City of Spearfish Legal, Finance, and Public Safety Committee Minutes July 1, 2020 The Legal, Finance and Public Safety Committee met in the Council Chambers of C i t y H a l l at 4:15 p.m. on Wednesday, July 1, 2020 with the following committee members present: Eisenbraun, Jacobs and Klarenbeek. Absent: none. Also present were: City Administrator Harmon, City Attorney McDonald, City Planner Watson, Public Safety Director Rotert, Police Chief Jacobs, and Finance Officer DeNeui. City Administration Ordinance 1317 – Committee recommended to full council to approve the second reading of Ordinance 1317 – An Ordinance Amending Chapter 16, Taxation. This ordinance will repeal section 16-58 of Spearfish City Ordinances. Finance Ordinance 1319 – Committee recommended to full council to approve the second reading of Ordinance 1319 – An Ordinance Amending Chapter 2, Administration. This ordinance will add additional signers for city contracts, agreements and other documents. FYI – An interim bill list was necessary on 6/26/2020 to avoid late penalties on electricity charges in the amount of $12,929.81. Resolution 2020-15 – Committee recommended to full council to approve Resolution 2020-15 and authorize Mayor Boke to sign the Local Government COVID Recovery Fund Reimbursement Agreement. Resolution 2020-16 – Committee recommended to full council to approve Resolution 2020-16 – A Resolution Authorizing the Transfer of Fund Balance to the General Fund. Planning and Zoning Ordinance 1318 – Committee recommended to full council to approve the second reading of Ordinance 1318 and to hold a public hearing on July 6, 2020 to change zoning from Planned Unit Development to Development Review District on Tracts 2R, 3R, and 4R of the Countryside Subdivision, and Lot 1C a Subdivision of Lot 1A of Lot 1, all of the Spring Creek Addition to the City of Spearfish, Lawrence County South Dakota. Ordinance 1320 – Committee recommended to full council to approve the first reading of Ordinance 1320 – An Ordinance Amending Appendix A – Zoning of the Revised Ordinances of the City of Spearfish by Zoning Certain Property and to set a public hearing for July 20, 2020 on the same. (Heritage Addition) Ordinance 1321 – Committee recommended to full council to approve the first reading of Ordinance 1321 – An Ordinance Amending Appendix A – Zoning of the Revised Ordinances of the City of Spearfish by Zoning Certain Property and to set a public hearing for July 20, 2020 on the same. (Airport) Resolution 2020-14 – Committee recommended to full council approval of Resolution 2020-14 – A Resolution of Annexation to Extend the Boundaries of the City of Spearfish, South Dakota by Annexing Lands more Specifically Described Herein. (Two parcels at airport) Ordinance 1322 – Committee recommended to full council to approve the first reading of Ordinance 1322 – An Ordinance Amending Appendix A – Zoning of the Revised Ordinances of the City of Spearfish by Zoning Certain Property. (Two parcels at airport) Ordinance 1323 – Committee recommended to full council to approve the first reading of Ordinance 1323 – An Ordinance Amending Chapter 10 Licenses, Permits and Business Regulations, Article VII. Peddlers, Section 10-214 and Repealing Section 10-215 of the Revised Ordinances of the City of Spearfish. Name – Committee recommended to full council the names of Sky Ridge, Foothills Village, Sunrise Village or The Foothills for the name of the Workforce Housing Development. Public Safety Volunteer – Committee recommended to full council to add Erin Magee to the volunteer firefighter list. Public Comment – Public comment section was opened at 4:33 p.m. and closed with no comments. Additional Comments – City Administrator Harmon noted the SD Department of Revenue has preliminarily determined the classification for TIF6 to be Affordable Housing for the purposes of the State Aid to Education formula. Finance Officer DeNeui noted an abatement request will be on the council agenda for consideration. There being no further discussion before the committee, the meeting was adjourned at 4:35 p.m.
