MINUTES OF SPECIAL CITY COUNCIL MEETING CITY OF TOMBALL, TEXAS TUESDAY, JULY 26, 2011 4:00 P.M. 1.0 Call to Order The Council meeting was called to order by Mayor Gretchen Fagan. Other members present were: Councilman Hudgens Councilman Stoll Councilman Brown Councilman Townsend Councilman Dodson Others present: City Manager – George Shackelford Assistant City Manager – Christal Weber City Secretary – Doris Speer Finance Director – Glenn Windsor Director of Public Works – David Kauffman Fire Chief – Randy Parr Assistant City Engineer – Lori Lakatos Police Chief – Robert Hauck HR Director – Lisa Coe Budget Analyst/Project Accountant – Craig Price Executive Director-TEDC – Kelly Violette 2.0 The following public comments were received. Jim and Linda Wrentz - Asked that their request for Zion Road to be included 31203 Antonia Lane, 77375 in the “No Through Trucks” designation be read into the record. 3.0 Workshop Session: 3.1 Motion was made by Councilman Stoll, second by Councilman Dodson, to adopt on Second Reading, Ordinance No. 2011-11, an Ordinance of the City of Tomball, Texas, Amending its Comprehensive Zoning Ordinance by changing the Zoning District classification of approximately 3.86 acres of land, legally described as Lot 1, Block 1, Eagle Gasket and Packing Company Subdivision Number 1 Replat, Within the City of Minutes Special City Council Meeting July 26, 2011 Page 2 of 3 Tomball, Harris County, Texas, from the SF-20-E Single-Family Estate Residential-20 District to the LI-Light Industrial District; said property being generally located on the Easterly side of Ulrich Road, Northerly of Hufsmith Road at 1110 Ulrich Road, Tomball, Texas; providing for the Amendment of the Official Zoning Map of the City; providing for severability; providing for a penalty of an amount not to exceed $2,000 for each day of violation of any provision hereof, making findings of fact; and providing for other related matters. Vote was as follows: Councilman Stoll Aye Councilman Brown Aye Councilman Townsend Aye Councilman Dodson Aye Councilman Hudgens Nay Motion carried, 4 votes Aye, 1 vote Nay. 3.2 Motion was made by Councilman Brown, second by Councilman Dodson, to adopt, on Second Reading, Ordinance No. 2011-14, an Ordinance of the City Council of the City of Tomball, Texas, Amending Section 60-11, Changeable Electronic Variable Message Signs (CEVMS), of Chapter 60, Signs, of the City's Code of Ordinances relating to Changeable Electronic Variable Message Signs to Allow CEVMS as On-Premise Signs on Properties Located Adjacent to All County and State Rights-of-Way; Providing Regulations for Such CEVMS; Providing a Penalty of up to $2,000.00 for Violations with Each Day Constituting a Separate Violation; Providing for the Publication of This Ordinance; and Making Other Findings and Provisions related Thereto. Vote was as follows: Councilman Brown Aye Councilman Townsend Nay Councilman Dodson Aye Councilman Hudgens Aye Councilman Stoll Aye Motion carried, 4 votes Aye, 1 vote Nay. 3.3 Motion was made by councilman Townsend, second by Councilman Dodson, to adopt, on Second Reading, Ordinance No. 2011-16, an Ordinance amending Chapter 78, Traffic and Vehicles, Article III, Operation of Vehicles Generally, of the Code of Ordinances of the City Council of the City of Tomball, Texas, by adding a New Section 78-74, Through Truck Traffic Prohibited; Establishing Regulations related to Truck Traffic on Public Streets Designated as No Through Truck Street; Providing a Penalty in an Amount Not to Exceed $200 for Each Violation Hereof; and Providing for Severability; and Making other Provisions and Findings related Thereto. Vote was as follows: Councilman Brown Aye Minutes Special City Council Meeting July 26, 2011 Page 3 of 3 Councilman Townsend Aye Councilman Dodson Aye Councilman Hudgens Aye Councilman Stoll Aye Motion carried unanimously. 3.4 The Tomball City Council entered into a Workshop Session regarding the Fiscal Year 2011-2012 Budget. George Shackelford and City staff provided information regarding the major items proposed in the 2011-2012 budget. Majority consensus of Council was to proceed with M121 West and Medical Complex during Fiscal Year 2011-2012 and issue certificates of obligation versus holding a bond election. 4.0 Motion was made by Councilman Stoll, second by Councilman Townsend, for adjournment. Notice is hereby given of a Special meeting of the Tomball City Council, to be held on Tuesday, July 26, 2011 at 4:00 p.m., City Hall, 401 Market Street, Tomball, Texas 77375, for the purpose of considering the following agenda items. All agenda items are subject to action.
