City Council Study Session Minutes
November 30, 2022, 4:15 p.m.
The City Council Study Session was called to order by Mayor Senden at 4:15 p.m. in the Council
Chambers of City Hall on Wednesday, November 30, 2022. The following c o u n c i l members
were present: Clark, Hodgs, Hourigan, Jacobs, Klarenbeek, and Rath. Absent: None. City staff
present were: City Administrator McFarland, City Attorney McDonald, Finance Officer DeNeui,
Public Safety Director Rotert, Public Works Director Broyles, City Planner Kapsa, City Engineer
Mathis, Assistant City Engineer Spindler, Assistant Public Works Director McMahon, and
Administrative Assistant Bussiere.
Klarenbeek moved, Hourigan seconded, and all voted to approve the agenda as presented.
Items for Council Discussion:
Low Pressure Sewer Systems – City Engineer Mathis and Assistant City Engineer Spindler discussed
low pressure sewer systems for design standards and construction specifications. This type of system
would be an option for sewer services when a lift station, force main, gravity flow, or septic systems
are not ideal for the development location. Consensus was to include this option in the design
standards and construction specifications that will be reviewed and approved by Council at a later
date.
Items for City Council Meeting:
The following items were reviewed for the upcoming City Council meeting on December 5, 2022:
A. Finance:
1) Authorize the highest bidder to move forward in obtaining an off-sale liquor license.
Finance Officer DeNeui noted one bid was received for $50,000 which is below the
$100,000 minimum price so will need to be rejected.
2) Approve a property tax refund of $191.66 and an abatement of $21,255 for parcel without
a structure.
3) Approve a $311,819 contingency budget transfer to the following line items:

4) Approve the first reading of Ordinance 1375 – An Ordinance Supplementing the 2022
Appropriations Ordinance No. 1344 of the Code of Ordinances, City of Spearfish, South
Dakota.
B. Parks and Recreation
1) Approve Construction Change Order #1 for the Sports Complex Irrigation Well Project
with an increase of $18,000.
C. Planning & Zoning
1) Ordinance 1376 – An Ordinance Amending the Development Review District (DRD)
Final Plan to Allow Revised Setbacks Along Bluestem Boulevard.
a. Hold a public hearing on the ordinance.
b. Approve the second reading of the ordinance.
2) Waive the $150 fee for the Major Amendment to the Development Review District
(DRD) Final Plan for Phase G of the Countryside Subdivision.
3) Approve a delay in the completion of the remaining punch-list items for Phase 1A of
Miller Ranch Subdivision with a financial guarantee of $45,000.
4) Dedication of public improvements for Phase 1A of Miller Ranch Subdivision:
a. Approve the Dedication and Acceptance of Public Improvements Agreement
b. Approve the Drainage Easements Agreement
c. Approve the Sewer Easement Agreement
D. Public Safety
1) Add Kimberly Bulava to the 2022 volunteer firefighter list and Raymond Brott to the
2022 volunteer fire department list.
E. Public Works
1) Approve the final, under/over Change Order #1 for the 2022 Sanitary Sewer CIPP Lining
Project for a final net increase of $5,940.64 (0.62%), final project cost of $958,604.10, and
Certificate of Final Completion and Acceptance setting December 5, 2022 as the date the
two (2) year warranty begins.
2) Approve Construction Change Order #6 for the Sandstone Hills Street Repair & Sewer
Up Size project with an increase of $47,221.
Public Comment – A time for public comment was opened at 4:59 p.m. Resident Joe Jorgensen
noted pleasure in the new LED Christmas lights along Jackson Boulevard. No further comments
were received and the time for comment was closed.
City Administrator McFarland reported on a recent meeting attended by several City staff and Mayor
Senden regarding the Western Dakota Regional Water System. This system will be utilized by the
City as an emergency water source. The organization is in the beginning process of getting
established so membership fees and allocation costs will be determined at a future date.
Mayor Senden and Councilman Klarenbeek noted that they will not be in attendance for the
December 5, 2022 City Council session. Council President Hodgs will chair the meeting.
No additional discussions were held. Hourigan moved, Hodgs seconded and all voted to adjourn at
5:06 p.m.
