City Council Study Session Minutes
October 12, 2022, 4:15 p.m.
The City Council Study Session was called to order by Council President Hodgs at 4:15 p.m. in the
Council Chambers of City Hall on Wednesday, October 12, 2022. The following c o u n c i l
members were present: Clark, Hodgs, Hourigan, Klarenbeek, and Rath. Absent: Jacobs and Mayor
Senden. City staff present were: City Administrator McFarland, City Attorney McDonald, Finance
Officer DeNeui, Public Safety Director Rotert, Public Works Director Broyles, City Planner Kapsa,
Park and Recreation Director Ehnes, City Engineer Mathis, Human Resource Director Mathis, and
Assistant Public Works Director McMahon.
Hourigan moved, Rath seconded, and all voted to approve the agenda as presented.
Items for Council Discussion:
Elkhorn Sewer Allocation Sales – City Engineer Mathis proposed a method of selling the sewer
allocations based on overall cost of the Elkhorn Sewer Lift Station, a minimum amount of allocation
per parcel area, and collection of the amount at time of annexation. Additional discussions were on
the ability for the purchaser to resell the allocation. Staff recommendation is to have all excess
allocations be prohibited to be resold to private parties, but allow the City to purchase the excess back
at original purchase price. Input was provided and a final recommendation will be presented at a later
date.
Package Liquor License – Finance Officer DeNeui noted one package liquor (off-sale) license is
available in Spearfish. Staff recommendation is for the license to be placed open for sealed bids with
a minimum bid requirement of $50,000, which is the same price as the last one sold via sealed bids in
2011. Final recommendation will be presented at a later date.
Items for City Council Meeting:
The following items will appear on the Council agenda for consideration. Comments received are
noted:
A. Finance
1) Consent Agenda – Approve application from Cheyenne Crossing for a special malt
beverage and on-sale wine license for the LCRW – Reagan Day Dinner on October 22,
2022 from 5:00 p.m. to 10:00 p.m. at the Pavilion.
2) Transfer $15,000 from Hospitality Tax Fund to General Fund, as budgeted.
3) Approve the corrected minutes of the September 19, 2022 City Council regular session.
B. Human Resources
1) Approve the second reading of Ordinance 1374 – An Ordinance Adopting the Revisions
to the City of Spearfish Personnel Policy Manual.
C. Parks and Recreation
1) Approve the recommendation for the funding and construction of a new skate park.
Comments were received from resident Tom Deis on the location at the south end of
Spartan Park and he requested the location be reconsidered. Mr. Deis provided other
options and information on other communities that have located skate parks in non-
residential areas. Eric Nies, attorney for Mr. Deis, requested the specific language of the
location at the south end of the lower field of Spartan Park be removed from the council
action so that alternative sites can still be considered.
2) Approve the skate park concept design package proposal from the American Ramp
Company in the amount of $9,000.
D. Planning & Zoning
1) Approve Resolution 2022-30 – A Resolution to Transfer Real Property from the City of
Spearfish to Spearfish Economic Development Corporation. (10 additional lots at Sky
Ridge)
2) Approve the C1 Redevelopment Incentive Plan for 544 North 7th Street.
Public Comment – A time for public comment was opened at 5:00 p.m. and closed with no
comments being received.
Park and Recreation Director Ehnes noted the ribbon cutting for the Sawmill Community Path will
be on Friday, October 14, 2022 at 1:00 p.m.
No additional discussions were held and the meeting was adjourned at 5:01 p.m.
