Consent Agenda - An ordinance to accept and appropriate $7,939 from the Commonwealth of Virginia for equipment purchases in the Office of the Commonwealth Attorney - Second Reading Approved 7-0 7. Consent Agenda - An ordinance to accept and appropriate grant funds received through the Hampton Roads Planning District Commission for the National Incident Management System (NIMS) Implementation - Second Reading Approved 7-0 8. Consent Agenda - An ordinance to accept and appropriate funds from the developer of Harbor Breeze for cost participation in the construction of a traffic signal at Bridge Road and Breeze Port Way and to provide for a local cash match - First Reading Approved 7-0 9. Public Hearing – Conditional Use Permit Request, C15A-02, submitted by Whitney G. Saunders of Saunders, Barlow, Riddick and Babineau, P.C. on behalf of Terry-Peterson Residential Eleven L.L.C, property owner, to reduce the 10-foot front yard setback as approved by Ordinance Number 03-O-083 down to 7.5 feet for parcels 4 and 9 only in accordance with Sections 31-306, 31-406, 31-409 and 31-411 of the Unified Development Ordinance Approved 7-0 14. Public Hearing - Conditional Use Permit Request C23-05, submitted by Susan Russo of Bunny’s Pawn Shop, Incorporated, applicant, on behalf of Frank E. Sheffer of Shefco, Incorporation, property owner, to permit the operation of a pawn shop in accordance with Sections 31-306, 31-406 and 31-711 of the Unified Development Ordinance Approved 7-0 15. Public Hearing - Rezoning Request RZ9-05 (Conditional), submitted by Michael T. Haas of Tri-City Developers, LLC, applicant, on behalf of Conrad E. Haas and Anna Haas Wuest, property owners, for a change in zoning for 258 acres from A, Agricultural District to RE, Rural Estate District. The property affected is located approximately 1750 feet northwest of the intersection of Everets Road and Audubon Road and is further identified as Tax Map 9, Parcels 5 and 5C, Chuckatuck Voting Borough, Nansemond Taxing District. The 2018 Comprehensive Plan designates this area for Rural Conservation Area/Low Intensity Residential (with public water) Approved 4-3, (Mayor Ralph, Vice Mayor Bennett, and Council Member Jones voted in opposition) 16. Public Hearing - Rezoning Request RZ2-06, initiated by the City of Suffolk for rezoning properties from RM, Residential Medium Density, CBD, Central Business District and M-2, Heavy Industrial to FRRD, Fairgrounds Revitalization and Redevelopment District in accordance with the adopted Fairgrounds Revitalization Plan Approved 7-0 17. Public Hearing – Reestablishment of the Real Estate Tax Rate An ordinance levying real property taxes for the tax year beginning July 1, 2006, and ending June 30, 2007 Public hearing closed. No City Council action required. 2 18. Staff Report - Briefing on Great Dismal Swamp National Wildlife Refuge Draft Plan A resolution endorsing an amendment to the Great Dismal Swamp National Wildlife Refuge Draft Comprehensive Conservation Plan was Approved 7-0 19. Motion - A motion to schedule a Work Session for May 3, 2006, at 4:00 p.m., unless canceled. Approved 7-0 A motion to amend the agenda to consider the following items was approved by a vote of 7-0 An appointment to the Planning Council – Council Member Joseph H. Barlow An appointment to the Airport Commission – Council Member Curtis R. Milteer, Sr. Approved 7-0 A motion to schedule a Public Hearing at the May 3, 2006, City Council Meeting for the purpose of receiving public comment on the proposed Operating Budget for Fiscal Year 2006-2007 Approved 7-0 20. Late Appearances - Guidelines for the Late Appearances period are outlined in the City Code Section 2-96 and permit each speaker five (5) minutes to address City Council.
