REGULAR MEETING in Council Chambers @ 7:00 p.m. March 12, 15 1. CALL TO ORDER: President of Council Donovan called the Regular Council meeting of Thursday, March 12, 2015 to order at 7:00 p.m. 2. PRAYER: Silent prayer. PLEDGE OF ALLEGIANCE. 3. ROLL CALL: Mr. Donovan, Mrs. Kilway, Mr. Sisak, Mr. Stalnaker, Ms. Tricaso – present. Also present were Mayor Kline, Dir. of Pub. Service Esler, Dir. of Finance Shanafelt, Dir. of Law Raber, Economic Developer Loughry and Clerk of Council Burton. Mrs. Ray arrived at 7:01 p.m. Mr. Rensel was absent. 4. MINUTES: 2-26-15 Regular Council meeting minutes. Mr. Sisak moved to adopt the 2-26-15 Reg. Council meeting minutes. Seconded Ms. Tricaso. Voice vote 5-0. The 2-26-15 Reg. Council meeting minutes were adopted by a vote of 5-0. Pres. of Council: For the record; it is 7:01 p.m. and Mrs. Ray is here. FINANCIAL REPORTS:  SMR Transfer in the amount of $100,000 to Council on 2-27-15.  Fire/EMS Capital Fund Transfer in the amount of $75,000 to Council on 2-27-15.  Bond Retirement Transfer in the amount of $200,000 to Council on 2-27-15.  Appropriation Report, Fund Report, Revenue Report, and Encumber Report for the period ending 2-28-15 to Council on 3-10-15.  Tallmadge Recreation Center Profit and Loss Report for the period ending 2-28-15 to Council on 3-10-15.  Income Tax Comparisons for the period ending 2-28-15 to Council on 3-10-15.  February Financial Reports to Council on 3-10-15.  Revenue Comparisons for the period ending 2-28-15 to Council on 3-10-15. Mrs. Ray moved to accept the Financial Reports submitted by Dir. of Finance Shanafelt. Seconded Mr. Sisak. Voice vote 7-0. The Financial Reports were accepted by a vote of 6-0. 5. PUBLIC HEARINGS: None. 6. COMMUNITY INPUT: Pres. of Council: City Council meets on the second and fourth Thursday’s of the month for the Regular Council meetings and the preceding Monday’s are the Council Committee meetings. At the Committee meetings legislation is discussed thoroughly with Council deciding to adopt, amend, reject, hold or table the legislation. We do allow time for community input at this point in the meeting. If anybody would like to address Council, please come forward and state your name and address. 6.A. ANNOUNCEMENTS: There will be a Board of Control Mtg. following Regular Council Mtg. this evening. 7. REPORTS OF SPECIAL COMMITTEES: Mayor: I really don’t have one, but I just want to give Council an update. You know that we did the Fire Study last year and we are working on the presentation that will be presented to Council when you get back from your break and so it will probably be the second or third week in April. I will probably ask for a Work Session. It won’t be anything related to a Council meeting. We will just sit and talk only about that. So, just look forward to that. 8. AGENDA ADDITIONS: Ord. 37-2015 will become Item 20.A on the agenda. 9. REPORTS OF ADMINISTRATIVE OFFICERS: MAYOR, DIR. OF PUBLIC SERVICE, DIRECTOR OF FINANCE, DIRECTOR OF LAW AND ECONOMIC DEVELOPER Mayor: Today Dr. Pascarella and I attended the State of the County with Russ Pry. It was a nice presentation. There are a lot of good things going on. I know Councilperson Tricaso was also in attendance. I listened to the County Executive talk about all of Summit County and how they are doing extremely well. Hats off to his administration and the whole County. He did talk in some depth about the Issue 12 that failed; the safety forces radios. What do we have to look forward to in the future on that? We still have the issue of our radio system. By 2018 it has to be replaced or upgraded for all of the safety forces throughout Summit County. The City of Stow’s Council and all the other seven municipalities in Summit County have to be upgraded. It will be a lot of dollars. He is right now willing to take care of the County stuff, but it is going to be on the backs of the individual communities to take care of their own radios unless we as a group come back to him . . . to see if we can work together to put it on another mechanism to get funding for the safety forces only. I am going to meet with the other Summit County Mayors. We have a meeting . . . next week it is down in Columbus; it is the Annual Northeast Ohio Mayor’s Association down in Columbus next week on the 18th. I will be talking to our group of people down there and I don’t know where we will go, but Tallmadge has to take care of the radios between now and then. We will start planning for that early on. There will be more to come on that. I also just came back from the Tallmadge Middle School. It was a career day that they actually started two years ago and this is the second Career Day and kids would come in and look at the different disciplines. One was government where I was attending and then Police was there and the Fire Department was there. There were 35 different groups from lawyers to . . . just every career that they could imagine. So it was a nice event for the kids to go in  REGULAR MEETING in Council Chambers @ 7:00 p.m. March 12, 15 Mayor (Cont’d.) and think at this young age what they want to be when they grow up. You know no matter what we say we are going to be at that age; it typically changes, except for me; I said I would be Mayor when I was at Overdale School and so you have to be careful of what you ask for! Also tonight, Tallmadge High School basketball is playing their Regional game against CVCA. That is going on as we speak. I think that is why Mr. Rensel is absent from Council tonight. So good luck to the boys up there. I know that this is Council’s spring break and this is the last Council meeting until next month. There are some 1st Readings that I would typically like to go to 2 nd Reading, but they are really just housekeeping things; Ord. 32-2015 is for trade-in of excess equipment which are some vehicles for the new Police vehicle that we are purchasing. We are going to trade-in vehicles and a couple of the Street Department vehicles in that trade-in and so if Council wants to pass that; that is more like a housekeeping ordinance. Ord. 33-2015 is a demo program and so is Ord. 34-2015 and Ord. 35-2015. All of those are blighted homes that we have been requested to tear down and we have the funds to do that and so if Council wants to adopt those; we can get that process started now that we have created the other ordinance at the last Council meeting. Then Ord. 36-2015 which is the South Avenue Water Project; we are going to take a loan out with the Ohio Water Development. We are going to bid that project and part of the bid process is to allow us to go with this grant from the OWDA. Then the most important is Ord. 37-2015. That is what was added to the agenda. You received a phone call and I talked about it last week, or on Monday, that we can apply for a $25,000 grant to demo the bowling alley and that application is due tomorrow. We were just informed about it this week and so if Council adopts that then we will turn in the grant application tomorrow and hopefully . . . they are only going to give out one grant Countywide and we have a real good chance at this one. End of report. Dir. of Pub. Service: I just got notice today that we are no longer being rationed on the salt. Spring is here and we are done with that, but we get some pretty good storms usually in March yet. But it is sure a sign of spring when our street sweeper is out and they were out patching holes and so we would rather be doing that than dealing with snow. The question was asked about bags for the textile recycling. When they drop off the new bags, they are actually tied to your trash can so they don’t blow away. The other question was on the alpacas on North Avenue. They are allowed to have 30 and they have 25 at this point and they are trying to get rid of some. End of report. Dir. of Finance: I will make this brief. Of course, you have the financial reports in front of you. Just a couple of highlights; the General Fund is on target with estimate. Income Tax is ahead of last year by a little over 4%. The General Fund balance is almost $4.5 million. The Rec Center ended the month with a net operating profit of about $41,500. Local Government Funds are at $93,421. That is ahead of estimate. The Fire Fund balance is $206,122. The Street Maintenance is at $265,288. The Sewer Operating balance is $1,257,565. The Water Operating balance is a little over $2 million. The Storm Water Revenues are in line with projections. So it looks as though we have a nice start to 2015. If you have any questions, I will be happy to address them. Dir. of Law: No report. Economic Developer: Express Furniture up on Brittain Road, which is a long time Tallmadge company, was projected to be sold at Sheriff’s sale this week. It had nothing to do with business; just tied to value and the bank loan guy called. I do not know if that sale happened, but I will let Council know when you get back. Ten-Minute Lube reopened. I placed at your desk this evening a nice article that was in the Record Courier today on Kent Displays and a report from the Greater Akron Chamber. End of report. Pres. of Council: Welcome to the students this evening. I just want to mention that at this point in the meeting everything is going to start moving kind of fast. This legislation has already been discussed; some of it will be at 1st Reading. It looks like we go through everything real fast all of the sudden and just pass things, but that is only because we have covered it before. 10. Ordinance 26-2015 At 3rd Reading. PUBLIC SERVICE Amending Chapter 160.06 of the Tallmadge Code of Ordinances for economic develop- ment programs, demolition of real estate program and providing for immediate enact- ment. PUBLIC UTILITIES Authorizing the Director of Public Service to advertise for bids and the Mayor to enter into a contract for the replacement of a waterline on South Avenue from Ferguson Drive to the south corporation limits and providing for immediate enactment. FINANCE Authorizing the Mayor to enter into an agreement with WARDJet, Inc. for a New Jobs Program Grant pursuant to T.C.O. 160.05 and providing for immediate enact- ment. PUBLIC SERVICE Authorizing the Mayor to enter into a three- year contract with Great Lakes Recycling, Inc. dba Simple Recycling for the collection of soft recyclables in the City of Tallmadge and providing for immediate enactment. PLANNING & ZONING Approving and granting a conditional zoning certificate for special nonresidential development at 1077 East Avenue for con- struction of a barn and fence to house seven male alpacas. Pres. of Council: Ord. 30-2015 is at 2nd Reading and will remain before the Planning & Zoning Committee. 15. Ordinance 31-2015 At 2nd Reading. PLANNING & ZONING Amending the zoning map by rezoning the P.H. ON 4-9-15 @ 7:03 P.M. property of applicant, HTH, LLC, dba Silver Star Motors, LLC on behalf of owner, West and Industry LLC, from Industrial-1 to Com- mercial-4 consisting of approximately 1.58 acres located at 257 West Avenue. Pres. of Council: Ord. 31-2015 is at 2nd Reading and will remain before the Planning & Zoning Committee and there is a public hearing scheduled for 4-9-15 @ 7:03 p.m. 16. FINANCE Declaring certain City-owned vehicles to be excess and authorizing the Director of Public Service to sell such equipment at public sale or trade-in and providing for immediate enactment. Pres. of Council: Ord. 36-2015 is at 1st Reading and is assigned to the Public Utilities Committee. 20.A. Ordinance 37-2015 At 1st Reading. FINANCE Authorizing the Mayor to apply for Summit County Land Bank Discretionary Grant Funds for the demolition of the structure located at 333 Northeast Avenue and enter into an agreement with the Summit County Land Reutilization Corporation to demolish that structure and providing for immediate enactment.
