City of Spearfish Legal, Finance, and Public Safety Committee Minutes November 13, 2019 The Legal, Finance and Public Safety Committee met in the Council Chambers of C i t y H a l l at 4:15 p.m. on Wednesday, November 13, 2019 with the following committee members present: Jacobs and Klarenbeek. Absent: Eisenbraun. Also present were: City Administrator Harmon, City Attorney McDonald, Human Resource Director Mathis, Public Safety Director Rotert, Finance Officer DeNeui, Fire Chief Deaver, and Assistant Fire Chief Mathis. City Administration IT Services Contract – Committee forwarded to full council with recommendation to approve IT services contract with Northern Hills Technology effective January 1, 2020 and to authorize President Hodgs to execute the agreement and any necessary documents to migrate to Office 365. Finance Ordinance 1306 – Committee forwarded to full council with no recommendation to approve the first reading of Ordinance 1306 – an ordinance to amend the 2019 budget. The final draft of the ordinance will be presented during the council meeting. Ordinance 1307 – Committee forwarded to full council with no recommendation to approve the first reading of Ordinance 1307 – an ordinance supplementing the 2019 budget. The final draft of the ordinance will be presented during the council meeting. Resolution 2019-23 – Committee forwarded to full council with recommendation to adopt Resolution 2019-23 – A Resolution to Establish Fund 295 – the SAFER Grant Fund. Special License – Committee forwarded to full council to hold a public hearing to consider an application from Visit Spearfish for a special malt beverage license for the 605 Black Hills Classic on September 12, 2020 from 2:00 p.m. to 10:00 p.m. at the Spearfish Lions Park. The approval of the application will be considered following the public hearing. License – Committee forwarded to full council to hold a public hearing to consider an application from Canada Salter with Pure Bliss dba A Perfect 10 for an on-off sale wine and cider license located at 2430 Platinum Dr., Ste. #4. This is a new position funded by the SAFER grant for the next 4 years. Wage Adjustment – Committee recommended to full council to move Kim Whitney-Schavone to grade 10, step 1, $14.86 per hour effective 10/1/2019 for the office assistant duties within her position description of campground manager/office assistant. Planning and Zoning Blue Star Subdivision – Committee recommended to full council to approve a preliminary plat and variance for the Blue Star Subdivision to include a variance to allow a 36 foot wide private access easement, a variance to allow the road grade to exceed 10%, and variances to apply only to the development of 8 lots within the overall 40 acre parcel. Ordinance 1303 – Committee recommended to full council to approve the first reading of Ordinance 1303 regarding small wind energy systems and to set a public hearing for December 2, 2019 to consider the ordinance. Public Works Resolution 2019-24 – Committee recommended to full council to adopt Resolution 2019-24 – A Resolution to Set Fees Charged by the City. This resolution will establish fees for water, sewer, wastewater and solid waste to be billed in 2020. Thoen Stone – Committee heard comments from Roger Tellinghuisen, Les and Karen Turgeon, and Johanna DellaVecchia requesting to open the Thoen Stone right-of-way by removing the existing fence and asked the City to maintain the surface. Mark Weber spoke in opposition to the request stating issues with traffic and vandalism. Committee forwarded the item to full council with no recommendation.
