REGULAR MEETING in Council Chambers @ 7:00 p.m. January 14, 16 1. CALL TO ORDER: President of Council Donovan called the Regular Council meeting of Thursday, January 14, 2016 to order at 7:00 p.m. 2. The 12-10-15 Regular Council meeting minutes were adopted by a vote of 7-0. There will be a short Richardson Trust Fund meeting following this meeting. 7. REPORTS OF SPECIAL COMMITTEES: None. 8. AGENDA ADDITIONS: Ord. 25-2016 will become Item 34.A. 9. REPORTS OF ADMINISTRATIVE OFFICERS: MAYOR, DIR. OF PUBLIC SERVICE, DIRECTOR OF FINANCE, DIRECTOR OF LAW AND ECONOMIC DEVELOPER Mayor: I will go over a couple of items. As everyone saw in the newspaper, Chapel Hill, with Macy’s closing and three other stores are falling off from up there as you saw or read, that we are working with Akron and Cuyahoga Falls and we will start meeting more frequently on some brainstorming on what to do with the Chapel Hill area. So, as Dennis has reported in the past, and even tonight, we have been working with Akron over the last year to year and a half on what to do with that whole Brittain Road corridor because Tallmadge is on the east side and Akron is on the west side. Nobody knew that Macy’s was going to go out and neither did Akron, but Mayor Horrigan actually called me before it hit the press that they were closing and saying that they have a lot of great ideas and things are coming out that we should be happy with and that we will be meeting shortly. Just to let you know that we are working with our neighbors to help facilitate some sort of mixed use or whatever. Also, Council authorized us to apply for a LGIF grant for Clean Fuel Ohio and we did receive that grant and that grant is for Tallmadge City Schools, Tallmadge City, Brimfield and Summit DD. There will be more to come on that. We were just notified that we did receive that $50,000 grant and the grant contracts will be forthcoming shortly. This week we did have a master meter/sewer meeting here at City Hall and all of their master meter contracts to start working on that again or continue to work on that and this afternoon we had a meeting of Tallmadge only and City of Akron on the meters. So we are asking for a lot of information from Akron clarifying some things and so we are continuing to work very hard on that because that will affect all of us. The contracts; I know you have ordinances tonight and I am going to say that we are not going to adopt those tonight, but I will ask to have an Executive Session at the next Monday meeting. It looks like we have tentative agreements for all the contracts. As we have stated in the past, we weren’t sure how some of them were going to go, but we were able to work out some things and so we will go over that more. They have not voted; only one contract was voted on and that was the Teamsters that will be tweaked a little bit based on a “me too clause.” The North Avenue Project out here actually started even though the contract is out to bid right now for the construction, but the contract for the gas line and the utility work has been let out and that is what you see out there now is that going on and so it is pretty cool looking out the City Hall window; out of the window in my office to see yellow gas lines being pulled down the road and a big crane up by the Circle and steel going up on the Bob’s Big Boy site and the noise of the Danbury Project going in the background. A lot of neat things are going on. Next Wednesday is the State of the City and I think all of Council got invited to go to that. It is at the Chamber.  REGULAR MEETING in Council Chambers @ 7:00 p.m. January 14, 16 Frank Dimenna was sworn in as the Captain and that is working out extremely well already. He has only been in that position for a week and a half or almost two weeks now and really we needed some extra help up there on that side of it and that is working out. That is really what Ord. 25-2016 is about tonight and we will get into that in a little bit. Lastly, I think most of you, or I’m sure all of you know that Dennis Loughry will be departing the City and tomorrow is his last day here at the City, but he is taking a vacation. I just want to thank Dennis for all of his efforts over the past five years. I think the City is a little better place because of Dennis Loughry being involved in the Administration team and I would personally like to thank him for all of his efforts and wish him very well working with his son. Good luck. End of report. Oh, the items to adopt tonight; I am only going to say the items that we do not need to adopt. I can do that as we go along, but it is Item 17, Ord. 7-2016, Item 26, 27, 28 and 29; those are all the union contracts and we do not want those adopted tonight and then Item 34, the Civil Service Rules changing how we do some hiring practices within the safety forces; in the Police Department particularly. So those items I do not want adopted tonight. End of report. Mr. Rensel: Mr. Mayor, there is another announcement coming out that they are going to be closing K-Marts. Do you have any advanced information about the one on South Avenue? Mr. Sisak: I did not see them on the list. I saw a list and they were not one of them. There was one in Boardman, Ohio, but that was it. Mr. Rensel: OK. Thank you. Mr. Sisak: Mayor, who got the bid for the utility work on 91 or is that . . . ? Mayor: That is all . . . the gas company is doing the work and so they subcontract out and Ohio Edison does the pole work and the gas line is a subcontractor of Dominion East Ohio Gas. Mr. Sisak: So, as far as the public, if they see people working on or about their property on 91 then that should be Dominion or East Ohio or one of their subcontractors? Mayor: What I have asked Bryan and Lloyd to do is, and we will get a section in the papers; a weekly update or daily update on our website or some type of media better than we have done in the past, because once the detour starts all of that is going to get very monotonous and then the Testa property, which will break ground probably in February. Mr. Sisak: Good. OK; thank you. Dir. of Pub. Service: Thank you. As the Mayor mentioned, the contracts for the North Avenue Project is out for bid. We have a pre-bid meeting with anybody who wants to bid on January 26th. The bid opening is on February 4th. All of the noise we have out front . . . Linda asked me today if she going to have to get used to that and I said, well probably for about the next 300 days you are going to have to get used to it, but it is a good noise. Speaking about the contract for the master meters with Akron; they did their calibration tests and I wasn’t real comfortable with what they did and so we did an actual zero flow calibration where we actually stopped the flow into the meter and found out that their meter was still reading with no flow 2-1/2” and so we have been overpaying for sewer and that is a good bargaining chip for us and I think it is going to work out in our favor with Akron. Tuesday we meet with Kent and the Metro Parks about joining the Freedom Trail to the Kent Trail. We have some ideas on how to do that and make it a little safer. End of report. Dir. of Finance: I am glad to be here this evening. You all should have received my written report and I am not going to rehash that. Just to let you know our income tax did end about 5.82% above where we were last year and a little bit over where we had budgeted; we had budgeted for a 5% increase. So, 5.82 gave us a little extra. You all may have seen the on-line checkbook. It went live on December 30th I think it was. So that is out there for anybody throughout this country or the world to review . . . currently it is current through September of 2015. It has data from 2012 through September of 2015. Right now things are a little crazy and so we will get the rest of the year’s data on there as soon as possible. Then our plan is to keep that updated on a monthly basis once we get the month closed, we will update the previous months financial transactions out there and so we would like to keep that as current as possible. We have gotten the year closed and working right now on getting our W-2’s issued. We are a little behind due to our software company being a little slow in issuing an update that we need in order to run the current W-2’s and then I am also in the process of interviewing for an Assistant Finance Director and then hope to have someone in place by mid-February for that position. Then I would just ask for adoption of Ord. 25-2016 this evening. End of report. Dir. of Law: Thank you. I just want to add to the Mayor’s list of items not to adopt that we do not need adopted this evening. We don’t need Ord. 32-2016 or Ord. 33-2016 adopted this evening because they are Planning & Zoning matters that will be in front of Planning & Zoning in February and so I just wanted to add that to the list. I want to also congratulate Dennis and thank him for his efforts for the City throughout the years in various different roles that he has had. It has been a pleasure getting to know him better and we are going to miss you around here and so best wishes to you. End of report. 2  REGULAR MEETING in Council Chambers @ 7:00 p.m. January 14, 16 Economic Developer: Well, as usual, the Mayor gave most of my report. I have learned over the years that that was my job. So, anyway. Really, you know, this is the end of 21 years for me being in public service whether as a Councilperson, School Board member and now an employee and so I can look at City Hall from a lot of different perspectives and it has been great. Really, I just have some thank you’s if you will bear with me for a minute. I want to thank the Express. You know when you do this for as long as many of us have, sometimes you can be misquoted or taken out of context or sometimes you just said something that you wished you would not have said, but the Express has always been fair to me. So I am thankful for that. Then the Beacon Journal; it is good to see you guys here out in the suburbs. That’s nice. So the Beacon has always been fair. What we have accomplished the last four or five years ultimately doesn’t get done without Council’s blessing. You guys do control the money; I remember that much and so these projects and the services that we provide to our residents all get done ultimately because of Council and so I want to thank you for your cooperation. I have known Susan forever back in the old Council days and knew Gina in a different way with our children, but you have a good staff in your office and they have been very helpful to me and have become good friends. Bryan was first an employee when I was the Service Director and was extremely helpful in helping me in that role. Ultimately everything that we do may start in community or economic development, but at some point for things to really happen, you are reliant on a department that reports to Bryan to get things done. He has been very helpful. Karen Morgan has been my assistant. I have known Karen for many, many years and the last four years in particular have been a real pleasure. She was a great help to me and a good friend. I come to the meetings and speak a lot more than I should; that’s for sure, but most of you don’t interact much with Pat Sauner, but Pat is an excellent co-worker and is worth his weight in gold for what he does for the City. So Pat has just been a great friend and a great co- worker. The last four years I have actually on paper reported directly to Dr. Pascarella. I think Tom is one of the brightest men I have ever met and he has taught me a lot. He is a wealth of institutional knowledge for the City and for business in general. We benefit for what he does for us. Megan, I think every time I open my mouth; she would shutter a little bit hoping I wouldn’t get us in trouble! I respect Megan more than you can imagine. She is a great Law Director and a good person and loves our City. I’m almost done! Mollie; I always tell people that Mollie is the daughter I never had. If I would have had girls, I would have had a tough one just like Mollie and I will tell you this; I have no doubt that if someone owes us money; they are going to pay it. If we owe somebody money; we will pay our bills and every penny will be accounted for and invested the best possible way and so I am thrilled with the people I had to work with. Lastly, everyone knows that Dave and I served on Council together and everyone knows that we coached our kids together and that we were friends and that we were two different political parties. Everyone knows the story. No one knows when you put 20 or 15 years at the time or 16 years how difficult it can be at times to work for a good friend because ultimately you have to have a separation. You have to know when to separate the friendship from the job and you have to know . . . well it is easy to know who is going to win disagreements because it is Mayor Kline! But I will tell you that our Mayor and my good friend always listens and never plays that card. He may have a preconceived idea of what he thinks he wants to do, but if the facts don’t agree with that, he has been willing to change his mind and I think that that is all we can ask for and so we did our very best to balance that work/friend relationship and I think all in all we did a great job. So I am leaving primarily because of changes in PERS since I came to work for the City. I did not make it financially a smart thing to stay here if there was another opportunity. That was just my situation. In my situation, I had opportunities that would let me take care of my family in a better way if I was going to continue to work full-time, especially if I was going to continue to do that for 5, 6, 7 or 10 years. So this is a business decision and ultimately it was a business decision, but it had nothing to do with any job dissatisfaction or any of those kinds of things. Opportunity presented itself and I evaluated it and I took advantage of it. That’s the bottom line. So with that, I will answer any questions. No one responded. OK, thank you very much. Mr. Stalnaker: I’m not going to let you off that easy! I know you can hear rumors that maybe some of us don‘t hear, but with the anticipation of Walgreens purchasing Rite Aid; do we have any . . . have you heard anything about that? You know we have a Walgreens right down there at Six Corners. Economic Developer: Right. Mr. Stalnaker: I just want to thank you for your service and it has been enjoyable, most of the time, working with you and good luck in your new endeavor. 3  REGULAR MEETING in Council Chambers @ 7:00 p.m. January 14, 16 Economic Developer: Thank you Mr. Stalnaker; I appreciate that. Mr. Stalnaker: Mollie, we sent out several thousand letters for people that did not file tax returns. Have we had a good response on that or do we still have several of them still outstanding? Dir. of Finance: All of the returns were actually based on the letters not due until January 31st and so they were giving people until the end of January to get that taken care of. Those went out the beginning of December and so once the end of January comes in, I will inquire with RITA as to how many of those returns we were able to get taken care of. I know we have helped several people. A lot of them were just issues with people maybe being retired and we didn’t have record of it and so we faxed over a lot of papers to RITA just letting them know that so and so is retired, but hopefully most of the time those issues are just a result of not all of the accurate information being on file at the time or . . . most people who don’t file don’t actually have the intention not to file; they forgot or they misplaced it or that kind of thing or they are retired. So once January 31st and that deadline hits, we will have a better idea of how many returns are still outstanding. Mr. Stalnaker: Have we had many inquiries about the information becoming public? Dir. of Finance: We received a few phone calls the first couple days. RITA did give me, and I think I forwarded it to Council, RITA did update me and gave me the information that I needed so that I could help anybody who called in. Like I said, the first couple of days we did receive quite a few phone calls, but those have really tapered off and I actually haven’t heard of too many . . . actually, I don’t know anybody who has come to me in Tallmadge that actually received a letter. Maybe you have heard from people, but I don’t know anybody . . . nobody has come to me stating that they received a letter. Pres. of Council: I will say from experience; Mollie is on top of everything; quickly. Thanks Dennis. Mr. Sisak: Yes, thank you. They are our medical advisory and that is where all of our medical guys get trained and they do all the stuff and the doctor and the medical controls are out of Akron General and as you can see it is $14,064 towards the purchase of that Auto-Pulse and so it is very nice of them and also the next ordinance coming we will talk about. Seconded Mrs. Kilway. Mayor: Here again, Akron General Hospital is stepping up to the plate. We are going to total electronics for report writing and so it will all be done through the Microsoft software and the pads and all of that and so they will have drop-down boxes that will make it a little easier for the medics as they are filling out these reports. They can then send that report directly to the hospital and the telemetry stuff that we have for the cardiograms and all of that; they will also pick up what they are seeing and it will record exactly what . . . the technology; I think I want to become a paramedic again! PERSONNEL Amending and supplementing Ord. 99-2013 Section 2.12(B) clothing allowance for non- collective bargaining employees and pro- viding for immediate enactment. Pres. of Council: Ord. 25-2016 is at 1st Reading and is assigned to the Personnel Committee. Mayor: Mr. Chairman, could Council consider this tonight? Before you make the motion, I can go into it a little bit. One thing that we forgot when we hired the Assistant Fire Chief and also the new Captain; the ordinance; the personnel ordinance for safety personnel did not have these positions so therefore those guys do not get a clothing allowance because they are now out of the bargaining unit and into that and it was an oversight on my behalf when I did not come forward with the legislation. They submit their invoices for their clothing allowance and Mollie can’t really pay it and so as Dennis said earlier, she is a good watch dog and she said that we don’t have the authority to do that and so that is what the ordinance is for. That is what is up on the screen right there (the personnel ordinance) and it will be Police Chief and now Captain and then Fire Chief and now Assistant Fire Chief or Deputy Fire Chief and so they will get the equal sum of the Sergeants and let me show you what that is . . . this is in the collective bargaining unit contract that is existing. This did not change in the new contract that we just have a tentative agreement on and so you can see that they do receive $1,000 for the Sergeants and the Lieutenants. So therefore, the Chief and the Captain and the Chief and Deputy and they will receive up to $1,000 and that was part of the attachment that was going to be part of it, but that is currently the union contract and the new contract will state the same and so we will just amend that. That is the personnel ordinance; we will have to add those two positions into that and that is what Ord. 25 allows us to add into that.
