REGULAR COUNCIL in Council Chambers @ 7:00 p.m. November 14, 13 1. CALL TO ORDER: President of Council Maguire called the Regular Council meeting of Thursday, November 14, 2013 to order at 7:04 p.m. 2. PRAYER: Silent prayer. PLEDGE OF ALLEGIANCE. 3. ROLL CALL: Mr. Donovan, Mrs. Kilway, Mr. Maguire, Mrs. Ray, Mr. Rensel, Mr. Sisak, Mr. Stalnaker – present. Also present were Mayor Kline, Dir. of Public Service Esler, Dir. of Finance Shanafelt, Dir. of Law Raber, Economic Developer Loughry and Clerk of Council Burton. 4. MINUTES: 10-24-13 Regular Council Meeting Minutes. Mr. Rensel moved for the adoption of the 10-24-13 Regular Council Meeting minutes. Seconded Mr. Donovan. Voice vote 7-0. The Regular Council Meeting minutes for the 10-24-13 Regular Meeting were adopted by a vote of 7-0. FINANCIAL REPORTS:  Fire Transfer in the amount of $203,000 to Council on 10-30-13.  Bond Retirement Transfer in the amount of $280,000 to Council on 10-30-13.  SMR Transfer in the amount of $118,000 to Council on 10-30-13.  Appropriation Report, Fund Report, Revenue Report, and Encumber Report for the period ending 10-31-13 to Council on 11-1-13.  Tallmadge Recreation Center Profit and Loss Report for the period ending 10-31-13 to Council on 11-12-13.  Income Tax Comparisons for the period ending 10-31-13 to Council on 11-12-13.  October Financial Reports to Council on 11-12-13.  Revenue Comparisons for the period ending 10-31-13 to Council on 11-12-13.  Consolidated Investment Portfolio for the period ending 10-31-13 to Council on 11-12-13. Mrs. Ray moved for the acceptance of the Financial Reports submitted by Dir. of Finance Shanafelt. Seconded Mrs. Kilway. Voice vote 7-0. The Financial Reports submitted by Dir. of Finance Shanafelt were accepted by a vote of 7-0. 5. PUBLIC HEARINGS: None 6. COMMUNITY INPUT: Pres. of Council: We invite anybody here in the audience that would like to address Council for any matter to please come forward. No one responded. 6.A. ANNOUNCEMENTS: Pres. of Council: Mr. Mayor; excellent job on picking the recipients for the awards for this evening and also congratulations to one of our colleagues; Kim Ray, for being the Co- humanitarian of the Year that she shared humbly with her husband. Congratulations Kim. Mrs. Ray: Thank you Mr. Maguire. Pres. of Council: For those of you who are students here this evening; City Council meets on the second and the fourth Thursday’s of the month for our Regular Council meeting like we are doing tonight. The preceding Monday, we meet in committees. The City Council is organized into six different committees and so each one of my colleagues is the Chairperson of their respective committee. Those committees debate and discuss the legislation on Monday night and so tonight if you hear us rapidly going through the legislation and thinking gee; they haven’t even talked about this, and of course a lot of these are going to be what st we call, 1 Reading, where we typically do not discuss the legislation and so if you think we are rapidly going through it; it is just because we have already discussed this legislation on the Monday night meeting. Are there any other announcements to come before Council? No one responded. 7. REPORTS OF SPECIAL COMMITTEES: None. 8. AGENDA ADDITIONS: None. 9. REPORTS OF ADMINISTRATIVE OFFICERS: MAYOR, DIR. OF PUBLIC SERVICE, DIRECTOR OF FINANCE, AND DIRECTOR OF LAW. Mayor: Thank you; I will be very brief. First of all, Happy Thanksgiving. We will not meet until next month, but in the meantime, since we do have a long time off; I know you have the st budget and also 1 Reading tonight of the personnel ordinance. Please look at it and if you have any questions, set up a time and give me a call or come in and talk to Dr. Pascarella or myself. Please look that stuff over and hopefully we can make any modifications between now and then if Council has some additions or something to add to the budget. End of report. Dir. of Pub. Service: Thank you. This will also be short and sweet. Leaf collection; we did delay it for one week because of the snow we had and so we will be starting the second pass on the whole City next week on Monday. Hopefully by the next meeting, we will be coming to you with some changes or additions to the Rec Center fees grid and hopefully we won’t have to come back again for at least another six months. So, you should see that the next time. End of report. Dir. of Finance: This evening you have several reports in front of you and I want to make note that by the end of October, we are 83% of the way through the year. The General Fund has collected 94% of the projected revenue. Income Tax is 11.4% ahead of last year at about $8.1 million. The General Fund Balance is nearly $6 million.  REGULAR COUNCIL in Council Chambers @ 7:00 p.m. November 14, 13 The Rec Center ended the month with $143,734 net operating profit. The Silver Sneakers broke the $200,000 mark actually in the month of October. By the end of last year they were at $197,000 and so we will see what happens by the end of this year. Local Governments is a little under $420,000, which is in line with projection. The Fire Fund has a balance of $502,110. The Street Maintenance & Repair Fund has an unencumbered balance of $174,296. The Sewer Operating Fund has an unencumbered balance of $1.431 million. The Water Operating has a balance of a little over $1.8 million. The Storm Water Revenue is at 85% of projection. Kind of an FYI for this evening; I had earlier stated that RITA had sent out letters to the non- filers in the City of Tallmadge and this was part of a two-prong approach. The second prong being a subpoena program and so there are about 2,000 recipients of the letter regarding payment of taxes. People with that letter have been advised to call RITA should you get calls on this. The folks should be advised to just get in touch with RITA and figure out what the needs are and go ahead and get them that information. th th We will be holding a program here in the chambers December 4 through December 6 where people will have appointments to meet with representatives from RITA to get those issues ironed out. If you have any questions, I would be happy to talk about that and I would st also ask for the 1 Reading adoption Ord. 105-2013. It is basically a housekeeping ordinance to accept donations that have come in throughout the year to the City. End of report. Pres. of Council: Mr. Shanafelt; you said 2,000? Dir. of Finance: Yes; that’s correct. Pres. of Council: That’s staggering. Gene; what do you think? That’s hard to believe isn’t it? I would have guessed 200. Why so many? Mayor: If I may, because I am a recipient of two of those letters for my daughters and it goes back years. I think Stephanie’s was for 2010 and we claimed her on our Federal Income Tax, but she did not file anything with the City of Tallmadge. The letter was simply to state that there was no income that year. You just checked a box and send the letter back and so I am not getting subpoenaed on her or Michelle, who was also a college student and she had no income. We just had to prove to RITA that that happened and so some of these are very simple. It goes back not just one year. It goes back a few years. Pres. of Council: That makes a little more sense; that 2,000 was just a staggering number for the size of this community. Clerk of Council: I had one for 2011. Mayor: Mine was for 2010. Dir. of Finance: So, I think they went back three or four years. Mayor: Probably three years. Pres. of Council: Thank you Mr. Shanafelt. Are there any other questions for the Director of Finance? No one responded. Dir. of Law: I would just ask for a brief Education Incentive Committee meeting following our meeting tonight. For those people that are on the Moral Claims Committee; we are going to need to find another date other than the one that was originally proposed. I will be floating some other dates and try to get that done. Pres. of Council: Say that again; right after Council? Dir. of Law: It is just a . . . Mayor: A special committee. Dir. of Law: Councilperson Kilway and the Mayor and I. Pres. of Council: Oh; OK. Economic Developer: I presented Council with a recap from the Portage Development Board; not the total recap; I sent that to you via e-mail, but the first item was a successful project and Bang Printing, formerly Hess Printing, was something that the Mayor and I and the Portage Development Board along with Jobs Ohio have been working on this for about a year. We are very happy to announce that Bang Printing has decided to not only stay in Brimfield, but to expand and so we will not only be keeping the 247 jobs that were there; they will be hiring another 100 jobs. Payroll will be over $16 million and they are going to have new investments of over $4 million and so that is a real win for us. Again, it just goes to emphasize how important the JEDD is to our City. Along with that, I would like to encourage everyone, as you shop for the holidays, to please shop local as much as you can. Think about buying gift certificates; think about doing things with Tallmadge businesses or businesses that are located in the JEDD area and lastly, even though we are happy about our success, because it really is a regional economy; we are sad to hear today about the decision that Lockheed Martin made to leave the area because we know several Tallmadge residents that will be affected by that. Resolution 23-2013 At 1 Reading. Expressing the appreciation of the Council and Administration to Thomas E. Walters for his service with the City of Tallmadge Richardson Trust Fund Committee and providing for immediate enactment. st Mr. Rensel moved for the adoption of Res. 23-2013 at 1 Reading. Seconded Mrs. Kilway. Mayor: I would just like to thank Mr. Walters for his service to the City of Tallmadge in this capacity since 1998, but prior to that he was actually on the Tallmadge Police Department and actually when I was growing up as a young pup around town; Mr. Walters was my . . . the officer that took care of the high school and that type of stuff. So him and I go back a long ways. He is a good person. I thank him for his service to the City. Pres. of Council: You didn’t get in trouble though did you? Mayor: Nope. I was on his good side! Mr. Rensel: Serving on City Council and on the Richardson Trust Fund over the time until 2011; he was awesome. He kept bringing money or kept donations or whatever and we kept passing them and I remember Linda Poinar always asking if we could ask for more money and we did and Tom Walters took very good care of the Richardson Trust Fund and he is to be applauded for that.
