Consent Agenda - Approval of the minutes Approved 7-0 6. Consent Agenda - An ordinance to accept and appropriate a Bulletproof Vest Partnership Program Grant from the United States Department of Justice - Second Reading Approved 7-0 7. Consent Agenda - An ordinance to accept and appropriate $32,675 from the United States Department of Agriculture Summer Food Service Program - Second Reading Approved 7-0 8. Consent Agenda - An ordinance to accept and appropriate donations to the City - Second Reading Approved 7-0 9. Consent Agenda - An ordinance to accept and appropriate funds from the Commonwealth of Virginia Technology Trust Fund for implementation of an integrated Land Information System in the Office of the Clerk of the Circuit Court - Second Reading Approved 7-0 1 10. Consent Agenda - An ordinance to accept and appropriate a Highway Safety Project Grant from the Virginia Department of Motor Vehicles, and to provide for an in-kind match - First Reading Approved 7-0 11. Consent Agenda - A resolution of the City Council of the City of Suffolk authorizing the City Manager to amend the Water System Development and Engineering Agreement Approved 7-0 * * * * * * * * * * * * * 13. Public Hearing - Conditional Use Permit Request C15-05, submitted by Michael Ola of New Life Church-Suffolk, applicant, on behalf of Olds Enterprises, LLC, property owner, to permit operation of a religious assembly facility in accordance with Sections 31-306 and 31-406 of the Unified Development Ordinance. The Planning Commission recommended approval. Approved 7-0 14. Public Hearing - Rezoning Request RZ5-05 (Conditional), submitted by George Powell of Powell Development Group, applicant, on behalf of S & D Enterprises, Incorporated and Michael Duman, property owners, for a change in zoning for 5.65 acres from RLM, Residential Low-Medium Density and B-2, General Commercial District, to RU, Residential Urban. (Conditional). The Planning Commission recommended approval. Approved 7-0 15. Public Hearing - Rezoning Request RZ10-05, initiated by the City of Suffolk, in accordance with Section 31-304 of the Unified Development Ordinance, to rezone property along Byrd Street from M1, Light Industrial to RLM, Residential Low-Medium Density. The Planning Commission recommended approval. Approved 7-0 16. Public Hearing - A resolution authorizing the sale of certain real property associated with the redevelopment of the former Thomas Jefferson Elementary School Approved 6-1 (Council Member Johnson voted in opposition.) 17. Public Hearing - A resolution authorizing the City Manager to abandon, extinguish and terminate a permanent utility easement previously granted to the City on certain real estate owned by James David Gardner and Sonya Ann Gardner located on Turlington Road Approved 7-0 2 18. Public Hearing - Adoption of the Stormwater Utility Program An ordinance amending Chapter 90 of the Suffolk City Code entitled “Utilities” by the addition of Article VII entitled “Stormwater” Approved 6-1 (Council Member Milteer voted in opposition.) A motion to schedule a public hearing at the December 21, 2005, City Council meeting to receive comments on the proposed monthly stormwater fee. Approved 6-1 (Council Member Jones voted in opposition.) 19. Resolution - A resolution of the City Council of the City of Suffolk authorizing the City Manager to amend the contract for the extension of Obici Boulevard within the Suffolk Industrial Park Approved 7-0 An ordinance to accept and appropriate funds from the City of Suffolk Industrial Development Authority for the Phase III Extension of Obici Boulevard located within Suffolk Industrial Park – First Reading This was a first reading only – no action was required. 20. Motion - A motion to schedule a Work Session for December 21, 2005, at 4:00 p.m., unless canceled. Approved 7-0 A resolution endorsing Governor Mark R. Warner’s vision of creating a National Center for Modeling and Simulation and High Technology Research and Development in Hampton Roads. Approved 7-0 A resolution authorizing the City Manager, on behalf of the City, to acquire certain property owned by the Mildred J. Brinkley Revocable trust Approved 7-0 21. Late Appearances – Guidelines for the Late Appearances period are outlined in the City Code Section 2-96 and permit each speaker five (5) minutes to address City Council. There is no limitation on the total time period for Late Appearances. No City Council action was taken. 22. Announcements and Comments from City Council Members No City Council action was taken. 23.
