PROCEEDINGS OF THE REGULAR COMMON COUNCIL MEETING SUPERIOR, WISCONSIN Tuesday, October 18, 2022 The Regular Meeting of the Common Council was called to order by Mayor Jim Paine at 6:50 p.m. in the Government Center, Board Room 201. 1. PLEDGE OF ALLEGIANCE 2. PRESENTATIONS AND PUBLIC HEARINGS 3.1 PUBLIC HEARING to receive public input on the designation of the following Municipal Register of Historic Places nomination(s): 1. Fairlawn Mansion & Museum, 906 E 2nd Street, Superior, WI 54880 2. S S Meteor Maritime Museum (also known as “The Meteor Whaleback Museum”), 100 Marina Drive, Superior, WI 54880 Superior Public Museums Executive Director Megan Meyer addressed the Council in favor of the designations. 3.2 PUBLIC HEARING to receive public input on the 2023 Budget proposed by Mayor Paine. There was no objection to Mayor Paine’s request to hold the public hearing immediately before Item 9.1. 4. APPROVAL OF MINUTES 4.1 October 4, 2022 - Regular Council Meeting MOTION to approve, by Councilor Bender, was seconded by Councilor Elm and carried. 5. To the COMMUNICATIONS & INFORMATION TECHNOLOGY COMMITTEE, appoint Dan Lindberg for a 3-year term, expiring October 2025. MOTION to approve, by Councilor Elm, was seconded by Councilor Herrick and carried. 2. To the CIVIL SERVICE COMMISSION, appoint Kelly Peterson for a 4-year term, expiring October 2026. MOTION to approve, by Councilor Bender, was seconded by Councilor Johnson and carried. 3. To the MARINA COMMITTEE, appoint Paul Snider for a 1-year term, expiring October 2023. MOTION to approve, by Councilor Herrick, was seconded by Councilor Bender and carried. 7. STANDING COMMITTEE REPORTS 7.1 Human Resources Committee (No meeting to report) 7.2 Public Works Committee (Meeting held October 6, 2022) Report from Councilor Van Sickle. RECOMMENDATION: 1. Approve Project Partnership Agreement with the US Army Corp of Engineers (USACE) to receive grant funds in the amount of $450,000 for the Hill Avenue Interceptor Project. MOTION to approve, by Councilor Van Sickle, was seconded by Councilor Bender and carried. 7.3 Finance Committee (Special Meeting held September 28, 2022) Report from Councilor Sweeney. 7.4 Licenses and Fees Committee (Special Meeting held September 26, 2022; Meeting held October 10, 2022) Report from Councilor Fennessey. 2 Regular Council Meeting October 18, 2022  RECOMMENDATION: 1. Approve O22-4287, an ordinance introduced by the Licenses and Fees Committee amending Article XII, Short-Term Rentals of Chapter 74, Licenses, Permits and Business Regulations, to update the short term rental license period, renewal due date and inspection requirements. MOTION to approve, by Councilor Fennessey, was seconded by Councilor Johnson and carried. 7.5 Public Safety Committee (No meeting to report) 7.6 Committee of the Whole Meeting (No meeting to report) 8. SPECIAL COMMITTEE REPORTS 8.1 REPORTS WITH RECOMMENDATIONS 8.1.1 Parks & Recreation Commission (Meeting held September 29, 2022) Report from Councilor Ledin. RECOMMENDATIONS: 1. Approve the 5-year lease agreement with Blue Water Paddling for two slips at the Barker’s Island Boat Launch, at the annual cost of $150/slip. 2. Approve the 5-year lease agreement with WikiWiki for one slip at the Barker’s Island Boat Launch, at the annual cost of $150/slip. MOTION to approve both recommendations, by Councilor Ledin, was seconded by Councilor Bender and carried. 8.1.2 Historic Preservation Committee (Meeting held October 12, 2022) No report from the Chair. RECOMMENDATION: 1. Approve setting a public hearing at 6:30 p.m. on November 1, 2022, in the Government Center Board Room 201, to receive public input on adding the Old Firehouse & Police Museum, located at 402 23rd Avenue East (parcel number 01-801-01268-00), to the Municipal Register of Historic Places. MOTION to approve both recommendations, by Councilor Herrick, was seconded by Councilor Elm and carried. 8.2 REPORTS SANS RECOMMENDATIONS 8.2.1 Culture, Events & Public Art Commission (Meeting held September 21, 2022) No report from the Chair. 3 Regular Council Meeting October 18, 2022  8.2.2 Communications & Information Technology Committee (Meeting held October 3, 2022) Report from Councilor Elm. 8.2.3 Tourism Development Commission (Meetings held October 4 & 11, 2022) No report from the Chair. 8.2.4 Police and Fire Commission (Special Meeting held September 27, 2022; Meeting held October 12, 2022) Report from Councilor Fennessey. 9. OLD BUSINESS 9.1 2023 General Fund Budget 9.2 2023-2028 Capital Improvement Program (CIP) Revenue 9.3 2023 Revolving Grants Program Fund Public Hearing held for proposed 2023 Budget (Item 3.2); there were no speakers. MOTION to close hearing and adopt the three budgets, by Councilor Bender, seconded by Councilor Elm. Mayor Paine proposed the following budget line item amendments: Revenue Changes: Increase state aid exempt personal property tax revenue by $21,893 Increase exempt computer aid by $6,530 Increase shared revenue by $36,255 Decrease connecting highway aid by $3,374 Decrease general transportation aid by $89,992 Decrease expenditure restraint program aid by $26,995 Decrease payments for municipal services by $43,416 Expenditure Changes: Decrease transfer to the PD Grant Fund by $35,000 Decrease the transfer to the Illegal Taxes Fund by $16,000 Decrease transfer to the Liability Insurance Fund by $35,000 Decrease transfer to the IT Fund by $13,099 MOTION to adopt the amendments as proposed, by Councilor Elm, was seconded by Councilor Van Sickle and carried. MOTION to postpone until November 1, 2022 Regular Common Council Meeting, by Councilor Sweeney, was seconded by Councilor Fennessey and carried. 4 Regular Council Meeting October 18, 2022 10. NEW BUSINESS 10.1 CITY CLERK RAMOS recommending approval of miscellaneous licenses. MOTION to approve, by Councilor Bender, was seconded by Councilor Herrick and carried. 10.2 CITY CLERK RAMOS recommends approval of a Temporary Class “B” Beer and Wine License for the Beautiful Strength Project (President Kelly D. Kellar, 7023 Kilmek Rd, Saginaw, MN 55779), for the Insides Out Art Exhibition, which will be held on November, 12, 2022. MOTION to approve, by Councilor Bender, was seconded by Councilor Elm and carried. 10.3 PUBLIC WORKS DIRECTOR JANIGO recommends approval of O22-4286, an ordinance amending City Code Chapter 112 - Traffic Code, Schedule J, Accessible Parking Zones, to add accessible parking signs to 1320 Baxter Avenue, on both sides. MOTION to approve, by Councilor Elm, was seconded by Councilor Ludwig and carried. 10.4 POLICE CHIEF ALEXANDER recommends approval of a Towing Services contract with Duke’s Towing, Inc. for a 3-year term which begins January 1, 2023. MOTION to approve, by Councilor Herrick, was seconded by Councilor Johnson and carried. 10.5 ECONOMIC DEVELOPMENT, PLANNING AND PORT DIRECTOR SERCK recommends amending the concrete repair loan agreement with Superior Business Center, Inc., dba Superior Business Center (located at 1423 North 8th Street), to include the cost of an HVAC System replacement and the acquisition of a new commercial-grade convection oven. MOTION to approve, by Councilor Graskey, was seconded by Councilor Fennessey and carried. 11.
