments and the public hearing was closed at 5:42PM. Clark moved, Jacobs seconded and all voted to approve the license transfer. License – Chairman Hodgs opened a public hearing at 5:43 PM to consider an application from Gregory Stroud with Apple FSH for the transfer of a retail on-sale liquor license from Todd Schriever with Applebees located at 301 N. 27th St. There were no oral or written comments and the public hearing was closed at 5:42PM. Schmit moved, Clark seconded and all voted to approve the license transfer. PUBLIC WORKS Proposal – Schmit moved, Clark seconded and all voted to accept proposal from A & L Contractors LLC for the hauling of sawdust from McLaughlin Saw Mill to City Rubble Site - cubic yard rate of $4.10 for a complete estimated total price of $49,325.00. Street Superintendent Riopel stated six requests for proposals were sent – four returned with A & L having the lowest responsive proposal. Total quote price is based on estimated 12,000 yd3. Proposal – Jacobs moved, Schmit seconded an all voted approval of FMG Engineering proposal for surveying, design services and bidding services to complete The City Hall Site Improvements Project at a cost not to exceed $68,217.40. FINANCE Grant - Special Olympics South Dakota requested $1,000.00 grant to support the State Summer Games in Spearfish May 17-19, 2018. Finance Officer Dutton stated the games were initially going to be in Brookings this year but the event has been relocated back to Spearfish. He stated historically, the City does provide a grant to this event when in Spearfish and staff recommends awarding the grant as requested – this will require a budget supplement and can be funded from Hospitality. Schmit moved to award $2,000 grant to Special Olympics and Lee seconded. Hodgs, Schmit, Lee and Jacobs voted yes, Clark and Klarenbeek voted no. Motion passed 4 - 2. FIRE Fire Grants – Clark moved, Schmit seconded and all voted to authorize the Fire Department to apply for the following grants:  Staffing for Adequate Fire and Emergency Response (SAFER) Grant - for recruitment and retention of volunteers (No City match, grant award may be up to $35,000)   Volunteer Fire Assistance (VFA) Program - grant for hand held radios (50/50 City match with $7,854.24 as total requested amount) AIRPORT Surplus – Jacobs moved, Clark seconded and all voted to approve adoption of Resolution 2018- 06 – Surplus. Airport wishes to surplus obsolete and unused equipment in order to transfer to another airport. RESOLUTION 2018-06 A RESOLUTION DECLARING THE FOLLOWING ITEMS SURPLUS. WHEREAS, the City of Spearfish is the owner of the following property:  Southern Avionics NDB Transmitter and Tuner Mod. SS500VS s/n 50-127 WHEREAS, the City of Spearfish deems it desirable to declare said property as being surplus; NOW, THEREFORE BE IT RESOLVED by the Common Council of the City of Spearfish that said property be declared surplus and transferred to the Dawson Community Airport in Glendive, MT. Ordinance 1274 – Chairman Hodgs opened a public hearing at 5:58 PM to consider second reading for Ordinance 1274 – Apply Agriculture Zoning District to 20-acre parcel recently annexed west of Falcon Crest. There were no oral or written comments and the public hearing was closed at 5:58 PM. Schmit moved, Jacobs seconded and all voted to approve second reading of Ordinance 1274. Agreement – Schmit moved, Jacobs seconded and all voted to authorize Mayor Boke to sign agreement #13-18, Easement and Development Agreement with Spring Creek Ranch LLC concerning requirements for a vehicular turn around area at the west end of 5th Avenue in Falcon Crest. Ordinance 1275 – Schmit moved, Jacobs seconded and all voted to approve First Reading of Ordinance 1275 – An amendment to Appendix A Zoning Article II Definitions for Home Occupation and Office land uses and to set public hearing for April 2, 2018. Ordinance 1276 – Schmit moved, Klarenbeek seconded and all voted to approve First Reading of Ordinance 1276 – An amendment to Appendix A Zoning Article IV District Regulations Sections 1a-4 concerning primary permitted uses and conditional use permit uses and to set public hearing for April 2, 2018. Ordinance 1277 – Jacobs moved, Schmit seconded and all voted to approve First Reading of Ordinance 1277 – An amendment to Appendix A Zoning Article VI Administration and Enforcement Section 3 - concerning administration of conditional use permits and to set public hearing for April 2, 2018. Final Plan Preliminary Plat – Clark moved, Klarenbeek seconded and all voted to approval the Final plan and prelim plat for Lot 2 of Lot 1R Block 3 Della Vecchia Addition at the Villages at Creekside. City Planner Watson stated this is the first of several commercial parcels at the Villages at Creekside.
