September 16, 2020
The Legal, Finance and Public Safety Committee met in the Council Chambers of C i t y H a l l at
4:15 p.m. on Wednesday, September 16, 2020 with the following committee members present:
Eisenbraun and Klarenbeek. Absent: Jacobs. Also present were: City Administrator
Harmon, City Attorney McDonald, Human Resource Director Mathis, City Planner
Watson, Public Safety Director Ro tert, and Finance Officer DeNeui.
City Attorney
Ordinance 1327 – Committee recommended to full council to approve the second reading of
Ordinance 1327 – An Ordinance Amending Chapter 14 Streets, Sidewalks and Other Public Places,
Article VI. Cemeteries of the Revised Ordinances of the City of Spearfish.
Ordinance 1328 – Committee recommended to full council to approve the second reading of
Ordinance 1328 – An Ordinance Amending Chapter 9 Health, Sanitation and Nuisances, Article II.
Nuisances of the Revised Ordinances of the City of Spearfish.
Ordinance 1329 – Committee recommended to full council to approve the first reading of
Ordinance 1329 – An Ordinance Amending Chapter 17, Traffic and Vehicles, Article VI. Stopping,
Standing and Parking of the Revised Ordinances of the City of Spearfish.
Ordinance 1330 – Committee recommended to full council to approve the first reading of
Ordinance 1330 – An Ordinance Amending Chapter 4 Alcoholic Beverages, Article I. Licenses and
General Provisions of the Revised Ordinances of the City of Spearfish.
Ordinance 1331 – Committee recommended to full council to approve the first reading of Ordinance
1331 – An Ordinance Amending Chapter 14 Streets, Sidewalks and Other Public Places, Article V.
Use of Municipal Rights-of-Way (ROW) and Other Properties of the Revised Ordinances of the City
of Spearfish.
Finance
Ordinance 1332 – Committee recommended to full council to approve the second reading of
Ordinance 1332 – 2021 Appropriations Ordinance.
Public Safety
Hire – Committee recommended to full council to hire Travis Ladson as full-time (benefit eligible),
fire chief, grade 23, step 1, $33.54 per hour ($69,763.20 annual salary), effective 10/5/2020.
Human Resources
Hire – Committee recommended to full council, consent agenda, to hire Brandy Kean as a part-time
(not benefit eligible) project engineer (PE), grade 22, step 22, $46.06 per hour, effective 9/28/2020.
This position will be utilized up until the time we find a candidate to fill the full-time position.
Policy – Committee recommended to full council to adopt employee negative leave balance
administrative policy.
Planning & Zoning
Resolution 2020-28 – Committee recommended to full council to adopt Resolution 2020-28 – A
Resolution Approving the Project Plan for Tax Increment District Number Six, City of Spearfish.
Dedication – Committee recommended to full council to authorize Mayor Boke to sign the
following documents related to the dedication of Red Fern Court, Gooseberry Road, Foxglove Court,
and Buttercup Court:
1) Dedication and acceptance of public improvements
2) Storm drain easement agreement pertaining to Foxglove Court
3) Drainage and utility easement document pertaining to Red Fern Court
Ordinance 1333 – Committee recommended to full council to approve first reading of Ordinance
1333 – An Ordinance Repealing Ordinance 1320.
Public Comment
The public comment section was opened at 4:31 p.m. and closed with no comments.
City Administrator Harmon noted Moody’s Investors Services have rated the City at Aa3 and the
upcoming Sales Tax Bond issue as an A1. These rates are unchanged from the last rating and indicate
the solid credit profile of the City. The authorization to settle the bonds will be presented to full
council. Harmon also noted the bids received for the Sky Ridge Infrastructure Project were very
favorable and will be presented to full council on Monday to award the bid. City Planner Watson
noted the Planning Commission recommended a revision to the subdivision ordinances that would
allow one acre lots to have private wastewater systems. This ordinance change will be presented to
council at a future date.
There being no further discussion before the committee, the meeting was adjourned at 4:35 p.m.
