Legal, Finance, and Public Safety Committee Minutes
February 12, 2020
The Legal, Finance and Public Safety Committee met in the Council Chambers of C i t y H a l l at
4:15 p.m. on Wednesday, February 12, 2020 with the following committee members present:
Eisenbraun, Jacobs and Klarenbeek. Absent: none. Also present were: City
Administrator Harmon, City Planner Watson, Parks and Recreation Director
Ehnes, City Attorney McDonald, Public Safety Director Rotert, Finance Officer DeNeui, Assistant
Finance Officer Thurmes, Police Chief Jacobs, Assistant Police Chief Dean, Fire Chief Deaver and
Assistant City Planner Van Holland.
City Administration
Agreement – Committee recommended to full council to approve the Development Agreement and
Declaration of Land Use Restrictive Covenants between the City of Spearfish and Dream Design
International with a modification of allowing purchases of category 1 homes to be in the 22 percent
tax bracket for a defined time period following completion of construction.
Finance
Report – Committee recommended to full council consent agenda the acceptance of the Spearfish
Community Pantry 2019 Annual Report.
License – Committee recommended to full council consent agenda approval of a special malt
beverage license for Grant Street Liquor for the Crow Peak Soup Off on February 16, 2020 from 3:00
p.m. to 6:00 p.m. at the Pavilion.
Abatement – Committee recommended to full council to abate 2019 taxes payable in 2020 for
Connection Church Spearfish, value of abatement is for the full taxable value.
Public Hearing – Committee recommended to full council to hold a public hearing to consider an
application from Monet Vermetter with Ye Olde Shoppes LLC dba Nowhere, A Men’s Clothier for a
retail (on-off sale) malt beverage and wine license located at 109 E. Hudson Street. The approval of
the license will be considered following the public hearing.
Planning & Zoning
Ordinance 1310 – Committee recommended to full council to hold a public hearing to consider
Ordinance 1310 – An Ordinance Amending Appendix A Zoning, Article V. Supplementary
Regulations, Section 6 Sign Regulations. Approval of the second reading of the ordinance will be
considered following the public hearing.
Deed – Committee recommended to full council to accept a quit claim deed from Lawrence County
to convey lands to the City of Spearfish along the south side of Colorado Boulevard where city water
and sewer infrastructure is presently located.
Annexation – Committee recommended to full council to adopt Resolution 2020-04, approve the
first reading of Ordinance 1311, and set public hearing on the ordinance for March 2, 2020. These
items pertain to 6025 E. Colorado Blvd annexation and concurrent change of zoning.
Dedication – Committee recommended to full council to approve the Dedication Agreement for
Venture Court and the Sanitary Sewer Easement Agreement and Drainage Easement Agreement both
with Access Point Properties. These items will dedicate Venture Court, a 5 lot industrial park
subdivision at the north end of Seaton Circle to the City.
Public Safety
Purchase – Committee recommended to full council to purchase two (2) 2020 Ford Explorer Police
Interceptors from Whites Canyon Motors at a cost of $37,587 per vehicle, total of $75,174, as the
local vendor is matching SD state bid pricing.
Agreement – Committee recommended to full council to approve the lease agreement with Spearfish
Rifle and Trap Club for the gun range in the canyon.
Hire – Committee recommended to full council to hire Thomas Hageman, as seasonal/on-call
wildland firefighter, at $13.50/hr., effective 5/1/2020.
Hire – Committee recommended to full council to hire Cody Jolovich as seasonal/on-call wildland
firefighter, at $13.50/hr., effective 5/1/2020.
Hire – Committee recommended to full council to hire Jacob Paul as seasonal/on-call wildland
firefighter, at $13.50/hr., effective 5/1/2020.
Public Comment – Public comment section was opened at 4:43 p.m. and closed with no comments.
There being no further discussion before the committee, the meeting was adjourned at 4:44 p.m.
