REGULAR MEETING in Council Chambers @ 7:00 p.m. May 26, 16 1. CALL TO ORDER: President of Council Donovan called the Regular Council meeting of Thursday, May 26, 2016 to order at 7:00 p.m. 2. PRAYER: Rev. Kurran Bishop, SPAN Ministries, Tallmadge. PLEDGE OF ALLEGIANCE. 3. ROLL CALL: Mr. Donovan, Mr. Rensel, Mrs. Kilway, Mr. Sisak, Mr. Stalnaker, Ms. Tricaso – present. Also present were Dir. of Pub. Service Esler, Dir. of Finance Gilbride, Dir. of Law Raber, Economic Developer Weinberg and Clerk of Council Burton. Mrs. Ray was absent. Mayor Kline was on vacation. 4. MINUTES: 5-12-16 Regular Council meeting minutes. Mr. Rensel moved to approve the 5-12-16 Regular Council meeting minutes. Seconded Mrs. Kilway. Voice vote 6-0. The 5-12-16 Regular Council meeting minutes were approved by a vote of 6-0. FINANCIAL REPORTS: None. PUBLIC HEARINGS: None. 6. COMMUNITY INPUT: There is no one here for community input again this evening. 6.A. ANNOUNCEMENTS: None. 7. REPORTS OF SPECIAL COMMITTEES: None. 8. AGENDA ADDITIONS: None. 9. REPORTS OF ADMINISTRATIVE OFFICERS: MAYOR, DIR. OF PUBLIC SERVICE, DIRECTOR OF FINANCE, DIRECTOR OF LAW AND ECONOMIC DEVELOPER Dir. of Pub. Service: Yes, thank you. We had a bid opening for the paving program and Tallmadge Asphalt was the low bidder at $407,038.08. We also had a bid opening for pavement marking and that was J.D. Striping and they came in at $55,136.60. Liberta will be shutting off the water on North Avenue between the Circle and Overdale tonight from 9:00 p.m. to 6:00 a.m. to lower the waterline in a couple of places for storm sewer crossings. They will have that done by 6:00 a.m. Maca Pool will open this Saturday at 11:00 a.m. End of report. Dir. of Finance: No report this evening. Dir. of Law: This evening I would ask for adoption of Ord. 52-2016. This is housekeeping legislation for when we do our codified ordinances. Walter Drane Company prepares our codified ordinances and we will update various sections of the Code to be in compliance with changes in the Ohio Revised Code relating to traffic and criminal charges and so that is what that is. So I would ask for your consideration this evening. In addition, there is Ord. 53-2016 in front of you. I will just go ahead and kind of explain it now if you would like me to. This is an ordinance for Project C.O.O.L. This is the group that I think you have been hearing about now for several months. C.O.O.L stands for Community Outreach of Love. They are doing a restoration on Danner Road and Peck Road and this would allow us to waive the $30 fee for the permits. There are actually only . . . and we weren’t sure when we originally wrote the ordinance, but we have got confirmation now that there would only actually be two of those that we would have to have fee waivers. One is for a deck and one is for a fence. This is a street restoration and so quite a few of the churches in the area are participating that day and providing the volunteers and the manpower to do it. This request for the donation would actually be coming out of the Tallmadge Minor Home Repair Program and so there is money in this program. I have talked with Pat Sauner about it and he indicated that the City typically . . . this is also part of the fund that the demolition CDBG funds come out of, but we don’t need that money. This is money that we anticipated spending for this program and the approximate value of our contribution would be $2,350 for the items listed in the ordinance. Mr. Rensel: Yes. Thank you. Let me confirm; which fees are you talking about that we are going to waive? Dir. of Law: The Zoning Department fees for the permits for a deck and for a fence. Mr. Rensel: Those are fees we still collect? Dir. of Law: Correct. Mr. Rensel: Not the County? Dir. of Law: Correct. The Zoning Department has several different things that still come in front of it and almost all projects have to have some zoning approval and so those are $30 fees that would be waived. Mr. Rensel: OK. Thank you. Dir. of Law: The reason we are asking for 1st Reading adoption on this is because the project is on June 4th and so we would not be meeting again until after this. Pres. of Council: So that is the only thing that we are approving? There was $2,000 or something mentioned. Dir. of Law: That is the approximate value. We were . . . the issue with when we wrote the ordinance; when we drafted the ordinance, they were still working out what they needed for the various houses. They are doing, I believe, around 20 houses that will be impacted with landscaping and they are going to be doing some siding, doing some windows, doing some repairs of fences and decks and just really beautifying the exterior of the homes on those two streets. So, we weren’t 100% sure of what was needed until they have been working it out and finalizing plans all this week. Pres. of Council: Our part is the waiver.  REGULAR MEETING in Council Chambers @ 7:00 p.m. May 26, 16 Dir. of Law: The waiver fees and then donating that amount of money; like those other services that are listed in there. So for the Auxiliary Police will be doing the traffic control; we will have one person that will man the truck for brush removal; we are providing port-o-johns and mulch. The approximate value of those things pursuant to Pat Sauner’s e-mail is about $2,350. Pres. of Council: Are there any other questions? No one responded. Economic Developer: Thank you. You may have read in the paper last week that Midway Plaza has sold for $1.25 million to a real estate company in New York. As of today, I still have not been able to have a conversation with anybody there and so they are not being forthcoming with their plans, but they do have a pattern of buying under-performing commercial properties around the country and they have bought several in Ohio. The Plain Dealer just announced yesterday that the sale of Severance Town Center to the same real estate company out of New York for $10.5 million and in that article as well, they are not saying much about what their plans are and so I am going to continue to identify somebody who can actually give me some information, but I think I have a pretty good idea of what they are going to be doing. I don’t think we can expect anything big out of this and so we will just have to wait and see. End of report. Mr. Sisak: There was a rumor or fact, but I heard that Maplecrest had sold? Economic Developer: I had heard the same rumor. I know that there is an option on it and I know that there is a meeting, I don’t know if it is tomorrow, or maybe it has already taken place, but anyway, there is an option, but I don’t think it has actually sold yet. I haven’t had confirmation of that. Mr. Sisak: Yeah, I had heard it was Lemmon and Lemmon. Economic Developer: It is; yeah. Pres. of Council: Anyone else? No one responded. Moving on to Item 10 is Ord. 42-2016. 10. Ordinance 42-2016 At 3rd Reading. COMMUNITY ISSUES/SAFETY Authorizing the Mayor to enter into a Memorandum of Understanding with the Summit County Metro Parks and the City of Kent, Ohio for connectivity improvements to the Freedom Trail and Portage Hike and Bike Trail and providing for immediate enactment. Ms. Tricaso moved for the adoption of Ord. 42-2016. Seconded Mr. Sisak. Roll Call: Mrs. Kilway, Mr. Rensel, Mr. Sisak, Mr. Stalnaker, Ms. Tricaso, Mr. Donovan – unanimous. Ord. 42-2016 is adopted by a vote of 6-0. 11. Ordinance 44-2016 At 2nd Reading. PERSONNEL Establishing the number of employees by department and position pursuant to R.C. 731.08 and providing for immediate enact- ment. Pres. of Council: Ord. 44-2016 is at 2nd Reading and will remain before the Personnel Committee. 12. Ordinance 45-2016 At 2nd Reading. PLANNING & ZONING Amending Ordinance 63-2015 approving and granting a conditional zoning certificate to owner/applicant Plumbers and Pipefitters Local 219 for use as offices and educa- tional institution for Local Union 219 offices, union hall and apprentice training at 1655 Brittain Road. Pres. of Council: Ord. 45-2016 is at 2nd Reading and will remain before the Planning & Zoning Committee. 13. Ordinance 46-2016 At 2nd Reading. Hovnanian Woodridge LLC for develop- ment of a 65-unit single-family detached planned residential development east of Dunbar Road and south of Eastwood Avenue. PUBLIC SERVICE Authorizing the Mayor to enter into a new management agreement with the Ohio History Connection for the Tallmadge Church State Memorial and providing for immediate enactment.
