Legal, Finance, and Public Safety Committee Minutes
July 15, 2020
The Legal, Finance and Public Safety Committee met in the Council Chambers of C i t y H a l l at
4:15 p.m. on Wednesday, July 15, 2020 with the following committee members present:
Eisenbraun, Jacobs and Klarenbeek. Absent: none. Also present were: Public Safety
Director Rotert, City Attorney McDonald, Public Works Director Lee, City
Planner Watson, Human Resource Director Mathis, Recreation Facility
Superintendent Rauterkus, Police Chief Jacobs, Assistant Police Chief Dean and
Finance Officer DeNeui.
City Attorney
Resolution 2020-17 – Committee recommended to full council to adopt Resolution 2020-17 – A
Resolution of Intent to Enter into a Lease Agreement. (Homeslice Media)
Provider – Committee recommended to full council to approve Kids Point Daycare and Preschool as
the chosen provider for the daycare at the Spearfish Recreation and Aquatics Center and authorize
staff to negotiate the terms of a contract for council’s consideration.
Finance
License – Committee recommended to full council to approve a special on-sale wine license for
Nonna’s Kitchen for the Downtown Friday Night Events from 5:00 p.m. to 10:00 p.m.
Human Resources
Hire – Committee recommended to full council, consent agenda, to hire Samantha Rosenau as full-
time (benefit-eligible) police officer, grade 18, step 5, $24.46 per hour, effective 8/3/2020.
Hire – Committee recommended to full council, consent agenda, to hire Dillon Smith part-time (not
benefit-eligible) recreation assistant, grade 7, step 1, $13.13 per hour, effective 7/21/2020.
Hire – Committee recommended to full council, consent agenda, to hire Madison Bates part-time
(not benefit-eligible) recreation assistant, grade 7, step 1, $13.13 per hour, effective 7/21/2020.
Parks and Recreation
Event – Items from visitors will include BHSU to request approval of the BHSU Triathlon
Invitational special event request for Sunday, September 6, 2020.

Ordinance 1320 – Committee recommended to full council to hold a public hearing and approve
second reading of Ordinance 1320 – An Ordinance Amending Appendix A - Zoning of the Revised
Ordinances of the City of Spearfish by Zoning Certain Property. (Heritage Addition)
Ordinance 1321 – Committee recommended to full council to hold a public hearing and approve
second reading of Ordinance 1321 – An Ordinance Amending Appendix A - Zoning of the Revised
Ordinances of the City of Spearfish by Zoning Certain Property. (Airport)
Ordinance 1322 – Committee recommended to full council to hold a public hearing and approve
second reading of Ordinance 1322 – An Ordinance Amending Appendix A - Zoning of the Revised
Ordinances of the City of Spearfish by Zoning Certain Property. (Two parcels at airport)
Ordinance 1323 – Committee recommended to full council to approve the second reading of
Ordinance 1323 – An Ordinance Amending Chapter 10 Licenses, Permits and Business Regulations,
Article VII. Peddlers, Section 10-214 and Repealing Section 10-215 of the Revised Ordinances of the
City of Spearfish.
Annexation – Committee recommended to full council to initiate an annexation for the S 17′ of the
N50′ of the NW1/4 and the S 17′ of the N50′ of the NW1/4 of the NE1/4, both of Section 21, T6N,
R3E, BHM, Lawrence County.
Resolution 2020-19 – Committee recommended to full council to approve Resolution 2020-19 – A
Resolution of Annexation for the S 17′ of the N50′ of the NW1/4 and the S 17′ of the N50′ of the
NW1/4 of the NE1/4, both of Section 21, T6N, R3E, BHM, Lawrence County.
Ordinance 1324 – Committee recommended to full council to approve first reading and set a public
hearing for August 3, 2020 for Ordinance 1324 – An Ordinance Amending Appendix A – Zoning of
the Revised Ordinances of the City of Spearfish by Zoning Certain Property. (S 17′)
Public Works
Permit – Committee recommended to full council to authorize Mayor Boke to sign and accept the
South Dakota DENR Surface Water Discharge Permit and Statement of Basis.
Public Comment – Public comment section was opened and closed with no comments.
Additional Comments – Public Works Director Lee noted the summer cleanup is being held this
Friday – Sunday, July 17-19, at the Restricted Use Site. Allowable items will be taken free of charge
during the cleanup event.
There being no further discussion before the committee, the meeting was adjourned at 4:42 p.m.
