Consent Agenda - An ordinance to accept and appropriate funds from the Commonwealth of Virginia for the E-911 wireless service – Second Reading Approved 7-0 7. Consent Agenda - An ordinance to accept and appropriate Fiscal Year 2005 – 2006 Community Development Block Grant (CDBG) funding – Second Reading Approved 7-0 8. Consent Agenda – An ordinance to accept and appropriate funds from the Burbage Grant Homeowners Association and CTR Associates, LLP for sidewalk construction on Respass Beach Road from Townpoint Road to McLauren Drive – Second Reading Approved 7-0 * * * * * * * * * * * * * 9. Public Hearing – Conditional Use Permit Request C14-05, submitted by the City of Norfolk, Department of Utilities, property owner, to permit dam safety modifications for Lake Burnt Mills Reservoir in accordance with Sections 31-306 and 31-406 of the Unified Development Ordinance Approved 7-0 1 10. Public Hearing – Conditional Use Permit Request C16-05, submitted by Chanda Kinney, applicant, on behalf of Sandy Bottom Materials, Incorporation, property owners, to permit the operation of a nail salon in accordance with Sections 31-306 and 31-406 of the Unified Development Ordinance Approved 7-0 11. Public Hearing – Conditional Use Permit Request, C20A-02, submitted by Michael E. Perry of MSA, P.C. on behalf of Drs. L.D. and Charlene M. Britt, property owners, to amend the development guidelines for the Governor’s Pointe cluster subdivision as approved by Ordinance 03-O-045 in order to reduce the required 10-foot setback from the 100-foot Resource Protection Area (RPA) buffer down to zero in accordance with Sections 31-306, 31-406 and 31-411 of the Unified Development Ordinance Approved 4-3 (Mayor Ralph and Council Members Johnson and Jones voted in opposition) There was a motion to refer the matter of the 10-foot buffer setback requirement on other affected properties in the Governor’s Pointe cluster subdivision back to the Planning Commission for further consideration. Approved 7-0 12. Staff Report – Update on the North Suffolk Library No City Council action was required. 13. Motion - A motion to schedule a Work Session for November 2, 2005, at 4:00 p.m., unless canceled. Approved 7-0 14. Motion – A motion to approve the guidelines for the implementation of the After School Grant Funding Program Approved 7-0 A motion to amend the agenda to consider the following item was approved by a vote of 7-0: A resolution authorizing the City Manager to acquire certain property owned by Riddick M. Jones and Eugene M. Dilday. Approved 7-0 15. Late Appearance - Guidelines for the Late Appearances period are outlined in the City Code Section 2-96 and permit each speaker five (5) minutes to address City Council. There is no limitation on the total time period for Late Appearances. No City Council action was required. 2 16.
