City of Spearfish Legal, Finance, and Public Safety Committee Minutes April 14, 2021 The Legal, Finance and Public Safety Committee met at 4:15 p.m. in the Council Chambers of City Hall on Wednesday, April 14, 2021 with the following committee members present: Jacobs, Klarenbeek and Lee. Absent: None. Also present were: City Administrator Harmon, City Attorney McDonald, Human Resource Director Mathis, City Planner Watson, Public Safety Director Rotert, Finance Officer DeNeui, Police Chief Jacobs, Parks and Recreation Director Ehnes and Mayor Boke. Public Comment The public comment section was opened at 4:30 p.m. and closed with no comments. City Administration/Mayor Condrey Study – Following discussions, committee forwarded with no recommendation the approval of implementation of grade and step schedule B with equity as described in the Condrey Study. Finance FYI – There will be a Special Session on April 19, 2021 to canvass votes from recent election. The regular session will immediately follow. PILT Transfers – Committee recommended to full council to authorize finance office to make the Payment in Lieu of Tax (PILT/PILOT) transfers. Transfer – Committee recommended to full council to transfer $25,000.00 from General Fund to Historic Procurement Fund. Planning & Zoning Miller Ranch – Committee recommended to full council the following zoning and preliminary plat approvals for the Miller Ranch area: A. Hold a public hearing on Monday, April 19, 2021 on Ordinance 1341 – An Ordinance Amending Appendix A – Zoning of the Revised Ordinances of the City of Spearfish by Zoning Certain Property. (Change zoning from County Agriculture to Development Review District) B. Approve second reading of Ordinance 1341 – An Ordinance Amending Appendix A – Zoning of the Revised Ordinances of the City of Spearfish by Zoning Certain Property. C. Approve conditions of DRD approval. D. Approve the development agreement for Miller Ranch. E. Approve Preliminary Plat for Phase 1. Preliminary Plat – Committee recommended to full council to approve a preliminary plat and variance located in the 3-mile extra territory platting jurisdiction for the Western Slope Subdivision. Public Safety Ordinance 1343 – Committee recommended to full council to approve the second reading of Ordinance 1343 – An Ordinance Amending Chapter 9 Vegetation, Article II. Trees, Division 3. Planting and Maintenance, Section 19-72. Trees on Private Property and Adding Sections 19-77 Wilt Disease and Invasive Species Information and Advisory Guide, 19-78 Hazardous Tree Emergency Declaration and 19-79 Additional Power of Administrative Staff of the Revised Ordinance of the City of Spearfish. Agreement – Committee recommended to full council to approve the agreement and waiver for the fire department to conduct training exercises on private property. Volunteer – Committee recommended to full council, consent agenda, to add Katie Clark to the volunteer firefighter list. No additional discussions were held and the meeting was adjourned at 4:55 p.m.
