CITY OF SPEARFISH LEGAL, FINANCE AND PUBLIC SAFETY COMMITTEE MINUTES May 10, 2016 The Legal, Finance and Public Safety Committee met in the Council Chambers of the Municipal Services Centre at 4:15 PM on Tuesday, May 10, 2016 with the following committee members present: Clark, Jacobs and Schmit. Also present were: City Administrator Neeb, Finance Officer Dutton, City Planner Watson, City Attorney Davis, Police Chief Rotert, Volunteer Fire Chief Heser, Assistant Police Chief Jacobs, Police Lieutenant Dean and Administrative Intern Vinal. Chair – Doug Schmit was selected by the Committee to chair. Items from Visitors Proclamation – On Monday, Mayor Boke will proclaim the week of May 15-21 as Emergency Medical Services Week in Spearfish. Proclamation – On Monday, Mayor Boke will proclaim May 18th as Emergency Medical Services for Children Day in Spearfish. Proclamation – On Monday, Mayor Boke will proclaim May 15-21, 2016 as National Police Week in the City of Spearfish. Leadership Spearfish – Leadership Spearfish will have a complete presentation at Public Works Committee for their project plans to light the tunnel at Lookout Mountain access point. On Monday, they will ask approval for Mayor to sign the DOT agreements, assistance with project specifications and guidance for grant timelines. Running Property – On Monday, Rachel Headley will present plan for Running Property. Ordinances and Resolutions Ordinance 1244 – Committee recommended approval to Full Council for First Reading of Ordinance 1244 – Rezone Rocky Road Rentals, Tract D Voorhees Addition from Ag to C2 and to set public hearing for June 6, 2016. Planning Commission recommended approval (5/1) and City Planner Watson stated that the opposing vote was due to preference of DRD over C2. Finance Office Audit Request – Committee recommended approval to Full Council to seek proposals for audit of City telecommunication vendor billing statements and services. Public Hearings – On Monday, there will be three public hearings for various alcohol licenses as follows: 1) Public Hearing to consider an application from Lana Christensen with Chris’ Campground for a retail on-off sale malt beverage & SD farm wine license located at 701 Christensen Dr. 2) Public Hearing to consider an application from Josh Fritz with Crow Peak Brewing for a special malt beverage and on-sale wine license for Taste of Autumn BBQ on September 16-17, 2016 at the City Campground. 3) Public Hearing to consider an application from Josh Fritz with Crow Peak Brewing for a special malt beverage license for the Gold Rush Gravel Grinder on June 11, 2016 from noon to 5 pm at the Park Pavilion. Special Licenses – Committee recommended approval to Full Council, Consent Agenda for the following special licenses: • Approve a special on-sale liquor license for the Stadium Sports Grill for the Spearfish All School Reunion on July 2, 2016 from 2 pm to 10 pm at the BHSU Joy Center. • Approve a special on-sale liquor license for the Stadium Sports Grill for the Ainsworth-Benning Retirement Party on July 30, 2016 from 3 pm to 7 pm at the BHSU Joy Center. • Approve a special on-sale liquor license for the Stadium Sports Grill for the Ladies Night Out-Vendor Showcase on June 9, 2016 from 4 pm to 9 pm at the Spearfish Pavilion. TID 4 – Committee recommended approval to Full Council for TID#4 Final Cost Certification. Total developer funded cost is $1,098,081.22. Planning and Zoning Concept Final Plan – Committee forwarded to Full Council without recommendation the request to approve a revision to the concept/final plan for the Reserve phases 4 – 7. City Planner Watson stated this modification will result in the same number of lots (134), but will revise the trails system, the amount of common open space, and the coving concept. Of note, the new plan will eliminate open space buffer zones from some properties constructed in earlier phases contained in original plans. Watson also stated this plan revision was shared with the Spearfish Parks, Recreation and Forestry Advisory Board who discussed options for a centralized neighborhood park that could be city owned/maintained, and trails linkages. The SPRFAB did not recommend that Ward Development plan for any additional central parks open spaces that could be owned/maintained by the city. This conclusion was reached based on the need for a more comprehensive approach to parks planning that normally takes place when zoning is first requested, not, when specific subdivision layout is being discussed. The recommendation of the SPRFAB is the following:  1) Pocket parks shown on the plan should be privately maintained (connecting southeast of Shoshone to Street D and at the east end of Reserve Street). Note that after the Board’s meeting, Ward Development revised the plan to remove the pocket park at the southeast end of Shoshone. The park at the east end of Reserve remains. 2) There will be a trail connecting east to the Higgins Gulch drainage in the vicinity of the intersection of Beartooth Loop and Street B, and a trail connecting Shoshone Ave to the Pheasant Lane trail. Note that after the Board’s meeting, Ward Development revised the plan to show these connections. 3) The Parks Recreation and Forestry Advisory Board will continue to work with Ward Development to make key decisions concerning trails planning. Staff recommends approval along with the three recommendations per the Parks Recreation and Forestry Advisory Board Final Plan – Committee forwarded to Full Council without recommendation the request to approve the final plan for the Travel Center at Elkhorn Ridge. City Planner Watson stated this is the Southwest corner of I-90 and Highway 85 Interchange. This request will enable the construction of a gas station, restaurant and convenience market for this commercial corner, as approved in the original DRD Master Plan. The park at the east end of Reserve remains. 2) There will be a trail connecting east to the Higgins Gulch drainage in the vicinity of the intersection of Beartooth Loop and Street B, and a trail connecting Shoshone Ave to the Pheasant Lane trail.
