Legal, Finance, and Public Safety Committee Minutes
January 15, 2020
The Legal, Finance and Public Safety Committee met in the Council Chambers of C i t y H a l l at
4:15 p.m. on Wednesday, January 15, 2020 with the following committee members present:
Eisenbraun, Jacobs and Klarenbeek. Absent: None. Also present were: City
Administrator Harmon, City Planner Watson, City Attorney McDonald, Public Safety
Director Rotert, Finance Officer DeNeui, Police Chief Jacobs, Fire Chief Deaver, and Assistant City
Planner Van Holland.
City Administration
FYI – Council members/staff, please let Kaija know ASAP if you plan to attend the 2020 Legislative
Rib Dinner and Municipal Government Day at the Legislature in Pierre on February 4-5, 2020.
Finance
Agreement – Committee recommended to full council to approve the revised Intergovernmental
Contract with South Dakota Public Assurance Alliance.
Consent Items – Committee recommended to full council to approve the following consent agenda
items:
1) A special malt beverage and on-sale wine license for False Bottom for 3-Cheers on January
30, 2020 from 5:30 p.m. to 8:30 p.m. at the Pavilion.
2) A special on-sale wine license for Spearfish Creek Wine Bar for Chinook Fest on January 25,
2020 from noon to 7:00 p.m. at the Pavilion.
3) A special malt beverage and on-sale wine license for Spearfish Creek Wine Bar for the
Chocolate Festival on February 8, 2020 from 8:00 a.m. to 5:00 p.m. at the Pavilion.
4) A special on-sale wine license for Spearfish Creek Wine Bar for Crow Peak Sound Off on
February 16, 2020 from 3:00 p.m. to 6:00 p.m. at the Pavilion.
5) A special on-sale liquor license for the Stadium Sports Grill for a wedding on February 1,
2020 from 4:00 p.m. to midnight at the Pavilion.
Public Hearings – Committee recommended to full council to hold the following public hearings
during the regular session on January 21, 2020 and consider each license approval after each hearing:
1) Hold public hearing to consider an application from Kelly Gould with 2 Broke Girls for an
on-off sale wine license located at 605 N Main Street.
2) Hold public hearing to consider an application from Sajan Baniya with Himalayan Indian
Cuisine for an on-off sale wine license located at 6764 Colorado Loop Ste 2.
3) Hold public hearing to consider an application from Zac Eixenberger with Spread the Tunes
for a special malt beverage license for Chinook Days on January 25, 2020 from noon to 7:00
p.m. at the Pavilion.
4) Hold public hearing to consider an application from Spearfish Chamber of Commerce for a
special on-sale liquor license for Taste of Spearfish on January 27, 2020 from 5:00 p.m. to
7:00 p.m. at the Pavilion.
Engagement – Committee recommended to full council to approve the engagement letter with
Ketel Thorstenson, LLP for audit of the financial statements for the year ended December 31, 2019.
Estimated cost of the audit is $32,000 which is budgeted in General Fund, finance.
Resolution 2020-03 – Committee recommended to full council to adopt Resolution 2020-03 – A
Resolution Establishing Fund 511-Workforce Housing Project Fund. This fund will track the
revenues and expenditures for costs associated with the workforce housing project.
Tap Fees – Committee recommended to full council the following items relating to tap fees:
1) First reading of Ordinance 1309 – An Ordinance Amending Chapter 18, Section 18-216 Tap
Fees. This ordinance will identify that tap fees are set by resolution and administered via a
policy.
2) Resolution 2020-02 – A Resolution to Set Fees Charged by the City. This resolution will set
water and sewer tap fees for the next 5 years.
3) Tap Fee Policy – This policy will govern how water and sewer tap fees are calculated for
residential and commercial construction projects.
Quote – Committee recommended to full council to accept quote (Q83172) for 20 tablet/mobile
data terminals (MDTs) and related accessories from Brite at the cost of $56,942. The purchase is
budgeted in Second Penny Fund, police.
Position – Committee recommended to full council to approve the position description for public
safety records manager and authorize to recruit to fill this position.
Public Comment – Public comment section was opened at 4:33 p.m. and closed with no comments.
There being no further discussion before the committee, the meeting was adjourned at 4:34 p.m.
