order at 3 30 18 6 0m pand welcomed those in attendance City Recorder Cheryl Peacock Cottle conducted a Roll Call wherein all Council Members were present Taylorsville City Council Minutes December 14 2011 Page 3 1 Opening Ceremonies Pledge of Allegiance Council Member Pratt Council Member Johnson directed the Pledge of Allegiance 2 1 Reverence Council Member Pratt Opening Ceremonies For January 4 2012 to be arranged by Youth Council 37 Council Member Pratt offered the Reverence 18 1 3 Review Administrative Report Community Development Department Chairman Rechtenbach called for any questions on the Administrative Report and there were none 4 1 Council Resolution 19Chairman Rechtenbach invited outgoing Council Members Morris Pratt and Bud Catlin 42 18 to join him at the podium Proclamations were read and presented to outgoing City Council Members Bud Catlin and Morris Pratt On behalf of the City of Taylorsville Chairman Rechtenbach thanked Mr Catlin and Mr Pratt for their many years of service Plaques in recognition of their many contributions to the City were also presented 12Chairman Rechtenbach invited Council Members Pratt and Catlin to make remarks 45 18 Council Members Pratt and Catlin reflected on their years of public service and recognized those with whom they have served They each expressed pleasure at being able to serve as elected officials in the City of Taylorsville They thanked those in attendance for their support 25 Mayor Wall asked for a point of personal privilege He shared an m 48 18 e ail written by City Administrator John Inch Morgan who was not able to attend the meeting Mr Morgan expressed his appreciation for Mr Catlin and Mr Pratt Mayor Wall also recognized the outgoing Council Members and thanked them for their service 5 1 Citizen Comments 32Chairman Jerry Rechtenbach reviewed the Citizen Comment Procedures for the 52 18 audience He then called for any citizen comments 07There were no additional citizen comments and Chairman Rechtenbach closed the 54 18 citizen comment period Taylorsville City Council Minutes December 14 201 L Page 4 6 1 Mayor Report s 0Mayor Russ Wall reported that he has had opportunity to attend a number of open 18 houses over the last couple of weeks He relayed that he has held some positive conversations with developers and has received praise for the City of Taylorsville He recognized City Staff particularly Economic Development Donald Adams and Public Relations Consultant Aimee Newton for their contributions 2 APPOINTMENTS 1 2 Dave Ballou Ordinance Review Committee Chairman Rechtenbach 16Chairman Rechtenbach nominated Dave Ballou to serve on the Ordinance Review 54 18 Committee 54Council Member Larry Johnson MOVED to approve the appointment of Dave Ballou 18 to the Ordinance Review Committee Council Member Moms Pratt SECONDED the motion Chairman Rechtenbach called for discussion on the motion There being none he called for a vote The vote was as follows Pratt yes Catlin yes Barbouryes yes Rechtenbach and Johnson All City Council members voted in favor and the motion passed unanimously yes 2 VAWA and VOCA Grants Report Chief Craig Detective Mike Ikemiyashiro and Tessa Kohl 5 18 3 0Chief Del Craig recognized Detective Mike Ikemiyashiro and Victim Advocate Tessa Kohl from the Taylorsville Police Department 25Dectective Ikemiyashiro reported on services provided by the VAWA and VOCA 18 58 Grants He also referenced statistics on the programs as contained in the Council Packets provided 00Ms Kohl relayed that both she and Detective Ikemiyashiro were the recipients of 19 awards this year for their accomplishments through victim advocacy in the City 3 REPORTS 1 3 Quarterly Report Taylorsville Police Department Chief Craig 49Police Chief Craig noted that the City has already been awarded the VAWA and 00 19 VOCA grants for the upcoming year He commended Detective Ikemiyashiro and Victim Taylorsville City Council Minutes December 14 2011 Page 5 Advocate Tessa Kohl for their efforts He reported on recent activities in the Taylorsville Police Department He said that major crimes have decreased overall within the City 52The Chief cited recent successes in capturing burglars He relayed that the ATM 01 19 Bandit Robbery has been solved and the arrested individual was responsible for about 23 crimes in the azea He relayed that violent crimes are down and calls for service are trending pretty even with last year 30Chief Craig reported on traffic issues and noted that the top locations for incidents were 02 19 at 5400 South Redwood and 5400 South Bangerter He made a clarification on the number of accidents actually occurring and noted that there were 27 accidents during the previous quarter at 5400 South Bangerter Highway and 27 accidents at 5400 South Redwood Road The Chief related He said that accidents at 6200 South relayed that most accidents are congestion Redwood have been fewer recently He cited a recent hit and run fatality and noted that the driver in that incident has now come forwazd 13Chief Craig called for questions from the Council 04 19 23Council Member Johnson asked about accidents at 2700 West 5400 South Chief Craig 04 19 cited 18 accidents at that location Mr Johnson inquired whether the signal light at that intersection might be delayed Chief Craig and City Engineer John Taylor agreed to follow up with some possible changes to the signal 41 Council Member Barbour asked about the Continuous Flow Intersection CFI at 5400 05 19 South Bangerter Economic Development Director Donald Adams confirmed that the project was completed about 2 z months ago It was noted that the next report should reflect any improvements at that intersection 26Council Member Barbour inquired about the 5400 South Redwood Road intersection 06 19 She relayed that she has observed vehicles making illegal toms there 23Chief Craig acknowledged that the intersection at 5400 South Redwood can be 07 19 confusing and said there is a learning curve associated with navigating the new CFI intersections 53Council Member Catlin observed that traffic enforcement is down and said he never 07 19 seesenforcement at intersections Chief Craig addressed Mr sCatlin concerns and said that 6200 South Bangerter constmction has contributed to problems at 5400 South Bangerter 25 Council Member Catlin cited the frequency of traffic accidents at intersections and 09 19 asked how much emphasis is being placed on enforcement Chief Craig indicated that enforcement at intersections is a high priority and is regularly emphasized with officers on a Taylorsville City Council Minutes December 14 2011 Page 6 weekly basis He clarified that the new officers hired are finishing up training with a Field Training Officer and should begin regularly duty in February 51 Chairman Rechtenbach asked about including trends on accident histories in future 10 19 reports for traffic accidents at the new intersections Chief Craig agreed to include such 20Chief Craig provided details on recent traffic accidents 12 19 36Council Member Barbour inquired about two boys that were recently hit on bicycles 19 12 Chief Craig gave clarification that only one boy was actually injured 4 CONSENT AGENDA 1 4 Minutes RCCM 11 16 31 Council Member Morris Pratt MOVED to adopt the Consent Agenda Council 13 19 Member members yes Barbour yes Catlin yes Rechtenbach Johnson voted in favor and the motion passed unanimously 5 PLANNING MATTERS There were no planning matters 6 FINANCIAL MATTERS 1 6 37Accepting a Grant from the Utah Department of Resolution No II Health Division of Disease Control and Prevention in the Amount of 00John Inch Morgan 500 02 14 19 In the absence of City Administrator John Inch Morgan Chief of Finance Scott Harrington presented the subject resolution to accept a grant from the Utah Departrnent of Health He noted that the grant may be used in any way desired but plans are in place to use it fox Healthy Taylorsville programs 19 0 x 4 Mayor Wall noted that this grant is a result of the work of the Healthy Taylorsville Volunteer Committee Taylorsville City Council Minutes December 14 2011 Page 7 31 Council Member Bud Catlin recognized the efforts of the volunteers serving on the 15 19 Healthy Taylorsville Committee He noted that they are primarily individuals working in medical fields 06Council Member Bud Catlin MOVED to adopt Resolution No 11 16 19 37 Accepting a Grant from the Utah Department of Health Division of Disease Control and Prevention in the 00 Council Member Morris Pratt SECONDED the motion Amount of 500 Chairman Rechtenbach called for discussion on the motion There being none he called for a roll call vote The vote was as follows yes Catlin Pratt yes Barbour yes and Johnson yes Rechtenbach yes All City Council members voted in favor and the motion passed unanimously OTHER MATTERS 7 1 Discussion Regarding Ordinance No 11 09 Prohibiting Smoking On or In Owned Parks Trails and Recreation Facilities John Brems City City Attorney Mitch Haycock Ordinance Review Committee Council Member Ordinance Review Committee Advisor Larry Johnson 37 City Attorney John Brems presented the subject ordinance regarding smoking in public 16 19 places He noted that it was previously brought before the Council but has since been fine tuned by the Ordinance Review Committee ORC and himself Mr Brems noted that all previous suggestions from the City Council were incorporated and the ORC is now recommending that the proposed ordinance be adopted 00Council Member Johnson cited his participation in discussions with the ORC on this 17 19 ordinance and relayed that he supports it as now amended 13Council Member Pratt relayed that the part of the ordinance he was previously 18 19 concerned with has been removed and he now believes it is a good ordinance Council Member Barbour agreed 47Chairman Rechtenbach asked about the potential to enforce the ordinance Mr Brems 18 19 noted that this ordinance gives officers authority to write tickets to offenders 25Mitch Haycock of the Ordinance Review Committee relayed some issues the 19 Committee had related to enforcement He suggested that the City post signs in all parks 11 Mayor Wall commented on problems experienced with smoking at the Taylorsville 21 19 Dayzz event the Veterans Day event etc Taylorsville City Council Minutes December 14 2011 Page 8 22Council Member Catlin called the ordinance a feel good ordinance and said it is 19 difficult to enforce He suggested that officers will not want to go to court on a smoking ticket no requests if asked and said an He observed that most people will accommodate smoking ordinance is not necessary 04Mayor Wall affirmed that signs will be posted in all City parks He relayed that there is 23 19 an ADA requirement at the Bass Fishing Pond and described reasons it is appropriate to have an ordinance that can be enforced 12Mr Haycock explained that the ORC initially didn 24 19 t believe the ordinance was enforceable but the LARP Committee and Healthy Taylorsville Committee have asked that it be pursued 04Mr Catlin asked about the ability to make rules rather than ordinances 1925 Mr Brems clarified that rules at the Dog Park were incorporated by ordinance 59Council Member Catlin further detailed his reasons for not believing an ordinance is 25 19 needed to monitor smoking 09Mayor Wall observed that rules are difficult to enforce if not backed by ordinance 27 19 20The Council agreed to bring the ordinance back for consideration at the first meeting in 19 29 January No additions or corrections were recommended 2 7 Discussion of the Proposed Land Development Code Chapters 32 33 and 34 Mark McGrath 09Community Development Director Mark McGrath called for discussion on Chapters 32 30 19 Site Plan Review Chapter 33 Administrative and Administrative Non Conditional Use Permit and Chapter 34 Appeals and Variances 29Council Member Pratt raised a question regarding verbiage on page six and Chairman 30 19 Rechtenbach gave clarification 11 Council Member Johnson inquired whether any additional studies required are 31 19 Mr McGrath confirmed that the applicant would be liable provided by the builder or developer 14Chapter 33 regarding Administrative Conditional Use was addressed 32 19 32Mr McGrath confirmed that the Conditional Use Permit goes with the land rather than 33 19 the applicant Clarification was given on the expiration of permits Taybrsville City Council Minutes December 14 2011 Page 9 20Chapter 34 regazding Appeals and Variances was discussed It was noted that this is 35 19 an area where State code has been altered in the last few years Mr McGrath gave explanation onthe requirement for an Appeal Authority and the standazds for review and approval He confirmed that variances also run with the land 8 NEW ITEMS FOR SUBSEQUENT CONSIDERATION No Action There were no new
