Spearfish Planning Commission Regular Meeting Minutes Tuesday, May 1, 2018 The Spearfish Planning Commission met in regular session on Tuesday, May 1, 2018 at 3:00 p.m. in the council chambers at Spearfish City Hall. Members present: Toby Bordewyk, Greg Kruskamp, Bob Meyer, Drew Skjoldal, and Barbara Zwetzig. Absent: Dan Green, Jim Hopewell and Larry Vavruska. Also present: City Planner Jayna Watson, Assistant City Planner Desirae Mayo and City Attorney Eric Davis. Chairman Zwetzig called the meeting to order at 3:00 p.m. APPROVAL OF MINUTES: Meyer moved to approve the minutes of the Planning Commission meeting of Tuesday, April 17, 2018 as presented. The motion was seconded by Kruskamp and upon vote taken thereon passed unanimously. DECLARATION OF CONFLICTS OF INTEREST: Zwetzig asked for any potential conflicts of interest to be identified. None were declared. 1. Request: Conditional Use Permit to Allow an Office in Single-Family Residential (R1) zoning. Applicant: Lisa Coolley – Cool Concepts Travel Inc. Location: E 70’ of Lots 1 & 2, Block 16, Original Town - 745 N 11th Street City Planner Jayna Watson referred the commission to the “Findings” commencing on page seven (7) of the staff report which are determined based on the Conditional Use Permit evaluation criteria established in city ordinance. Each criteria item was presented for consideration and discussion. Additional conditions were recommended regarding parking, signage and restricting the business operations to the main floor of the residence. Chairman Zwetzig opened the public hearing at 3:12 pm. No testimony was offered and Zwetzig the public hearing at 3:12 pm. Motion was made by Bordewyk and seconded by Kruskamp to approve a Conditional Use Permit to allow an office (travel agency) in a Single-Family Residential (R1) zoning district on property legally described as the E 70’ of Lots 1 & 2, Block 16, Original Town, located at 745 N 11th Street, and to approve the Findings presented in the staff report and including certain conditions of approval noted in item thirteen (13) revised as follows: a) Signage, if provided, shall be per Article V, Section 6 of the zoning code; no direct or indirect sign illumination shall be permitted; b) Only the ground floor/main floor of the structure may be used for office purposes; c) Three off-street parking spaces shall be required and provided based on the proposed use of the building, and as indicated on the site plan on page six of the May 1, 2018 Spearfish Planning Commission Staff Report; d) Outdoor lighting, if provided, shall be fully shielded and directed downward. Upon vote taken thereon, the motion passed unanimously. 2. Request: Preliminary Plat Approval. Applicant: Professional Mapping & Surveying, LLC for Ryan Wordeman Location: Preliminary Plat of Lots 1 through 15 of Block 6 of Evans Addition to the City of Spearfish Watson referred to the preliminary plat which, if approved, will enable the platting and development of fifteen (15) single family lots for residential construction. She presented an overview of the staff analysis which addresses secondary pedestrian and vehicular access to 2nd Street, connectivity to the recreation path and probable floodplain mapping revisions. Chairman Zwetzig opened the public hearing at 3:27 pm. No testimony was offered and Zwetzig the public hearing at 3:27 pm. Motion was made by Meyer to recommend approval of the Preliminary Plat of Lots 1 through 15 of Block 6 of Evans Addition to the City of Spearfish as presented. The motion was seconded by Skjoldal and upon vote taken thereon passed unanimously. 3. Request: Updates to the Conditional Use Permit Land Use Lists for Central Commercial (C-1), Central Core Commercial (CC), Highway Service Commercial (C2) and Office Commercial (C-3) zoning districts. Applicant: City of Spearfish Location: All commercial zoning districts There was considerable discussion regarding the proposed zoning ordinance text revisions pertaining to Conditional Use Permits in commercial zoning districts city-wide. The planning commission opted to forego setting a public hearing date at this time, requesting further review of additional changes recommended. CITY COUNCIL UPDATE: No report was given. ADJOURNMENT: There being no further business to come before the commission, Zwetzig adjourned the meeting at 3:45 p.m.
