4. Preliminary Subdivision Plat:
A. PRELIMINARY SUBDIVISION PLAT, PS08-09, Lake View Industrial Park, Parcels R-2-
2 and R-2-3, submitted by Jerrold W. Hutton , L.S., of Rouse-Sirine Associates, Ltd,
applicant, on behalf of MB Suffolk Lake View, LLC and Lake View Development Group II,
Inc., property owners, for the purpose of creating 3 new commercial parcels totaling 3.766
acres. The property affected is located at 109 and 111 Lake View Parkway and is further
identified as Tax Map 6, Parcels 9*3*2 and 9*3*3, Sleepy Hole Voting Borough, zoned M-1,
Light Industrial District.
5. Public Hearings:
A. REZONING REQUEST RZ21A-94, Hillpoint Farms S-3, submitted by Scott Overton, of
Fairways Crossing, LLC, property owner, to amend the Master Land Use Plan for Hillpoint
Farms to change the foundation requirement to allow 18-inch raised slabs or a crawl space for
all new dwelling units. The affected property is located south of Hillpoint Boulevard and is
further identified as Tax Map 26F, Parcels FC*39, 41, 43 through 53, Chuckatuck Voting
Borough, zoned PD, Planned Development Overlay Zoning District.
B. REZONING REQUEST RZ14B-03, Bennett’s Creek Square, submitted by Charles J.
Bodnar, P.E., of Hoggard-Eure Associates, P.C., on behalf of Bennett’s Creek Square, Inc.,
property owner, to amend the approved proffers for the multi-family portion of the project,
(The Vineyards,) removing the age restriction and adding a cash proffer for middle school and
high school capacity. The affected property is located on the east side of Shoulders Hill Road
and is further identified as Tax Map 12, Parcels 56A, 56C, and 57, Nansemond Voting
Borough, zoned TND, Traditional Neighborhood Development.
C. REZONING REQUEST RZ09A-06 (Conditional), Nansemond River Estates, Phase 9,
submitted by Vincent A. Napolitano of Broad Bay Associates, LLC, and Star Creek, LLC,
property owners, to amend the approved proffers allowing development of 34 single family

lots with a cash proffer for high school construction and the installation of traffic
improvements within 180 days of subdivision plat recordation. The affect property is located
on the west side of Sleepy Hole Road and is further identified as Tax Map 19 Parcels 78A,
80, 83*82 and 84, and Tax Map 19L Parcel OS*2, Nansemond Voting Borough, zoned RLM,
Residential Medium Density Zoning District.
D. CONDITIONAL USE PERMIT REQUEST C05-09, submitted by Tami Harrison of World
Class Gymnastics, applicant, on behalf of Northgate Commons LLC, property owner, for an
indoor amusement center in accordance with Section 31-306 and 31-406 of the Unified
Development Ordinance. The affected property is located at 1000 Bowen Parkway and is
further identified as Tax Map 20, Parcel 22B*1, Nansemond Voting Borough, zoned M-2,
Heavy Industrial Zoning District.
E. EXCEPTION REQUEST EX03-09, submitted by Charles J. Bodnar, P.E., of Hoggard-Eure
Associates, P.C., on behalf of Bennett’s Creek Office Park, L.L.C., to permit after-the-fact
approval of a principal structure (office/warehouse) built into a portion of the 100-foot RPA
buffer. The affected property is located at 3345 Bridge Road and is further identified as Tax
Map 12, Parcel 34C, Sleepy Hole Voting Borough, zoned O-I, Office-Institutional Zoning
District.

A. ORDINANCE TEXT AMENDMENT OA2-09, initiated by the Suffolk Planning
Commission for additions and amendments to Chapter 31, Article 7, Supplemental Use
Regulations, Section 31-714, Sign Regulations; Article 4, Zoning, Section 31-412(h)(2)(D),
Special Corridor Overlay District, Limitation of Signs; and Appendix ‘A’, Definitions of the
Unified Development Ordinance for the purpose of amending and adopting regulations
pertaining to the type, placement and physical dimensions of signs within the different zoning
districts and to continue to permit such signs so as to not endanger the public safety of
individuals; confuse, mislead or obstruct vision necessary for traffic safety; nor otherwise
endanger public health, safety and welfare.
