Minutes Tuesday, March 6, 2018
The Spearfish Planning Commission met in regular session on Tuesday, March 6, 2018 at 3:00 p.m. in the council
chambers at Spearfish City Hall. Members present: Toby Bordewyk, Dan Green, Jim Hopewell, Greg Kruskamp,
Bob Meyer, Drew Skjoldal, and Barbara Zwetzig. Absent: Larry Vavruska. Also present: City Planner Jayna
Watson, City Administrator Mike Harmon, Assistant City Planner Desirae Mayo, and City Attorney Eric Davis.
Chairman Zwetzig called the meeting to order at 3:00 p.m.
APPROVAL OF MINUTES:
Meyer moved to approve the minutes of the Planning Commission meeting of Tuesday, February 20, 2018 as
presented. The motion was seconded by Kruskamp and passed unanimously.
DECLARATION OF CONFLICTS OF INTEREST:
Zwetzig asked for any potential conflicts of interest to be identified. None were declared.
1. Consider Amendments to The Revised Ordinances for the City of Spearfish, Appendix A – Zoning,
Article IV, District Regulations, Sections 2, 3 and 4 (R1, R-2 and R-3 zoning districts respectively) –
front yard setbacks.
Applicant: City of Spearfish
Location: Residential zoning districts in downtown Spearfish
City Planner Jayna Watson presented an overview of recent findings based on ongoing research underway in
an attempt to expose any adverse effect that might result should the planning commission recommend
approval of the proposal to reduce the minimum front yard setback requirement from twenty five feet (25’) to
twelve feet (12’) in residential zoning districts in downtown Spearfish. Following lengthy discussion, motion
was made by Bordewyk to continue discussion and further review of the proposed zoning ordinance text
amendment to Appendix A – Zoning, Article IV, Sections 2, 3 and 4 (R1, R-2 and R-3 zoning districts
respectively) pertaining to front yard setbacks. The motion was seconded by Meyer and upon vote
taken thereon, motion carried with Green voting No.
2. Update to The Revised Ordinances for the City of Spearfish, Appendix A – Zoning, Article II,
Definitions and Article IV, District Regulations, Sections 2, 3 and 4 (R1, R2, and R3 zoning districts) all
pertaining to Conditional Use Permits.
Applicant: City of Spearfish
Location: City-wide
City Planner Jayna Watson presented the final draft of a document which outlines the proposed zoning
ordinance text amendments pertaining to Conditional Use Permits.
Chairman Zwetzig opened the public hearing at 4:00 pm. No testimony was heard and Zwetzig closed the
public hearing at 4:00 pm.
Motion was made by Meyer to recommend approval of the proposed zoning ordinance text amendment
to the Revised Ordinances for the City of Spearfish, Appendix A – Zoning, Article II, Definitions and
Article IV, District Regulations, Sections 1a., 1b., 2, 3 and 4 (RLS-1, AG, R1, R2, and R3 zoning
districts) and Article VI, Section 3, all pertaining to Conditional Use Permits as presented. The motion
was seconded by Bordewyk and upon vote taken thereon passed unanimously.
3. Request: Development Review District (DRD) Final Plan and Preliminary Plat Approval for a mixed-
use commercial development in a DRD zoned parcel.
Applicant: The Granary, LLC (Rick Furnish)
Location: Lot 2 of Lot 1R of Block 3 of Della Vecchia Addition
The Villages at Creekside, Yukon Place
Jason Roberdeau, Architect at Williams & Associates Architecture, Inc., presented an overview of a proposed
two phase mixed use commercial development on behalf of the applicant, The Granary, LLC, including a site
plan and preliminary plat of Lots 1, 2, 4, 5, 6, 7 and street right of way located in part of Lot 1R of Block 3 of
the Della Vecchia Addition. Motion was made by Bordewyk to recommend approval of the DRD Final
Plan for mixed-use commercial development in a DRD-zoned parcel and approval of the Preliminary
Plat as presented. The motion was seconded by Green and upon vote taken thereon passed unanimously.
CITY COUNCIL UPDATE:
Watson commented briefly on matters before the council at the meeting last evening.
ADJOURNMENT:
There being no further business to come before the commission, Bordewyk moved to adjourn at 4:32 pm. The
motion was seconded by Green and passed unanimously.
