Town of St. Joseph - St. Croix County, WI Minutes of the Town Board Meeting St. Joseph Town Hall November 14, 2024 Call to Order by Chair Theresa Johnson at 6:00 pm Statement of Public Notice read by Clerk Roll Call: Chair Theresa Johnson, Dan Gavin, Matt Moore, Chris Marshall, Justin Kruse, Engineer Lee Mann, Attorney Nick Vivian Adoption of Agenda: MOTION to adopt the agenda as presented (Kruse/Marshall). Motion carried. Pledge of Allegiance recited Public Comment: Laurie DeRosier questioned the Code 170-26 setback of 10 feet. Business discussion and possible action on: 1. Eckert Blufflands road connections – Jason Kjeseth from St Croix County Community Development: Jason was present to discuss the bike trails and answer questions. Jason responded to a question about the guardrail damage on County Road E stating the Highway Dept would be in charge of that issue. a. Bike trail connections and town property: Jason discussed the current plans for the Eckert Blufflands. Responded to questions from the Board and the residents. Michael Givens, resident, 233 River Heights Trail, made a comment that he is happier with the revised plan and stated that the County has completed everything that they said they would to date. Jason discussed the agreement needed from the Town to utilize the Town property to extend the bike trail and obtain a TAP grant. Jason stated the plan is to go into the north west corner of Willow River State Park and not utilize Trout Brook Road. Joel Magnus, Hwy 35 and County V, resident, asked if the trail was coming out of the west side or the east side. Jason stated they are coming down the east side. Dan Schulte, County V and Hwy 35 north side, questioned the trail going onto his property. MOTION that the Town of St. Joseph move forward with St. Croix County in the spirit of cooperation for the possible access or easement of Town-owned property for the Phase 2 development of the bike trail moving north on Highway 35 and east on County Road V (Gavin/Moore). Motion carried. b. Stormwater review in the Town: Jason discussed the stormwater reviews for the Town. Discussed creating a MOU for the Town to work with the County for the stormwater reviews. Lee Mann suggested the Board should review and consider. Jason will send an agreement to the Town. 2. Lot Line Adjustment-Michael Givens, 233 Cedar Dr. W, PID#030-2020-70-0000: Michael Givens was present and discussed the lot line adjustment from 3 lots to 1 lot. MOTION to accept the lot line adjustment for Michael Givens at 233 Cedar Dr. W, PID #030-2020-70-000 (Marshall/Moore). Motion carried. 3. CSM-Carlson-Zenner 1374 Fox Ridge Trail PID#030-1083-10-000: Doug Zahler and Jeff Carlson discussed the CSM. MOTION to accept the CSM for Carlson-Zenner at 1374 Fox Ridge Trail, PID #030-1083-10-000 (Marshall/Kruse). Motion carried. 4. Consider payment for 144th Avenue Project [Vader, Steve]: Lee Mann discussed the pay request for the 144th Avenue Project. Discussed future payments for base course paving, wear course paving, and punch list items. Discussed payment and invoices owed by Mr. Vader. MOTION to pay to Steve Vader for the 144th Avenue in the amount of $69,022.76 conditional upon him paying the invoices he owes the town minus the two invoices from Stantec for road review construction and that those will be decided before the next meeting (Johnson/Marshall). Lee Mann stated we would like to see the design invoices from his engineer as soon as possible for this project. Asked Mr. Vader to provide proof of payments to contractors. Motion carried. 5. Preliminary Plat-St. Croix Crossing West of Hwy 35 [Furseth] PID#030-2064-70-101, 030-2064-60- 101, 030-2064-50-000: Louis Filkins was present to discuss the preliminary plat. Lee Mann discussed the roadways within the development and access to other parcels. Jason Kjeseth discussed the bike trail and how it would tie into this development. The proposed bike path along Hwy 35, but the cemetery could be an issue. Resident asked about crossing before the cemetery, Jason stated the terrain is not as usable on the other side. This developer will return to the Plan Commission and the Board in December. MOTION to move Items 7b and 8 up to this point in the agenda (Johnson/Kruse). Motion carried. 6. Public Works a. Update on no parking signs on Nelson Farm Rd, Ln and Perch Lake Road: Discussed the no parking signs and reasoning behind the signs. Tim Nixon, 481 Nelson Farm Lane, discussed representing his neighbors, who are very upset, and stated there are 33 tow-away signs all over the neighborhood. John Andrews, 503 Nelson Farm Lane, asked if it is possible to have parking on one side of the road. Discussion on other options for no parking on this road. The Board has asked the residents to submit other options proposed for the parking situation. 7. Willow River State Park / Parking - Bike Trail Access: Discussed the parking situation at Trout Brook Road. MOTION that the Town convey to Willow River State Park, via Aaron Mason, that we would be in support of Willow River State Park constructing a 25-car parking lot off of Trout Brook Road with the caveat that no bike trail access would be used on Trout Brook Road itself. (Gavin/Moore). Motion carried. 8. Town Hall Building update a. Pay Request #5 for building-$257,282.80: Bruce Paulson discussed the pay request. MOTION to approve Pay Request No. 5 to Berghammer Builders for $257,282.80 (Johnson/Marshall). Motion carried. b. St Croix Electric rebates: This was sent by Clerk. c. Midwest Gas, Northwest Communications, St Croix Electric connections: They are all plowed in and all to the building. These are done. d. Approve quotes for Sunnylink Systems for technology: Discussed the quotes received from Sunnylink. MOTION to approve Quotes 22011 and 22010 with the caveat of two things: that he change out the wall mount depth cabinet and that we will try to supply a double-sized one that that which is listed and we feel that the Unifi WiFi 6 Pro is not the standard and we would like to have a 7. We will void the current check and rewrite a check to Sunnylink for 50% of $21,864.43 (Johnson/Kruse). Motion carried. e. Pay request from Well installation: Bruce Paulson discussed the well invoice and the reason for the increase in price. MOTION to approve $160,090.00 to be paid to Tim Butterfield Drilling, Inc. with Teri holding the check until she and Bruce are comfortable that all documentation has been submitted (Johnson/Marshall). Motion carried. f. Pay request and update from Sanitary System installation: The sanitary system is complete, but we have not yet received an invoice. g. Generator Tracker-Quote from Allied Generator: MOTION to approve the Allied Generator Quote 10466 for $1,350.00 (Johnson/Kruse). Motion carried. h. Projected expenditures and available funds and timeline for construction: Discussed the change order for forming and setting rebar, concrete mix, running gas piping, and rock mulch and edging. i. Update on furnishings for Town hall and Fire Hall: MOTION to approve the finishes as we saw (Marshall/Kruse). Motion carried. 9. Public Works a. 2024 Road Maintenance – update and pay request: Lee Mann discussed the pay request of $77,517.58, which will complete the 2024 Road Maintenance. MOTION to approve Pay Request No. 3 Final to Allied Blacktop Company in the amount of $77,517.58 (Johnson/Marshall). Motion carried. 10. Parks, Trails and Recreation: The DNR will meet with the Town Board on November 15 th to discuss the Preserve issues. 11. Plan Commission a. Junkyards and other chronic nuisances and enforcement issues: None to discuss at this meeting. b. Update to ordinances 1. Ordinance 2024-18- Chapter 68 – Events and event plans: Anton Rang discussed the changes to this ordinance. MOTION to approve Ordinance 2024-18 Chapter 68 Events and Event Plans (Moore/Marshall). Roll Call: Justin Kruse-Aye, Dan Gavin-Aye, Theresa Johnson-Aye, Chris Marshall-Aye, Matt Moore-Aye Motion carried. 2. Ordinance 2024-19 – Chapter 130 – Mobile Homes and Mobile Home Parks: MOTION to approve Ordinance 2024-19 Chapter 130 Mobile Homes and Mobile Home Parks as revised (Kruse/Marshall). Roll Call: Matt Moore-Aye, Dan Gavin-Aye, Chris Marshall-Aye, Theresa Johnson-Aye, Justin Kruse-Aye. Motion carried. 12. Fire Department a. Plan for build out of storage in Fire Hall: Discussed the buildout to the Fire Hall. MOTION to approve the quote we received from Berghammer Builders from November 12th for the St. Joseph’s Fire Station Improvements (Kruse/Marshall). Motion carried. b. New Member – Matthew Jacobs: MOTION to approve Matthew Jacob as a new member of the Fire Department (Moore/Kruse). Motion carried. 13. Operator Licenses: Dylan Neinas – Bass Lake Cheese: MOTION to approve Dylan Neinas, Bass Lake Cheese Factory for an Operator License (Moore/Kruse). Motion carried. 14. Public Records Requests – progress and costs: There has been one public record request for this month. 15. Approval of Town Board minutes – October: MOTION to approve the Town Board Minutes for October 8th, October 10th, and October 24th (Moore/Marshall). Motion carried. 16. Budget, Invoices, checks and bank balances: MOTION to approve Check Nos. 25435 through 25451 including all transfers and epays for this month, and we will void the check to Sunnylink and reissue the new one (Johnson/Kruse). Motion carried. 17. MOTION to go into Closed Session per Wis Stats 19.85(g)-Conferring with legal counsel (Kruse/Moore). Roll Call: Theresa Johnson-Aye, Matt Moore-Aye, Justin Kruse-Aye, Chris Marshall-Aye, Dan Gavin-Aye. Motion carried. Closed Session: Wis Stats 19.85(g)—Conferring with legal counsel who is rendering oral or written advice concerning strategy to be adopted by the body with respect to litigation in which it is or is likely to become involved – trash burning, animal control issues, Cajun Club, illegal campground, vape manufacturing 18. MOTION to go into Open Session (Kruse/Marshall). Roll Call: Chris Marshall-Aye, Dan Gavin- Aye, Theresa Johnson-Aye, Justin Kruse-Aye. Motion carried. a.
