Legal, Finance, and Public Safety Committee Minutes
July 29, 2020
The Legal, Finance and Public Safety Committee met in the Council Chambers of C i t y H a l l at
4:15 p.m. on Wednesday, August 12, 2020 with the following committee members present:
Eisenbraun, Jacobs and Klarenbeek. Absent: none. Also present were: City
Administrator Harmon, City Attorney McDonald, City Planner Watson, Human
Resource Director Mathis, Finance Officer DeNeui, Fire Chief Deaver, and Police
Chief Jacobs.
City Administration
FYI – The 2021 departmental budget presentations during city council are scheduled as follows:
8/3/2020 – Human Resources, Public Works, Engineering, Public Safety, Library, and
Planning & Zoning.
8/17/2020 – City Administration, City Attorney, Finance, and Parks and Recreation.
City Attorney
Agreement – Committee recommended to full council to approve the Facility Lease and Use
Agreement with Kids Point, LLC for daycare at the Spearfish Recreation and Aquatic Center.
Finance
Transfer License – Committee recommended to full council to hold public hearing to consider an
application from Keith Cullinan with Aladdin Food Management Services @ BHSU to transfer an
(on-off sale) wine license from Aviands LLC located at 1200 University Street, BHSU Campus
excluding the Joy Center. Consideration of the transfer of the license will follow the public hearing.
Fees – Committee recommended to full council to authorize the finance office to make the second
quarter budgeted administrative fees for personnel and information technology costs.
Underwriter – Committee recommended to full council to engage Colliers Securities LLC as the
underwriter for the Sales Tax Revenue Bonds, Series 2020 and authorize staff to sign the Letter of
Intent and disclosure forms required.
Resolution 2020-21 – Committee recommended to full council to adopt Resolution 2020-21 – A
Resolution Authorizing the Execution, Terms, Issuance, Sale and Payment of Sales Tax Revenue
Bonds, Series 2020 in the Aggregate Principal Amount of Not to Exceed Ten million and No/100
($10,000,000.00), of the City of Spearfish of Lawrence County, South Dakota.
Refinance – Committee recommended to full council to begin the process to refinance the 2008
WWTP Clean Water State Revolving Fund Bond with a potential savings over the remaining life of
$120,000 to the Sewer Fund.
Purchase – Committee recommended to full council to purchase three Microsoft Datacenter 16
Core Government Licenses with software assurance for 2 years at a cost of $20,922.84.
Human Resources
Hire – Committee recommended to full council, consent agenda, to hire Travis Morgan as a full-
time, benefit-eligible solid waste collector/operator, grade 10, step 12, $18.93 per hour effective
August 18, 2020. (Hiring contingent upon results of background checks and pre-employment drug
screen).
Planning & Zoning
Ordinance 1324 – Committee recommended to full council to approve first reading and set a public
hearing for September 8, 2020 for Ordinance 1324 – An Ordinance rezoning the two 17-foot strip
parcels along Colorado Boulevard.
Ordinance 1325 – Committee recommended to full council to hold a public hearing and approve
second reading of Ordinance 1325 – An Ordinance concerning Lots 1B-1 through 1B-8 of Block 4
Heritage Addition.
Ordinance 1326 – Committee recommended to full council to approve first reading and set a public
hearing for September 8, 2020 for Ordinance 1326 – An Ordinance amending Appendix A Zoning,
Article V. Supplementary Regulations, Section 6. Sign Regulations.
Resolution 2020-18 – Committee recommended to full council to adopt Resolution 2020-18 – A
Resolution Establishing the Boundaries of Tax Increment Finance District Number 6.
Lease – Committee referred to full council the request to provide direction concerning Riverfront
Broadcasting’s request to renegotiate a ground lease on Lookout Mountain. Three options were
discussed and no recommendation was provided.
Public Comment – Public comment section was opened and closed with no comments.
There being no further discussion before the committee, the meeting was adjourned at 4:50 p.m.
