Taylor Borough Regular Monthly Meeting November 9, 2022 The Taylor Borough Council held its regular monthly meeting on Wednesday, November 9, 2022, at 7:00 P.M. at the Taylor Municipal Building, 122 Union Street, Taylor, Pennsylvania. On Roll Call: Councilman Nezlo, Yes; Councilman Maldonato, Yes; Councilman McKeel, Yes; Councilman Tigue, Yes; Councilman Digwood, Yes; Councilman DeAngelo, Yes; President Mickavicz, Yes; Mayor Kavulich Loiselle, Yes. President Mickavicz chaired the meeting. Next, President Mickavicz asked the public if they had any comment or input regarding the agenda items. There were none. Next, President Mickavicz stated that everyone had the opportunity to read and review the October 12, 2022, Regular Meeting Minutes held at the Taylor Municipal Building at 122 Union Street, Taylor, PA. President Mickavicz asked if there were any corrections, additions, or deletions. None noted. A motion to approve by Councilman McKeel and seconded by Councilman DeAngelo. A voice vote was called and all Council Members were in favor. The motion passed. The meeting minutes were approved as presented. Next, President Mickavicz stated for the record that Council held an Executive Session on Monday, November 7, 2022, immediately following the 7:00 P.M. Work Session regarding personnel issues within the Police Department with the Solicitor. Next, President Mickavicz entertained a motion to approve a Memorandum of Understanding between the Taylor Borough and the Taylor Police Officer’s Association regarding the K-9 Cross Shift. A motion to accept was made by Councilman McKeel and seconded by Councilman Maldonato. A voice vote was called and all Council Members were in favor. The motion passed. Next, President Mickavicz entertained a motion to remove Officer Thomas Kerrigan from leave of absence effective November 1, 2022. A motion to accept was made by Councilman Maldonato and seconded by Councilman DeAngelo. A voice vote was called and all Council Members were in favor. The motion passed. Next, President Mickavicz entertained a motion to adopt the 2023 Tentative Budget. General Fund Operating Budget - $4,190,548.00; Capital Budget - $1,440,133.00; Liquid Fuels Budget - $209,525.00. Total Budget - $5,840,206.00. A motion to accept was made by Councilman Tigue and seconded by Councilman Digwood. A roll call was made – Councilman Nezlo, Yes; Councilman Maldonato, Yes; Councilman McKeel, Yes; Councilman Tigue, Yes; Councilman Digwood, Yes; Councilman DeAngelo, Yes; President Mickavicz, Yes. The 2023 Tentative Budget was adopted. Next, President Mickavicz entertained a motion to adopt Resolution # 18 of 2022, reducing Bond Number BX20895 in the original amount of $1,357,860.90 to $113,300.00 subject to the Council President negotiating and executing a 4 th Amendment of the Developers Agreement, upon terms acceptable to the Borough, subject however to the Solicitor and Borough Engineer’s concurrence with the intent of this action. It is understood the Borough is not releasing the obligations of Taylor 1, LLC from the completion of the improvements required under the Developers Agreement and Plans. The Chairman gave a brief overview. A motion to adopt Resolution # 18 was made by Councilman Tigue and seconded by Councilman DeAngelo. A roll call was made – Councilman Nezlo, Yes; Councilman Maldonato, Yes; Councilman McKeel, Yes; Councilman Tigue, Yes; Councilman Digwood, Yes; Councilman DeAngelo, Yes; President Mickavicz, Yes. The Resolution was adopted. Next, President Mickavicz entertained a motion to approve the submission for a Highway Occupancy Permit on behalf of Riverside School District and to authorize the execution of any documents by the appropriate Borough Officials, including a crosswalk agreement. A motion to approve was made by Councilman Digwood and seconded by Councilman McKeel. A voice vote was called and all Council Members were in favor. The motion passed. Next, President Mickavicz entertained a motion to issue a Purchase Order for the purchase of a 2023 Chevrolet Tahoe PPV Police Vehicle with a delivery date in January 2023, from Bonner Chevrolet in the amount of $47,078.00 and to authorize the appropriate Borough Officials to execute the lease documents – Costars #013-E22-215; 10-8 Emergency Vehicle Service for Equipment Upfit in the amount of $13,693.54 Costars #012-E22-259. For a total amount of $60,771.54. A motion to accept was made by Councilman Maldonato and seconded by Councilman DeAngelo. A voice vote was called and all Council Members were in favor. The motion passed. Next, President Mickavicz entertained a motion to accept or reject a bid submission to the Lackawanna County repository tax list property sale for PIN # 15501-020-00101 (124 Acres – Superfund Site), Bid amount $3,501.00 (Total Payment $3,662.77) and PIN #15501-020-017 (7.24 Acres – Railroad Line), Bid amount $2,801.00 (Total Payment $2,948.77). The Chairman gave a detailed overview. A motion to accept a bid submission was made by Councilman Tigue and seconded by Councilman McKeel. A voice vote was called, and all Council Members were in favor, the motion passed. Next, President Mickavicz entertained a motion to authorize a payment to the Redevelopment Authority of Lackawanna County in the amount of $13,188.61 for the 2021 Taylor 1, LLC TIF payment for Tax Map #16607-030-001. A motion was made by Councilman Tigue and seconded by Councilman Digwood. A voice vote was called, and all Council Members were in favor, the motion passed. Next, President Mickavicz entertained a motion to authorize the appropriate Borough Officials to execute a 1 year agreement Plan Maintenance Agreement with White’s Clock and Carillon Northeast, Inc. for maintenance of the Taylor Borough Clock located at the intersections of Davis Street and North Main Street. A motion was made by Councilman Tigue and seconded by Councilman McKeel. A voice vote was called, and all Council Members were in favor, the motion passed. Next, Councilman Tigue read the Approval of Bills for Payment for October 2022. Attached are the list of paid invoices and open invoices. Next, President Mickavicz entertained a motion to pay the October 2022 Payroll in the amount of $129,392.24. October General Fund Open Invoices in the amount of $78,627.88. October Paid Invoices in the amount of $149,714.93 and October Liquid Fuels Open Invoices in the amount of $12,348.17 - Total Expenditures $370,083.22 when funds are available. A motion was made by Councilman Tigue and seconded by Councilman Maldonato. A voice vote was called and all Council Members were in favor. During the month of October 2022, the Police Department responded to 496 incidents. There were 14 traffic crashes investigated; 68 traffic stops were conducted; 8 citations issued. Officers made 23 criminal arrests. (Arrest Report – Officer Kowanick – 1 arrest; Officer Boback – 2 arrests; Officer Zuby – 1 arrest; Officer Graham – 8 arrests; Officer Gianacopoulos – 2 arrests; Acting Sergeant Snyder – 3 arrests; Officer Moran – 3 arrests; Officer Palonis – 3 arrests. Revenues received for the month of October 2022: Police Reports $180.00, Parking Tickets $15.00, Magistrate Fines $5,387.94, Judicial Fines $701.40, Totaling $6,284.34 – K-9 Donations $1,1782.91. Next, President Mickavicz asked the Public if they had any comments or questions. Jeanie Sluck advised Council that their 3rd Annual Trunk or Treat was a huge success with over 800 children and over 1,500 people total. She also reminded Council that the 2nd Annual Miracle on Main Street is coming up on November 25th. Mayor Kavulich Loiselle read a letter from the Bangor School District Police Department commending Officer McDonald and K-9 Officer Biko for their professionalism and assistance conduction a K-9 sweep of the High School and Middle School. He extended his appreciation with all of their help. Mayor Kavulich Loiselle also stated that K-9 Biko will be graduating this Friday.
