Minutes Tuesday, February 20, 2018
The Spearfish Planning Commission met in regular session on Tuesday, February 20, 2018 at 3:00 p.m. in the
council chambers at Spearfish City Hall. Members present: Toby Bordewyk, Dan Green, Jim Hopewell, Greg
Kruskamp, Bob Meyer, Drew Skjoldal, Larry Vavruska. Members absent: Barbara Zwetzig. Also present: City
Planner Jayna Watson, City Administrator Mike Harmon, Assistant City Planner Desirae Mayo, and City Attorney
Eric Davis.
The meeting was called to order by Vice Chairman Bordewyk at 3:00 p.m.
APPROVAL OF MINUTES:
Kruskamp moved to approve the minutes of the Planning Commission meeting of Tuesday, February 6, 2018
as presented. The motion was seconded by Vavruska and passed unanimously.
DECLARATION OF CONFLICTS OF INTEREST:
Bordewyk asked for any potential conflicts of interest to be identified. During the course of the meeting, Greg
Kruskamp stated for the record he owns property in downtown Spearfish; however, he has no conflict of interest as
it pertains to the proposed zoning ordinance text amendment pertaining to front yard setbacks.
1. Amendments to The Revised Ordinances for the City of Spearfish, Appendix A – Zoning, Article IV,
District Regulations, Sections 2, 3 and 4 (R1, R-2 and R-3 zoning districts respectively) regarding front
yard setbacks in residential zoning districts.

Location: Residential zoning districts in downtown Spearfish
City Planner Jayna Watson referred to the staff report which contained detailed analyses based on extensive
research in response to the four questions posed by the commission at the February 6th meeting and concluded
with findings which support the proposed text amendments. Comments have been received from local
residents concerned about the proposed change and from those in favor of the changes being considered.
Vice Chairman Bordewyk opened the public hearing at 3:20 pm. Testimony was offered by Ms. Randi Smith,
Greg Dias, Lennis Larson, and Whitney Driscoll. Bordewyk closed the public hearing at 3:32 pm.
Following considerable discussion regarding parking requirements, vegetation protection, neighborhood
aesthetics and structures located in historic districts, Vavruska moved to recommend approval of proposed
zoning ordinance text amendments to The Revised Ordinances for the City of Spearfish, Appendix A –
Zoning, Article IV, Sections 2, 3 and 4 (R1, R-2 and R-3 zoning districts respectively) pertaining to front
yard setbacks as presented. The motion was seconded by Green. Meyer requested time for further review
and upon vote taken thereon, the motion failed by a vote of 3-4, with Green, Skjoldal and Vavruska
voting Aye; Meyer, Hopewell, and Kruskamp voted No; Bordewyk cast the tie-breaking vote of No.
Motion was made by Meyer and seconded by Kruskamp to continue this matter to the next planning
commission meeting. Upon vote taken thereon, the motion passed by a vote of 4-2 with Green and
Vavruska voting No.
2. Update to The Revised Ordinances for the City of Spearfish, Appendix A – Zoning, Article II,
Definitions and Article IV, District Regulations, Sections 2, 3 and 4 (R1, R2, and R3 zoning districts) all
pertaining to Conditional Use Permits.
Applicant: City of Spearfish
Location: City-wide
City Planner Jayna Watson presented the final draft of proposed zoning ordinance text amendments pertaining
to Conditional Use Permits. Motion was made by Meyer to set a public hearing for Tuesday, March 6,
2018 to consider revisions to The Revised Ordinances for the City of Spearfish, Appendix A – Zoning,
Article II, Definitions and Article IV, District Regulations, Sections 2, 3 and 4 (R1, R2, and R3 zoning
districts) all pertaining to Conditional Use Permits. The motion was seconded by Vavruska and upon
vote taken thereon passed unanimously.
3. Voluntary Annexation and Concurrent Change of Zoning from County Agriculture (A-1) to Agriculture
(AG) District.
Applicant: Spring Creek Ranch LLC
Location: W½NE¼ NW¼, Section 24, T6N, R2E
The applicant, Rick Furnish, briefly commented on the annexation request and anticipated sale of a five (5)
acre piece of the twenty (20) acre parcel. The potential buyer plans to build a single family home. Watson
presented a brief overview of the information outlined in the staff report.
Vice Chairman Bordewyk opened the public hearing at 4:39 pm. Gerry Avery offered testimony. Bordewyk
closed the public hearing at 4:47 pm
Motion was made by Meyer, seconded by Vavruska and passed unanimously recommending approval of
the request by Spring Creek Ranch, LLC for voluntary annexation and concurrent change of zoning
from County Agriculture (A-1) to Agriculture (AG) for property located in the W½NE¼NW¼ of
Section 24, T6N, R2E.
4: Request for Change in Zoning from Single-Family Residential (R1) to Office Commercial (C-3)
Applicant: Lisa Coolley – Cool Concepts Travel Inc.
Location: E 70’ of Lots 1 & 2, Block 16, Original Town
745 E 11th Street
Watson detailed a request by Lisa Coolley to operate a travel agency from an existing home located at 745 E
11th Street, zoned single-family residential (R1) at this time. It was the consensus of the planning commission
to consider an application for a Conditional Use Permit (CUP) for this request, pending city council approval
of the proposed zoning ordinance text amendments pertaining to CUPs.
CITY COUNCIL UPDATE:
No report was given. The city council will meet this evening due to the Monday observance of Presidents Day.
ADJOURNMENT:
There being no further business to come before the commission, meeting adjourned at 5:04 pm.
