Prince, property owners, for a residential cluster subdivision with a density bonus of 24% over the allowable 305-lots to be located on the north and south sides of Bob White Lane in accordance with Sections 31-306, 31-406, 31-409 and 31-411 of the Unified Development Ordinance A motion was made to consider action on this item at the October 20, 2004, City Council meeting. Approved 7-0 15. Public Hearing - Rezoning Request RZ2-04 (Conditional), submitted by Whitney G. Saunders of Saunders, Babineau, and Brewbaker, P.C. on behalf of PMP, LLC, contract purchaser, and Art-Ray Corp. and Charles D. Parr, Sr., property owners, for rezoning approximately 121.490 acres of land from O-I, Office-Institutional and M-1 Light Industrial, to RLM, Residential Low-Medium Density, to create a 191-lot single-family subdivision A motion was made for denial of the application as presented. The application was denied by a vote of 4-3 (Council Members Brown, Johnson and Milteer voted in opposition.) 16. Ordinance - An ordinance amending Chapter 86 entitled “Traffic and Vehicles” of the Code of the City of Suffolk, Virginia, to include a section regarding the operating of mopeds (This item was continued from the September 1, 2004, City Council Meeting.) Approved 7-0 17. Ordinance - An ordinance amending Chapter 54 entitled “Miscellaneous Offenses” of the  Code of the City of Suffolk, Virginia, to include a section regarding panhandling (This item was continued from the September 1, 2004, City Council Meeting.) A motion was made to consider action on this item at the October 6, 2004, City Council meeting. Approved 7-0 18 Motion - A motion to schedule the City Council Retreat for September 29 – 30 and October 1, 2004 Approved 7-0 19. Motion - A motion to schedule a Work Session for October 6, 2004, at 4:00 p.m., unless canceled Approved 7-0 There was a motion to amend the agenda to consider the following items: An appointment to the Wetlands Board (alternate): M.F. Hall, IV Approved 7-0 Vice Mayor Leroy Bennett and Council Member Brown were designed the voting delegate and alternate delegate, respectively, to the National League of Cities Annual Conference. Approved 7-0 An ordinance amending Chapter 82 Entitled “Taxation” of the City of the City of Suffolk, Virginia, pertaining to Open Space Use Agreements. Approved 7-0 20.
