Members present upon roll call were: Carlson, Hurtak, Clendenin (remote), Henderson, Miranda, and Maniscalco, constituting a quorum. Councilmember Viera appeared remotely at 5:09 p.m. Martin Shelby, Council Attorney, was in attendance. The minutes were recorded and prepared by Suling Lucas, Deputy City Clerk, recording secretary for these proceedings. Motion: (Hurtak-Henderson) That Council moves to allow Councilmembers Clendenin and Viera to attend remotely. Motion carried unanimously with Viera being absent. Motion: (Hurtak-Carlson) That Council moves to deny said petition due to the failure of the applicant to meet its burden of proof to provide competent and substantial evidence that the development as condition and shown on the site plan is consistent with the comprehensive plan and city code, and the applicants failure to meet its burden of proof with the respect to the requested waivers. In addition, adopt all of the findings and all of the reasonings of the Planning Commission and City staff reports. Specifically, that it doesn’t’ work with Land Use Policies 9.2.2, 9.3.1, 9.3.8, 9.5.1, and 9.5.2 because approving single family attached uses on this site could adversely impact the character of the adjacent single family detached neighborhood to the west. And Land Use Policies 2.1.2 and SHG policy 1.3.4, the site has the potential to accommodate other housing types such as single family detached uses, single-family detached uses would more align closely with the character of the adjacent neighborhood to the west and can be considered within its current zoning of R-10. In addition, Environmental Policy 2.7.9, emphasizes the importance of conserving protecting and maintaining the city’s mature trees including those designated as Grand that possess preservation quality or historical significant. In addition, Section 27- 136(1), the proposed development does not take careful consideration of the adverse impacts to the on-site natural elements or the surrounding impacted neighborhood; further, subsection 5, the subject site has 101 jurisdictional trees in the applicant requested a waiver to reduce the required tree retention from 50 percent to 42 percent, the applicant also proposes to remove 7 non-hazardous Grand trees and requires 175 type 1 mitigation trees; and subsection 6, the immediate area is characterized by an established residential single family detached neighborhood that was plotted in 1925 a public park and vacant land. Additionally, the waivers are extensive, the request to remove 7 non-hazardous grand oak trees as shown and the request to reduce the required 50 percent tree retention to a wooded lot over one acre to 42 percent weighted tree retention and the other two waivers to request to allow front doors to face internal drive aisles. And to include waiver standards 27-139(4). Motion carried unanimously by voice roll call vote of 7-0. Once the City has possession of the property, the City could then work with USF, the History Center and the Jackson House Foundation to renovate and rebuild the structure; further, that the Jackson House Foundation to present their renovation plans”.
