Tallmadge City Council Regular Business Meeting (2013-2019)

REGULAR MEETING in Council Chambers @ 7:00 p.m. April 28, 16 1. CALL TO ORDER: President of Council Donovan called the Regular Council meeting of Thursday, April 28, 2016 to order at 7:00 p.m. 2. PRAYER: Rev. Phil Anderson, Bethel Assemblies of God, Tallmadge. PLEDGE OF ALLEGIANCE. 3. ROLL CALL: Mr. Donovan, Mr. Rensel, Mrs. Kilway, Mrs. Ray, Mr. Sisak, Mr. Stalnaker, Ms. Tricaso – present. Also present were Mayor Kline, Dir. of Pub. Service Esler, Ass’t. Dir. of Finance Burns, Dir. of Law Raber, Economic Developer Weinberg and Clerk of Council Burton. 4. MINUTES: 4-14-16 Regular Council meeting minutes. Mrs. Ray moved to approve the 4-14-16 Regular Council meeting minutes. Seconded Mr. Sisak. Voice vote 7-0. The 4-14-16 Regular Council meeting minutes were approved by a vote of 7-0. FINANCIAL REPORTS: None. 5. PUBLIC HEARINGS: None. 6. COMMUNITY INPUT: Pres. of Council: I would like to welcome all of the students that are here this evening. Tallmadge City Council meets on the second and fourth Thursdays of the month for the Regular Council meetings and the preceding Mondays are the Council Committee meetings. At the Committee meetings legislation is discussed thoroughly with Council deciding to adopt, amend, reject, hold or table the legislation. We do allow time for community input at this point in the meeting. If anyone would like to address Council, please come forward and state your name and address. Bill Romer, 3616 Southern Rd., Richfield, Ohio. I very much appreciate the opportunity to speak to Council and the residents. I think this is either my 5 th or 6th time appearing before you. I previously represented Tallmadge and all of Summit County as a member of Summit County Council and one of the commitments that I made was that should I be elected, I would make sure that I would go to each community’s meetings every year to know the issues that are facing the elected officials as well as the residents. I think being informed really makes the job of being a legislator much easier. I now currently represent Tallmadge and all of Summit County as a member of the Summit County Education Service Center Board of Governors. When I noticed that the parking lot was full; I thought we were going to have a number of students here. I was at the Tallmadge Board of Education meeting coincidentally last week and I knew they had a requirement to make sure they attended a Council meeting to get a government perspective and I really appreciate that. I do also happen to be a candidate for Summit County Executive and again, if I am fortunate enough to be elected, I will continue to reach out to the communities to make sure that I am aware of the issues that are facing everyone. REPORTS OF SPECIAL COMMITTEES: None. 8. AGENDA ADDITIONS: None. 9. REPORTS OF ADMINISTRATIVE OFFICERS: MAYOR, DIR. OF PUBLIC SERVICE, DIRECTOR OF FINANCE, DIRECTOR OF LAW AND ECONOMIC DEVELOPER Mayor: Thank you. As I reported to Council at the last Council meeting about the Summit Racing issue that we were working on with Congressman Ryan and all of the Congress folks from the State of Ohio and I am happy to announce that we did receive a letter from the EPA dropping the omission limits effecting racing cars and so there is a reprieve and so I would like thank all of the folks who worked on this. I know that Mary Tricaso was very active in helping us with this meeting and meeting with Summit Racing and all of that and all of Council with their efforts in talking to folks, but I did receive a nice thank you from Summit Racing about this. That would affect nationwide and their other divisions in North Carolina and also out in Nevada and so that was a good thing that we worked on and I am happy that that happened. Also, we have been working on the Comprehensive Plan. As you know, we have been working on this now for about a year and a half and we did get a draft from Dave Hart and we have been working with it internally and as soon as we go through it and get a cleaner draft, then we will start meeting with Council on the Comprehensive Plan. My goal is to get it here by January and we are already at March, but it is a big document and so we will get it to you soon, but I just wanted to make sure that there was an update that it is getting worked on. Also we are working with rebranding the City of Tallmadge; our logos and our website upgrades and so there is a committee working on that and we will get Council involved with that. There will be some focus groups that our consultant will be working on and we will let you know when the surveys are going out. But, outside of that, that is the end of my report. Dir. of Pub. Service: Work continues on North Avenue. Liberta currently has two crews working on relocating fire hydrants. We are replacing them all with new ones. We are not wanting to put old ones back as we move them. They also have another crew working next door at Fifth Third Bank doing the first underground storm water detention area and in about two weeks they hope to begin storm water pipe installation on North Avenue.  REGULAR MEETING in Council Chambers @ 7:00 p.m. April 28, 16 Ohio Edison continues installing new poles and moving their cables. After they get all of their poles in, the other utilities; phone and cable will move all their lines over to the new poles and will get the old ones removed. Concrete repairs are out for bid with a bid opening on May 6th. The paving bid is out and bid opening on that is May 19th. Our crews are working currently at the Tallmadge Recreation Center doing repairs to all of the asphalt there. Then we will do an asphalt seal after we are done with those repairs. Crews are also working out at Maca installing some concrete for new cabanas and doing cleaning and repairs to the equipment out there and getting ready for this season. End of report. Mr. Rensel: Mr. Esler, the depression on the Circle by Bob’s Big Boy, which looks like a detention or a detention pond potentially; is that going to remain like that or is that going to be enclosed? Dir. of Pub. Service: At the Big Boy site? Mr. Rensel: Yeah, right at the corner of North and . . . Dir. of Pub. Service: Yes, that will remain . . . that is a detention water quality basin and that will remain there. Mr. Rensel: There is no concern about the safety or cars winding up in that ditch or people falling into there? I mean it is right on the Circle. It is not like . . . Dir. of Pub. Service: It is on private property and I don’t know of any accidents where we have had cars going off the road there. I guess it is a possibility. But, no it has to remain. Mr. Rensel: OK. Thank you. The other item for you Mr. Esler, because I know you are overseeing Maca; is the lady that wrote the letter about the fees . . . Dir. of Pub. Service: We have looked at our fees and we think we are right where we need to be. We do have a meeting coming up that we will discuss those. Mr. Rensel: That is only my concern that the City will at least evaluate whether . . . Dir. of Pub. Service: We evaluate our rates all the time. Mr. Rensel: Has anyone responded to her or are we expected to do so individually? Dir. of Pub. Service: Jessica. Mr. Rensel: I have not seen any e-mails on that; that is why I am asking. Dir. of Pub. Service: Well, she would respond directly to that person. Mr. Rensel: OK. For those in the audience; this is no secret, there is a lady’s family has two children that are 18 and are out of high school and she wanted to renew their passes and now that they are 18 and over; they have to pay individually and it gets to be a lot more expensive than it was when they were part of the family. That was her concern. Mr. Esler and his group are working on that, but right now it is what it is. They have to pay as adults. Dir. of Pub. Service: That’s correct. Mrs. Kilway: Like the rest of us do. Mr. Rensel: Thank you Mr. Esler. Dir. of Finance: No report this evening. Dir. of Law: I want to thank everyone who was able to make it out to our Community Opiate Forum that we had yesterday. It was full of information and I thought that we provided a lot of good information about the dangers of opiate use and abuse and we did get a lot of positive feedback in response. So we will be looking at that and looking at things that we liked and things we could do better next time and doing an evaluation of it, but overall, we had a really great response. We think that we had about 85 people that attended. In conjunction with that, we are doing the Tallmadge Drug Takeback Day. We are doing that on the National DEA’s Drug Takeback Day and so that will be this Saturday from 10:00 a.m. to 2:00 p.m. and again it is a great time for people to clean out those medicine cabinets and get rid of the unused prescription medication and get rid of over the counter drugs that you don’t need and all you need to do on Saturday is swing by the Police Department. There will be signage out there to direct you where to go. It will be staged in the Police Department garage and you won’t even need to get out of you vehicle; just drop it off and go. So, it makes it very easy. If you can’t make it during that time, again, we will remind you that we do always have the dump box in the lobby of the Tallmadge Police Department which is open 24/7 and you can deposit those items there anytime. Thank you. Mrs. Ray: I would just like to commend Mrs. Raber and her staff and the City for putting on a great event last night. I thought a lot of the information was so valuable for everyone. There were some things that I did not know and so it was an eye opening experience as well and especially the young man who is a recovering addict and talked about his experiences and his journey to recovery. I would really urge the school officials to bring that young man in to talk to every class at the high school because his story was heroing, but I think very uplifting. It was just a job very well done and so thank you very much. Dir. of Law: Thanks and I will just take this quick second to say that if you do have any churches or organizations that you think would like to hear a truncated version of that; Detective Loughlin and I are already booked to go over to Our Lady of Victory and do a presentation next month and so again, we would be happy to do that. It was an excellent job and so well planned out. It was a great evening. Thank you very much for doing that. I do have a question; I figure if I am thinking about it that somebody else might too. With the drug take-back day; does everything have to be in original prescription bottles; do we tear names off it . . . Dir. of Law: A great question. We ask that you keep it in the containers if you have the containers. We have had people come without them and we still take them. But, if you would please mark out all of your identifying information on the pill bottle and then bring that in that way; that is the best method to do that. We do not accept syringes. That is a different number and we will give you contact information for that, but otherwise, we will take everything including over the counter medication. Mrs. Kilway: Thank you very much. Economic Developer: Thank you. Last week, the Mayor and I met with the new owner of the 12.8 acres adjacent to Rocco’s Plaza and he does have some interest in purchasing the remainder of the land which would give us over a 20 acre development site and so there are some positive possibilities there. He is open to ideas and so he is not wedded to one particular idea and so he seems like somebody who is going to be easy to work with and so we are looking forwards to seeing how that transpires. We are still working with another developer on a possible housing development on Ripley Farm and that is just ongoing discussions. Then next week, we have a meeting with Brimfield to discuss possible development on Maple Crest Golf Course and so we are just going to have an open discussion about what we would like to see there and what Brimfield would like to see as well. That’s it. Mr. Sisak: I saw that there was a lot right next to Tallmadge Collision Center, kind of northwest that was sold; I just wondered if we know who bought it; if it was Tallmadge Collision or if it was Waltco or . . . it is a real narrow deep parcel. Economic Developer: That is actually the Waltco property that they are currently leasing and that was bought by Speelman Electric. So they have the intention of occupying that building in another two or three years because they need some expansion room and so we are going to be having to work closely with Waltco to see if we can retain them and move them elsewhere. Mayor: It is actually the Independent Drug building; it is not the little strip. It is the . . . the blue building. Economic Developer: It is in an odd space. It is in an odd place where they put the sign. I didn’t understand that either. Mr. Sisak: OK, then secondly; is Maplecrest for sale currently? I know it has been on an off the market for years. Economic Developer: I’m sorry; what did you ask? Mr. Sisak: Maplecrest? Economic Developer: Yes; it is on the market. Mr. Sisak: I know it has been back and forth for probably ten years. OK. Great. Thank you. 10. Ordinance 40-2016 At 3rd Reading. PLANNING & ZONING Approving and granting a conditional zoning certificate for special nonresidential development to applicant LTC Tallmadge, LLC on behalf of owner Yusef Khan Grotto 169 for operating a skilled nursing/conva- lescent care facility located at 619 North- west Avenue. Mr. Sisak moved for the adoption of Ord. 40-2016. Seconded Mrs. Ray. Roll Call: Mrs. Kilway, Mrs. Ray, Mr. Rensel, Mr. Sisak, Mr. Stalnaker, Ms. Tricaso, Mr. Donovan – unanimous. Ord. 40-2016 is adopted by a vote of 7-0. 11. Ordinance 41-2016 At 2nd Reading. FINANCE Authorizing the Mayor to enter into an agreement for the sale without bid of real property at 26 Nottingham Street, not needed for municipal purposes, to Tallmadge Grow, Inc. a Community Improvement Corporation. Pres. of Council: Ord. 41-2016 is at 2nd Reading and will remain before the Finance Committee. Mr. Stalnaker: Excuse me; but should we change that to two with one abstention? Dir. of Law: Yes; if you want to amend that. It’s just a typo. Mrs. Ray: But, thank you for catching that Mr. Stalnaker; you are correct. Dir. of Law: It’s still at 2nd Reading. 3  REGULAR MEETING in Council Chambers @ 7:00 p.m. April 28, 16 12. Ordinance 42-2016 At 1st Reading. COMMUNITY ISSUES/SAFETY Authorizing the Mayor to enter into a Memorandum of Understanding with the Summit County Metro Parks and the City of Kent, Ohio for connectivity improvements to the Freedom Trail and Portage Hike and Bike Trail and providing for immediate enactment. Pres. of Council: Ord. 42-2016 is at 1st Reading and is assigned to the Community Issues/Safety Committee. 13. Resolution 5-2016 At 1st Reading. Extending the sympathy of the Council and the Administration to John “Ziggy” Ziegler and members of his family in the death of John E. Ziegler Jr. and providing for imme- diate enactment. Mr. Rensel moved for the adoption of Res. 5-2016. Seconded Mrs. Kilway. Mayor: My heart goes out to John Ziegler. It is always tough to bury one of your family members; let alone his son. So my heart goes out to him. If you see John; he is the one that some of you may not know him; he is retired from the Street Department, but he is still with the Street Department, but back part-time as one of our parks guys. He is the one who takes care of Southeast Six Corners, all the flower beds that are out and about and he works down at the Mac Burleson field with some stuff. He works with Wayne a lot. There will be a fund raiser for his son here in Kent and we will pass out that information or put it in your box. It is coming up in the future. Voice vote 7-0.
