3. Preliminary Subdivision Plats:
A. PRELIMINARY SUBDIVISION PLAT PS13-08, Waverton Commerce Park, submitted
by Waverton Commerce Park, LLC, and the City of Suffolk, property owners, and William C.
Griffin, contract seller, for the purpose of creating 19 industrial parcels totaling approximately
298 acres. The property affected is located on the east side of Carolina Road and south of Dill
Road and is further identified as Tax Map 34, Parcel 88C as well as Tax Map 44, Parcels 21A,
28, 29, 30, 31, 31A, 32, 33, 37A, 38, 39*6, 39*7, 40*1, 40*2, 40*3, portion of 43, 44, 46, 47,
and 88A, Whaleyville Voting Borough, zoned M-2, Heavy Industrial.
B. PRELIMINARY SUBDIVISION PLAT PS11-09, Hillpoint Estates, submitted by Brian J.
Layne, of Art-Ray Corporation, applicant, on behalf of Hillpoint Virginia, LLC, property
owner, for the purpose of creating 90 residential parcels totaling approximately 124 acres. The
properties affected are located on the north side of Hillpoint Boulevard and west of the
Nansemond River and are further identified as Tax Map 26, Parcel 6, Tax Map 26F, Parcel
S*7, and Tax Map 26F, Block (2), Parcel M*2, Chuckatuck Voting Borough, zoned RC,
Residential Compact Zoning District (Conditional) and PD, Planned Development Overlay
District.
C. PRELIMINARY SUBDIVISION PLAT PS12-09, submitted by Richard L. Blake of
Precision Measurements, Inc., on behalf of the City of Suffolk, property owner, for a
dedication of right-of-way to provide public ingress and egress from Commerce Street to
South Main Street and adjacent parcels. The subject property is further identified as Tax Map
34G18(A), Parcels 281E, 286, 287 and 288, Suffolk Voting Borough, zoned CBD, Central
Business District Zoning District.
4. Public Hearings:
A. REZONING REQUEST RZ04A-06 (CONDITIONAL), Towne Bank at Harbour View,
submitted by Keith D. Horton, applicant, on behalf of Towne Bank, property owner, to permit
Towne Bank to amend the MUD, Mixed Use Development – Design Guidelines for signage
and to replace such sign requirements with the B2, General Commercial District sign

requirements listed in Section 31-714 (l) of the Unified Development Ordinance. The affected
properties are identified as Tax Map 6, Parcels 3C-1 and 3C-2, Sleepy Hole Voting Borough,
zoned MUD, Mixed Use Development Overlay District (Conditional). The 2026
Comprehensive Plan designates this area as part of the Northern Suburban/Urban Growth
Area.
B. REZONING REQUEST RZ05-09 (CONDITIONAL), Nansemond-Suffolk Academy,
submitted by Charles R. Birdsong, Board of Trustees, applicant, on behalf of Nansemond-
Suffolk Academy, property owner, for a change in zoning of approximately 94.59 acres from
A, Agricultural Zoning District, to O/I, Office-Institutional Zoning District (Conditional). The
affected property is located at 3373 Pruden Boulevard and is further identified as Tax Map 25,
Parcel 58E, Suffolk Voting Borough, zoned A, Agricultural Zoning District. The 2026
Comprehensive Plan designates this area as part of the Central Suburban/Urban Growth Area.
C. CONDITIONAL USE PERMIT REQUEST C12-09, submitted by Claude F. Lym, P.E., of
SIA Site Improvement, applicant, on behalf of Southside Baptist Church, property owner, to
permit the expansion of a large religious assembly in accordance with Section 31-306 and 31-
406 of the Unified Development Ordinance. The affected property is located at 917 Carolina
Road and is further identified as Tax Map 44, Parcel 8A, Whaleyville Voting Borough, zoned
O-I, Office-Institutional Zoning District.
D. CONDITIONAL USE PERMIT REQUEST C14-09, Hands On Massage, LLC, submitted
by Sheila Slocum, of Hands On Massage LLC, applicant, on behalf of Sandy Bottom
Materials, property owner, to permit the operation of personal services-massage therapy, in
accordance with Section 31-306 and 31-406 of the Unified Development Ordinance. The
affected property is located at 3441 Bridge Road and is further identified as Tax Map 12,
Parcel 34B, Sleepy Hole Voting Borough, zoned O-I, Office-Institutional Zoning District.
E. ORDINANCE TEXT AMENDMENT OA03-09, initiated by the Suffolk Planning
Commission for an amendment to the Code of the City of Suffolk, Chapter 31, Unified
Development Ordinance, Article 4, Section 31-417, Affordable Dwelling Unit Ordinance, to
amend the provisions to be consistent with the Code of Virginia § 15.2-2305, and for the
administration of the ordinance.
5. Old Business
A. REZONING REQUEST RZ14C-03 (CONDITIONAL), Bennetts Creek Square, submitted
by Charles J. Bodnar, P.E., of Hoggard-Eure Associates P.C., applicant, on behalf of Bennetts
Creek Square, Inc. and Shoulder Hill Road Associates, LLC, property owners, to eliminate
residential lot 1 in Phase 2 and transfer the property to Parcel C in the commercial portion of
the project. The affected property is located on the east side of Shoulders Hill Road and is
further identified as Tax Map 12, Parcel 57, and Tax Map 12V, Parcel C, Nansemond Voting
Borough, zoned TND, Traditional Neighborhood Development Zoning District. The 2026
Comprehensive Plan designates this area as part of the Northern Suburban/Urban Growth
Area.
