President of Council Kilway called the Virtual Regular Council meeting of Thursday, February 11, 2021 to order at 7:00 p.m. This is a virtual meeting due to the State of Emergency. 2. MINUTES: 1-28-21 Virtual Regular Council Meeting minutes. Mr. Sisak: I move to accept the 1-28-21 Regular Council Meeting minutes as presented. Seconded Mr. Loughry. Voice vote 6-0. The 1-28-21 Regular Council meeting minutes were accepted by a vote of 6-0. 5. Pres. of Council: I guess it is that we are accepting them. We just always been adopting them into the record. Mr. Grimm: OK. Dir. of Law: Accepting them is more appropriate. OF PUBLIC SERVICE, DIR. OF ADMINISTRATION, DIR. OF ECONOMIC DEV., DIR. OF FINANCE AND DIR. OF LAW. Mayor: Thank you Madame Chair and thank you Council for being here tonight and the public who is out there watching. It has been a very busy last couple of weeks. Today we did have an interview of four CMR’s for the Tallmadge Fire Station No. 2 and those interviews went very well. Now we will whittle that down to getting a  VIRTUAL REGULAR MEETING in Council Chambers @ 7:00 p.m. February 11, 21 Mayor (Cont’d.) couple of RFP’s (request for proposals) for that and then legislation to Council at the next Council meeting allowing us to enter into contract with the CMR. Also, I was happy to announce that I did finalize our electrical aggregation. As you know, we are currently with First Energy which is also Energy Harbor who took over First Energy’s contract and our previous contract was 4.95¢ per kw and I am happy to announce that we are now at 4.96¢ and so it only went up a very small amount but with that it comes with a grant for energy upgrades and lighting upgrades up to $90,000 for the City of Tallmadge and so the first year will be $45,000 and then years 2, 3 and 4 with an additional $15,000. So, I am pretty happy about that and the nice thing about being with First Energy Harbor; I do not have to change vendors and so all of the residents who are currently with them will still get the opt-out letter, but they really have to do nothing to stay with them. The bulk of the City of Tallmadge is with First Energy Harbor. I am still working on the gas aggregation but that is not up until November of this year. Our electric is up on May 1st so that would be effective May 1st and I will get something in your mailboxes or e-mails and do a press release coming up on that. Outside of that, I think that is the end of my report for now. I will entertain any questions or anything that you might have for me. Dir. of Pub. Service: Good evening. I would like to request that Ord. 32-2021 be passed at 1st Reading. The Zoning Department had a total of 21 permits issued for the month; 13 of which were Zoning Certificates. Code Enforcement had 38 open violation cases, 10 of which were follow-ups from the previous month. 12 were property disrepair and 8 were junk, trash and debris in the yard. The Code update; the formal draft revisions is with the consultant and so we anticipate to get a copy back soon. Going off from what I said two meetings ago, we are probably 92 days out before Council gets to see it. For Parks and Recreation, Councilman Sisak asked for an update on the Silver Sneakers. In 2019 United Health Care stopped providing what was equivalent to Silver Sneakers; I think it was called Renew Active Optimum Fitness and that was stopped. It was free to the membership for a medical supplement plans and that was stopped. They reinstated that in 2020 and so that was added back in. The memberships nearly doubled over the first two months of 2020 but then you know what happened in March; Covid hit and we really haven’t seen . . . it stayed steady but you know, that is a risk group with that age group and so we really haven’t got to see the full effect. But it has been reinstated in the membership. I hope that answers any questions Councilman Sisak. Mr. Sisak: Yes; thank you. Dir. of Pub. Service: Moving on, the numbers for the Rec Center; membership as you can see there; there were 6,028 and that was down 1,000 from last year. Visits at the Rec were 10,983 and that was up 2,600 from last month, but down 17,000 from last year. We are averaging 354 people per day and that is 75 people more than what we were getting in December, so it is all on an uptick. Updated mask policy because we were in purple for two months and you had to wear your mask all the time and now that we are back in the red and that is the Summit County Risk Level; we are back in the red and now if you are working out actively on a piece of equipment or in a fitness class, you no longer have to wear your mask, but you do have to wear it entering into the common areas. For those residents or members that aren’t comfortable with that, we do offer Monday through Friday from 1:00 p.m. to 3:00 p.m. where you have to wear your mask all of the time regardless of what you are doing. I thought that was a good compromise for those that didn’t like the folks not wearing their masks. Summer Camp; it is exciting. We are bringing it back. Hopefully everything goes well. We are working on the guidelines and how to do that. Obviously it is going to be a reduced number, but we are trying to pull that together based on the guidelines. We are going to be doing something mid-March with new sessions of dance, cheer, gymnastics, ballet and the speed and agility classes and so we have to have that going by mid-March. Parks; the halls and shelters are still closed through April of this year. Kent Drive Park playground is being designed; this is part of the budget. It actually needs to get replaced. We had it looked at last year and some of the pieces there need to start getting replaced and so that is on schedule for this year. VIRTUAL REGULAR MEETING 2  in Council Chambers @ 7:00 p.m. February 11, 21 Dir. of Pub. Service (Cont’d.) Maca Pool; memberships are on sale to residents right now. Right now, as of yesterday, we sold 516 passes which is great. Normally we don’t even hit that number until May. The opening day is May 29th and the last day would be August 15th. The hours are 11:00 a.m. to 7:00 p.m. and then on Friday through Saturday, we go until 8:00 p.m. You can see that non-resident memberships go on sale on March 1st and we are looking at 1,500 memberships for 2021. Each member is allowed two guests and going back to the request for Ord. 32-2021, we are trying to adjust the prices and we will cover that when you guys get to that. In the Street Department, you can see there were 2,600 tons of debris was swept up and that was with 72 hours of street sweeping. There was one culvert replacement and 25 catch basins cleaned; 550 lineal feet of swale or ditch work was done. 918 hours of snow and ice control was done in the month and we used 1,100 tons. We started winter shifts on January 10th and keep in mind that that gives us two 12-hour shifts and so it gives us a complete 24-hour coverage throughout the week and so the guys are doing a great job. I mean it has not been a very good winter and these are the ones that are expensive and we waste a lot of money throwing down salt because none of these snows have really been anything you can really plow off and so the guys are doing a great job. New School Zone sign is there at East Avenue. It has been a long time coming and this is a request that I have been getting since I came the last three years. Tallmadge Schools split the cost with those new signs which we appreciate Tallmadge Schools doing that. Keep in mind that those lit-up signs aren’t needed in a school zone, but it just helps out especially when you don’t have a school up on the road. In that case, you don’t even realize there is a school there unless you live here. Tree trimming at the Hole; that is a picture of the guys trimming dead limbs off of the trees along Baron. It was a good job that they did. Also, they were able to install a new floor drain in the Service Center. That building probably wasn’t designed to wash the vehicles wherever they are at and so we would have a lot of standing water that solved some safety concerns we were watching as we were cleaning off the vehicles and so the guys did a nice job installing that. Utility Department for the month; we had one watermain break and that was on South Alling. You can see there that we average about 22 watermain breaks over the course of year. We were able to repair three valves. They weren’t working properly. They were leaking which is an issue, but more importantly, they weren’t functioning correctly because you can’t isolate the waterline when a water break occurs so the fact that those valves got fixed is great. Good asset management. Then for training; they learned how to call on an Oops ticket and for those folks who don’t know what Oops that is Ohio Utility Protection Service and so any time you dig in the ground, you have to call Oops within 48 hours before you break ground. It was well. That is my report for the month and so if there are any questions, I would be happy to take them. Pres. of Council: Next we will go on to Economic Development. Matt, would you like to speak? Dir. of Econ. Development: I will be brief. The City participated in a ribbon cutting with Polte Homes earlier this week and that was nice to be able to celebrate their grand opening. As you know, there are about 208 single-family lots within this development and we are pleased to announce that they have sold over 22 as of earlier this week on Tuesday. In fact, we are told by Polte that they set a record with all of their developments within Ohio, they sold 17 over one weekend and so these are selling incredibly fast and it is a really good development and they are actively moving forward with Phase IV and so you will see plans coming forward in the near future. Just a couple of informational items. We continue to monitor the Midway Plaza situation very closely with the property owners out of New York and I think we were very clear about what our expectations are on that property and so as that moves forward, we will be sure to keep you posted. The advisory committee that is going to be working on some recommendations on the repurposing of the former Summit DD school building. They are going to meet again on March 9th and they are going to tour the facility and so you will hear more information on that in the coming weeks and months. Our CIC, our Community Improvement Corporation called a special meeting for next Tuesday, I believe; it’s February 17th. There could be a grant opportunity and so more to come on that, but there is some discussion about the CIC partnering up with Tallmadge Chamber of Commerce to put out our version of a small business VIRTUAL REGULAR MEETING 3  in Council Chambers @ 7:00 p.m. February 11, 21 Dir. of Econ. Development (Cont’d.) assistance grant that would go towards retail establishments, food and beverage establishments, as well as personal service. There will be more information to come on that once we iron out a couple details, but again any opportunity we get to support some of our small businesses; we certainly want to do that. More to come on that and that concludes my report and I would be happy to answer questions you might have. Pres. of Council: I was lucky enough to go tour the Polte homes and oh my gosh, they are beautiful. They really are beautiful. It is going to be a great addition to our community. I am so excited. Dir. of Administration: Good evening everyone. Since Mr. Springer was brief; I will be even briefer. Just one item to report on really. The Part-Time Firefighters Association communicated to us very recently, earlier this week, that they are engaging an attorney who we have worked with before to assist them with negotiations. So, those negotiations continue and we look forward to working the new representative. End of report unless you have any questions. Mr. Bollis: Will the ordinance remain at 3rd Reading on the agenda or would that fall off the agenda and come back at a later date? Dir. of Administration: I’m not sure I am the person to deal with that. Mayor: You have a couple of options to deal with that. You can table it until a future date, or you can, and I’m sure the Committee Chair of that, Mr. Grimm would want to table that until it can get out of potential arbitration. Mr. Grimm: We will deal with it when we get to committee. Dir. of Finance: Good evening everyone. You should have received your January Financial Reports. Early in the year income tax was down a little bit, but I think that was a blip and so we will just continue to monitor that. I know I saw a report and there was a significant increase in February and so I just think that might be a timing issue and so after we get a couple months under our belt, I think it will be a better time to access how our income tax is maintaining through this continued year of the pandemic. The Rec Center is continuing to be behind last year as Mr. Rorar stated, but I don’t think in this month at least in January we were behind anyway from where we had been and I can see that progressing forward. In addition, I have spoken with the Auditors and have been in contact with them. They are getting to prepare to audit our 2020 financial statements. I did want to inquire of Council if there is anyone interested in meeting with the auditors and having a formalized entrance conference prior to the beginning of the audit. They always offer that to Council people if they are interested. So, if anybody has an interest in that you can either voice it here or contact me tomorrow so we can get something scheduled. Then I also would request 1st Reading adoption of Ord. 33 and 34-2020. End of report and I will answer any questions if anybody has any? Mr. Loughry: Mrs. Gilbride, not a question; just a comment, I just want to thank you again for that TIF communication. It was extremely well done. So, thank you very much. Dir. of Finance: Thank you. Dir. of Law: Thank you. I just wanted to take this opportunity to report that the Charter Commission did meet on Monday of this week. The next meeting is scheduled for February 22nd at 7:00 p.m. and so anyone who wishes to view or participate; participation requires registration like this meeting, but anyone can view it on the City’s website or You tube page. In the process of doing that, there was a question that was raised by Councilman Loughry as it relates to some language that is in Section 4.07A of the Charter. That sentence does have the language that would require Council to do a roll call vote for every ordinance and resolution and I know it has been a long standing practice that Council has done voice votes on, I would call them more ceremonial resolutions, such as resolutions of congratulations or sympathy, but given that language, I think it is most prudent for us to revert to doing a roll call vote even for those. To that end, as I was looking at that issue, I will note that Chapter 111.01, Rule 30, which are Council’s Rules, do provide that we do not need to do a referral for those types of resolutions; the resolutions of congratulations and gratitude and we can just give them a 1st Reading so that will be more similar to what we had previously done before we rearranged the Council meetings into one meeting and so we can just put those directly at the 1st Reading and not have them being discussed at committee level and then again having them at 1st Readings. So, we will make that change moving forward and along the same vein, Rule 16 will VIRTUAL REGULAR MEETING 4  in Council Chambers @ 7:00 p.m. February 11, 21 Dir. of Law (Cont’d.) provide an automatic excuse or abstention for anyone who is affected and so that person should not be called in the roll; it would automatically be noted as an abstention if it is a family member for example, so if that person is impacted by that resolution of sympathy. So, hopefully that provides some clarity and I just wanted to point that out because we will be making that change as we move forward. Thank you. End of report. Mr. Loughry: One, thank you for the report. Two, thank you for leading the Charter Review Commission and being so open. You know the devil is in the details, but regarding the resolutions, I think we both agreed that it is better for us just to change our procedure than to go to the electorate with something so minor. Dir. of Law: Agreed. Like I said, it is a long standing practice and at some point there may have been some discussion or some opinion that it was not really the intention to have those types of resolutions be included in that language, but I think the plain reading of it would indicate that we would be best to just follow that language and do the roll call. So, thank you. Pres. of Council: I do have a question along that same line as well. It is quite difficult, especially when we do . . . when we are accepting the minutes and we have just a voice vote. Can we . . . because of the pandemic and because we are virtual; can we go ahead and do a roll call on those? I know it is not necessary, but it is also very hard to see how many people actually say yes and how many just aren’t speaking? Dir. of Law: Correct. I think we would be better off to do the roll call vote now for those reasons on everything so that it is easier for Sue when she is doing the minutes; Mrs. Burton, I’m sorry, when she is doing the minutes. COMMUNITY ISSUES Dennis Loughry, Chair Jonathon Bollas, Vice Chair Rebecca Allman NO LEGISLATION AT THIS TIME. Mr. Loughry: Thank you. Mr. Bollas: I just wanted to give a thank you to the Service Director for the inquiry regarding the guardrail repairs on S. Munroe. Mr. Loughry: Anybody on the rest of Council have anything for our committee? No one responded. Administration? Mayor: The only thing we are working on is the Tallmadge Little League Parade. We are making the determination. Little League is going to have baseball this year, but will they be allowed to run a parade? SAFETY Jonathon Bollas, Chair Christopher Grimm, Vice Chair Craig Sisak NO LEGISLATION AT THIS TIME. Mr. Bollas: I call the Safety Committee to order; myself, Mr. Grimm and Mr. Sisak are all present. We have no legislation at this time. I would like to open it up to the committee or the administration if anybody has anything for the Safety Committee this evening. Mr. Grimm: I am 66 years old and so when the Covid vaccine became available for me this past Monday, I like, many Tallmadge residents, weren’t sure how to go about getting my vaccination. My wife plays on the internet a lot and found on Tallmadge Talk the ability for myself, my brother and my sister-in-law to get in and get vaccinated, which we did this past Tuesday. But I find that a lot of people who are my age and older who really are not VIRTUAL REGULAR MEETING 5 in Council Chambers @ 7:00 p.m. February 11, 21 Mr. Grimm (Cont’d.) computer savvy are having trouble figuring out how to get online and how to find where to get the vaccination and so forth and it becomes very frustrating for people my age and older with that. I’m not saying I’m a dinosaur, buy I’m not too far from it. So, I would like to see the City do something maybe through the Fire Department to help individuals in this community who are having trouble figuring out how to get online, who to contact, how do they get their vaccination because it is not just people my age and older and I know there are quite few people in this community who are older than I am who have not been able to get vaccinated. But, I think it is a good service that we should be stepping up with as a community possibly as I say through the Fire Department to help older citizens in our community to get into that vaccination loop to at least figure out how to get their name on the list and then maybe to calm some people down in the process about this disease and they are leary of not getting the vaccination. So, I kind of throw that out on the table and hopefully maybe the Mayor or someone else on Council could give us some direction on this. Mayor: Thank you very much Chris. Andrea Kidder in our department works with someone every day on trying to get them in. She has a list of people that we are tying to get them in and you haver to do it online. You cannot make that phone call to get it done, and as you well know, how hard it was and when they go on Monday at noon when it opens up, by Monday at 12:02 p.m. it is totally booked up. We are constantly working with . . . we have the phone numbers; we have Children’s Hospital and that is an easier one to get into, but nobody really knows that, but that is a great point. I will talk to her. We publicize it on our website on how to get to it and we have a Covid section on our website, but we will do a better job and see what we can do because a lot of people don’t have the computers to get on to do that. Mr. Grimm: That’s the big problem Dave is if you don’t have a computer or you are not computer literate, you don’t know how to go to the City’s website to get the information that we are going to need. This might be something better to be put on the bulletin board or it be publicized in the paper of who to contact in the City who can at least get you in that direction of where you need to go. Mayor: Sure. Mr. Grimm: It may be something to work with the library so you can go into the library and get on one of the public computers and do it or something. I see a lot of people who struggle . . . Mayor: Struggle a lot and you have to be there and my sister, who is trying to get in and she had four computers in her house and they were all on different channels trying to login and she was unable to get in and she is of the age that she can apply this week. It’s frustrating. There are not enough vaccines to get. We have talked to the Health Department and we have offered our Community Center to be a vaccine location because it is empty. Let’s have it. It is right beside the library and we have the drive-thru that we can do from the front of the building to the back and they have turned us down on that. So, we will work harder and there is a lot of peretinent information from the seniors that you have to be able to plug into that site and just by calling a phone number; you can’t do it that way; you have to register primarily on-line. But, thank you. Mr. Grimm: Thank you. Mr. Bollas: Mr. Grimm, I agree with you. Myself, personally and my wife were helping a lot of family members try to figure that out and we had multiple cell phones going at the same time on the internet as well as laptops going and so I understand th frustration and I totally agree with you and am happy to help in any way that I can. PERSONNEL Christopher Grimm, Chair Rebecca Allman, Vice Chair Jonathon Bollas • Ord. 70-2020 – (3rd Reading) – Authorizing the Mayor to enter into an agreement with Tallmadge Part-Time Firefighters Association consisting of Tallmadge Part-Time Firefighters and providing for immediate enactment. Mr. Grimm: Thank you. We have one ordinance before us this evening which is Ord. 70-2020 and this is to authorize the Mayor to enter into a contract with the Fire Department. This has been with us since August, or October; I’m sorry; October 22nd and it sounds as though it will probably be with us for quite a while longer. I would recommend to thee committee that we table this until June 10, 2021. IF there is a settlement somewhere, we can always pull it back at any Council meeting and amend it and approve it. But it sounds as of this point this is . . . they have hired an attorney and so they kid of dug their feet in a little bit hoping for something that just isn’t there. I would recommend that we just go ahead and table this until June 10th. Mr. Bollas, Mrs. Allman? Mr. Bollas: Yes I would second that. Are there any concerns of the Administration on doing that? Mayor: No, I would be fine with that and when it comes up on the next part of the agenda; you just make that motion to table it as long as we can pull it out earlier and I know we can. Mrs. Allman: I agree as well. Mr. Grimm: OK, we will move to table Ord. 70-2020 until June 10, 2021. Pres. of Council: Just as a point of order and I know I say it every time, but just to keep repeating myself, I will not have any discussion or anything to do with Ord. 70-2020 because husband is on that Part-Time Fire Department. So, thank you. Mr. Grimm: Thank you. Finally, having sat through a thousand, or at least 1,000 different Council meetings in my life; when I came back here I promised myself that I would shut up the first month and try to learn something, but I find our agenda very cumbersome and I find that if you were to come to find an item at 1st Reading, you would probably have to see half of the agenda two or three times and I was wondering if there was any interest in Council to review our Rules and see if we can’t move the Council meeting along a little smoother. If you were an outsider walking in, you might find it a little awkward and so I am suggesting that maybe we look at Council Rules and go across them one quick time if there is any interest from the committee. Mr. Bollas or Mrs. Allman any . . . A per Mr. Bollas: Just a question or just as clarification; are you referring specifically to the agenda or how the committee is opened? Mayor: The entire Council Rules. Just kind of go through the rules real quick and see if there are any improvements we can make to them. As an outsider, I looked at it and it looks very . . . to me it looks very cumbersome the way we do it through our agenda. A perfect example is Ord. 70-2020 is on the agenda twice. So, I would like to maybe look at it to see if maybe there is a better way of doing what we do. I think that would be a great idea. Mr. Grimm: Thank you. Mayor: Just so you understand also, if I may, the reason you see the ordinance twice and the easiest way to explain it is that the first half of the agenda is the Monday meeting and everything after Item 14. is the Thursday meeting and that is how it and that is how it as broken up. So, the first top half; you talk about it and you are like in committee and then the second half is your formal Council meeting. That is how they adjusted the agenda, but you it is definitely not a bad idea to review the rules and take a look at it and streamline it a little better, but just so you understood that that is how that got broken up. Mr. Grimm: Well, I figured it out; I just think it is like taking two agendas and shoving them together. Mayor: Monday and Thursday into one. Mr. Grimm: I know Dave you have been a proponent for years for this type of format for years before Council went to it. Mr. Bollas: I would support a Work Session to go through that. My only other question I have was; are any items and how the meeting is organized and ran reviewed as a part of the Charter Commission including anything to do with how the committees are assigned or the Organizational Meeting or anything of that nature that would possibly have overlapped with our working session? Mayor: I would say no. I think it does talk about legislation from the Council but Council has the right to create their own rules and Megan would have to concur. Dir. of Law: So there is some very broad strokes or guidelines in the Charter and so those Charter rules are kind of the overarching guidance and within that though it does talk about “Council shall establish rules for the meetings” so then there are things that are mirrored in both places, but mostly the rules are able to be adjusted by Council. But you will have to make sure and we will obviously would look at that that you are in compliance with the Charter requirements first and foremost. Mr. Bollas: I would support the working session to go through this. Mr. Grimm: Good. Mrs. Allman are you concurring with that? Mrs. Allman: Yes. I would concur with that as well.
