Consent Agenda – Approval of the minutes Approved 6-0 (Council Member Barlow was excused.) 6. Consent Agenda – An ordinance to accept and appropriate donations to the City – Second Reading Approved 6-0 (Council Member Barlow was excused.) 7. Consent Agenda – An ordinance to accept and appropriate funds in excess of the anticipated amount previously appropriated in the Fiscal Year 2004-2005 annual Operating Budget from the Commonwealth of Virginia Department of Health for the Two-For-Life Program – Second Reading Approved 6-0 (Council Member Barlow was excused.) 8. Consent Agenda – An ordinance to accept and appropriate a supplemental Homeland Security Emergency Management Performance Grant from the Virginia Department of Emergency Management – Second Reading Approved 6-0 (Council Member Barlow was excused.) 9. Consent Agenda – An ordinance to appropriate funds from Unappropriated Retained Earnings of the Utility Fund for use in a contribution to the Western Tidewater Authority – Second Reading Approved 6-0 (Council Member Barlow was excused.) 1 10. Public Hearing – Conditional Use Permit Request C3-05, submitted by Horace Balmer and Sherwin Turner, contract purchasers, on behalf of WYZJ, Limited, property owner, to permit a nightclub in accordance with Sections 31-306 and 31-406 of the Unified Development Ordinance Approved 6-0 (Council Member Barlow was excused.) 15. Public Hearing – Conditional Use Permit Request C4-05, submitted by Michael and Connie Mullholland, property owners, to permit the replacement of a detached accessory dwelling in accordance with Sections 31-306, 31-406 and 31-701 (b) of the Unified Development Ordinance. The property affected is located at 837 North Liberty Springs Road and is further identified as Tax Map 54, Parcel 1D, Whaleyville Voting Borough, Nansemond Taxing District, Zoned A, Agriculture District Approved 6-0 (Council Member Barlow was excused.) 16. Public Hearing – Conditional Use Permit C5-05, submitted by Gerry Jones, Capital Program Director, on behalf of the City of Suffolk, property owner, to permit the construction of a library in accordance with Sections 31-306 and 31-406 of the Unified Development Ordinance Approved 6-0 (Council Member Barlow was excused.) 17. Public Hearing – Ordinance Text Amendment OA2-05 for an amendment to Article 4, Table 406-1, Principal Uses Permitted in Zoning Districts and Appendix A, Definitions of the Unified Development Ordinance as it relates to residential hotels Approved 6-0 (Council Member Barlow was excused.) 2 18. Ordinances – Suffolk Annual Operating Budget for Fiscal Year 2005-2006 and Related Ordinances - An ordinance levying real property taxes for the tax year beginning July 1, 2005, and ending June 30, 2006 – Second Reading - An ordinance to levy taxes on all tangible personal property not either exempt from taxation or otherwise taxed for the 2005 and 2006 tax years– Second Reading - An ordinance approving the City budget and appropriating funds for expenditures contemplated during the fiscal year beginning July 1, 2005, and ending June 30, 2006, in the amount of $314,551,474 and regulating the payment of money out of the City Treasury– Second Reading - An ordinance to amend Chapter 2 “Administration” of the Code of the City of Suffolk concerning compensation of members of the Historic Landmarks Commission– Second Reading - An ordinance to amend Chapter 34 “Environment” of the Code of the City of Suffolk concerning compensation of members of the Wetlands Board– Second Reading - An ordinance approving a fee schedule for the City of Suffolk– Second Reading A motion to approve the School Fund and continue consideration of additional funding with the remaining Fiscal Year 2005-2006 Proposed Operating Budget until the June 1, 2005, City Council Meeting was approved 6-0 (Council Member Barlow was excused.) 19. Motion – A motion to schedule a Work Session for June 1, 2005, at 4:00 p.m., unless canceled. Approved 6-0 (Council Member Barlow was excused.) A motion to amend the agenda to consider the following appointments was approved 6-0 (Council Member Barlow was excused): Resource Conservation and Development Council – Council Member Joseph H.
