City of Spearfish Legal, Finance, and Public Safety Committee Minutes September 2, 2020 The Legal, Finance and Public Safety Committee met in the Council Chambers of C i t y H a l l at 4:15 p.m. on Wednesday, September 2, 2020 with the following committee members present: Eisenbraun, Jacobs and Klarenbeek. Absent: none. Also present were: City Administrator Harmon, City Attorney McDonald, City Planner Watson, Public Safety Director Rotert, Finance Officer DeNeui, and Assistant Finance Officer Thurmes. City Attorney Ordinance 1327 – Committee recommended to full council to approve the first reading of Ordinance 1327 – An Ordinance Amending Chapter 14 Streets, Sidewalks and Other Public Places, Article VI. Cemeteries of the Revised Ordinances of the City of Spearfish. Ordinance 1328 – Committee recommended to full council to approve the first reading of Ordinance 1328 – An Ordinance Amending Chapter 9 Health, Sanitation and Nuisances, Article II. Nuisances of the Revised Ordinances of the City of Spearfish. Resolution 2020-26 – City Attorney McDonald stated this resolution will be presented at a future committee meeting. Finance Resolution 2020-24 – Committee recommended to full council to adopt Resolution 2020-24 – A Resolution Amending the City of Spearfish Credit Card Acquisition and Use Policy. Policy – Committee recommended to full council to adopt Policy 4.1 Purchasing. Ordinance 1331 – Finance Officer DeNeui presented the first reading of Ordinance 1331 – 2021 Appropriations Ordinance. Business representatives and residents of Jared DeGraff, Mark Kazmer, John Dale, Nathan Hoogshagen, Greg Krier, and Mistie Caldwell spoke against the proposed reduction to funding for Visit Spearfish. Committee referred to full council with no recommendation the first reading of Ordinance 1331 – 2021 Appropriations Ordinance. Power – Finance Officer DeNeui presented the request for the installation of speaker power as requested by Spearfish Downtown Business Association at a price of $11,750 to be funded from Hospitality Fund allocation to Visit Spearfish. After power installation, speakers will be mounted near the top of decorative light poles on both sides of Main Street between Jackson Boulevard and Hudson Street. Nathan Hoogshagen, Spearfish Downtown Business Association Executive Director, noted they are not in support of the funding being taken from the allocation to Visit Spearfish in 2020 and reviewed the overall project plan. Committee referred the request to full council with no recommendation. Planning & Zoning Ordinance 1324 – Committee recommended to full council to hold a public hearing and approve second reading of Ordinance 1324 – An Ordinance Amending Appendix A – Zoning of the Revised Ordinances of the City of Spearfish by Zoning Certain Property. (A change in zoning from County AG to City AG for the 17-foot-wide strip of city-owned land located south of Colorado Boulevard.) Ordinance 1326 – Committee recommended to full council to hold a public hearing and approve second reading of Ordinance 1326 – An Ordinance Amending Appendix A. Zoning, Article V. Supplementary Regulations, Section 6. Sign Regulations of the Revised Ordinances of the City of Spearfish. Dedication – Committee recommended to full council to authorize Mayor Boke to sign the following documents related to the dedication of Red Fern Court, Gooseberry Road, Foxglove Court, and Buttercup Court: 1) Dedication and Acceptance of Public Improvements 2) Storm Drain easement agreement pertaining to Foxglove Court 3) Drainage and Utility Easement document pertaining to Red Fern Court Public Comment – Public comment section was opened with comments from Mark Kazmer on Hospitality Tax collections by Airbnb and VRBO and volunteering to assist in finding sponsorships for the sports complex fields. Additionally, a request was made by Doug Deppe with the Spearfish School District to waive the building permit fees for the District’s multiple roof repair projects. The request will be on the full council agenda. Wildland Crews – Public Safety Director Rotert noted the wildland fire crews have returned from a 21-day deployment to Colorado and will restates soon for additional deployments. There being no further discussion before the committee, the meeting was adjourned at 5:17 p.m.
