7:00 P.M.
1.0 Call to Order
The Council meeting was called to order by Mayor Gretchen Fagan. Other members present
were:

5.0 Presentations:
● Shawn Cox presented a check in the amount of $2,515.06 to the Tomball Rotary
Club and Tomball High School Student Council for the “Showers for Shane”
Project.
6.0 Reports and Announcements:
● February 22, 2011 – Trail Ride Reception – 12:00 p.m. at the Depot
● February 24, 2011 - Reception honoring Betty Reinbeck, Executive Director-
TEDC, at the Chamber of Commerce, 2:00-4:00 p.m.
● February 28, 2011 – Special Meeting of the Tourism Advisory Committee, 6:00 p.m.
● March 12, 2011 – 2nd Saturday at the Depot – Oilfield Helping Hands Car Show and
Motorcycle Rally
● March 14, 2011 – Last Day to Apply for Place on Ballot for May 14, 2011 General
City Election
● April 9, 2011 – 3rd Annual City of Tomball Bunny Run 5K and Kids 1 Mile
● April 18-23, 2011 – City of Tomball Spring Clean Up Week – 8:00 a.m. to 4:30 p.m.
● Walk Tomball! (every Saturday at 9:00 a.m. at the Depot)
● Reports by City staff and members of council about items of community interest on which
no action will be taken
○ Glenn Windsor presented the Quarterly Investment Report (ending 12/31/2010).
○ Glenn Windsor presented a summary of the vehicles being purchased through Buy
Board Contracts.
○ Shawn Cox presented a slideshow of the Beckendorf Statue unveiling.
7.0 Motion was made by Councilman Townsend, second by Councilman Brown, to approve the
minutes of the following meetings:

Motion carried unanimously.
8.0 Old Business:
8.1 Doris Speer presented an overview of the proposed Ordinance. Motion was made by
Councilman Brown, second by Councilman Townsend, to adopt, on Second Reading,
Ordinance No. 2010-26, an Ordinance of the City of Tomball, Texas, adding Chapter 15,
“Commercial Filming” to the Code of Ordinances of the City of Tomball, to Require a
Permit for Commercial Filming in the City of Tomball, to Establish Policies, Procedures
and Regulations as They Relate to Filming; Providing a Penalty in an Amount of Not
More Than $500 for Violation of any Provision Hereof; Providing for Savings and
Severability; Providing for Publication; and Making other Provisions and Findings
related Thereto. Vote was as follows:

Motion carried unanimously.
8.2 Lori Lakatos presented an overview of the proposed parking lot locations. Motion was
made by Councilman Townsend, second by Councilman Brown, to Designate Downtown
Parking Lot Locations AN and ES and to Direct the Engineering and Planning Department
to Negotiate and Prepare Professional Services Contract and to get prices for CS and DN
location as well.
Motion carried unanimously.
9.0 New Business
9.1 Mayor Fagan presented information regarding the resignation of LaMar Barr. Motion was
made by Councilman Stoll, second by Councilman Quinn, to accept the resignation of
LaMar Barr and appoint Prakash Patel to the Unexpired Term on the Tourism Advisory
Committee (Hotel Industry Position 8). Motion was made by Councilman Quinn, second
by Councilman Townsend, to table consideration of an appointment to the Unexpired Term
on the Tourism Advisory Committee (Hotel Industry Position 8) until city staff provides
information regarding current payment status of hotel occupancy taxes by Tomball hotels.
Motion to table carried unanimously.
9.2 Shawn Cox presented an overview of the proposed Grant. Motion was made by
Councilman Brown, second by Councilman Quinn to Approve the Grant Application by

Tomball Sister City Organization for Hotel Occupancy Tax Funds in the amount of
$30,000. As recommended by the Tomball Tourism Advisory Committee and, if TSCO
meets the budget requirements for the additional funds, $20,000 would be funded from
the grant funds budgeted for the Sister City organization and the additional $10,000
would be funded from the grants line item under the hotel occupancy tax fund. Vote was
as follows:

Motion carried, 4 votes Aye, 1 vote Nay.
9.3 Mayor Fagan presented an overview of the proposed appointments. Motion was made by
Councilman Townsend, second by Councilman Quinn, to appoint the members
recommended by Mayor Fagan and to appoint Mitchell Holderrieth as well, to serve on
the Downtown Tomball Advisory Committee (DTAC).
Motion carried unanimously.
9.4 Kelly Violette presented an overview of the proposed Policy. Motion was made by
Councilman Townsend, second by Councilman Dodson, to approve Administrative
Policy Number 65, Entitled “Right-of-Way Abandonment Policy”.
Motion carried unanimously.
9.5 Lori Lakatos presented an overview of the proposed Replat. Motion was made by
Councilman Dodson, second by Councilman Townsend, to approve the PARTIAL
REPLAT OF TOMBALL MARKETPLACE: A 28.5984 acre (1,245,748 Square Foot)
subdivision; Being lots 2, 3 & 4, Tomball Marketplace, as recorded in Film Code
Number 605157, of the Harris County Map Records out of the John M. Hooper Survey,
Abstract 375 Tomball, Harris County, Texas.
Motion carried unanimously.
9.6 Shawn Cox presented an overview of the proposed partnership with Tomball High
School for their March of Dimes fundraising event. Motion was made by Councilman
Brown, second by Councilman Townsend, to approve City of Tomball’s partnership with
the Tomball High School and Student Council for the March of Dimes Walk.

9.7 Glenn Windsor and Nathan Krupke with Belt, Harris, Pechacek presented an overview of
the Comprehensive Annual Financial Report (CAFR). Motion was made by Councilman
Brown, second by Councilman Dodson, to accept the Comprehensive Annual Financial
Report (CAFR) for the Fiscal Year ended September 30, 2010. Motion was made by
Councilman Townsend, second by Councilman Quinn to table acceptance of the CAFR
until the March 7, 2011 meeting.
Motion to table carried unanimously.
10.0 Motion was made by Councilman Townsend, second by Councilman Dodson, to adjourn.
Motion carried unanimously.
