PUBLIC COMMENTS: To comment on a topic not scheduled for a Public Hearing, please fill out a Speaker Form and return it to the Clerk of Council BEFORE the start of the meeting. When called upon, proceed to the microphone, state your name and address, and proceed with your comments. You will have three (3) minutes to speak. Ms. Estella Crews of 4434 Redonda Lane expressed concerns regarding certain neighborhoods. She asked what more can be done regarding the upkeep of business and residential properties. She reported that she sees auto repairs shops in the streets, car dealerships from homes, tall grass, tire debris, trash cans left out, and burning trash. Ms. Crews also reported that she frequently sees vehicles parked in fire lanes and that currently she is dealing with a duck and chicken problem. She shared that neighbors have called the police and stated that she does not know the ordinance for having fowl in a neighborhood, but that the ducks and chicken are running amuck and leaving their droppings, which creates a medical hazard for her. Mayor Page thanked Ms. Crews for bringing these issues to Council and asked City Manager to have Code Enforcement Supervisor Max Fuller speak with Ms. Crews to address her concerns. Ms. JoAnne Orihood of 14 Oak Street stated that there is a situation on West Worley, about a block from the end of the street. She explained there is a vacant lot that she believes is owned by the City and children who live across the street are riding their electric and gas bikes around a track they made on the property. She stated that there are 2 - 4 bikes riding around the track on a regular basis, and sometimes others with bigger bikes join them. Ms. Orihood asked what could be done about this as she feels this is not the right place for such activity. She added that the neighbors living nearby are frustrated because it is very disturbing, particularly to the elderly people and people who work at night. Mayor Page stated that staff will work with Code Enforcement to address the matter. Ms. Vickie Nelson of 202 East Main Street shared that she is a lifelong resident of Trotwood and that she is a truck driver who has parked her truck at Devers, with their permission, for over 25 years. She made Council aware that the truck drivers they see are members of the community; no one is coming off of Interstate 70 to park in Trotwood. She shared that the average pay for a truck driver is $67,000 per year and further, they are not a strain on City resources because they are not home but only for short periods of time to see their family. Now, she has no place to park her truck. Ms. Nelson said zoning told her to develop a parking lot; however, she believes there are empty parking lots in Trotwood and doesn't see the need to develop another lot. She shared that she has heard road conditions is a big concerns. Ms. Nelson stated that City buses are heavier than a semi with an empty trailer. She added that she agrees trucks should not be parking in residential areas, but that is not what she is asking. She is simply asking to park at a business who has given her permission to do so. She stated that she has been told all the other communities don't allow it, but she believes Trotwood is special and has something other communities do not have. Ms. Nelson shared that currently, her truck is parked 100 miles away so she will spend over four hours picking up her truck, which is time lost with her family. She explained that she has looked around for places the City might consider for truck parking and believes the junior high, which has a huge parking lot, would be an ideal place that would City of Trotwood Page 3 City Council Meeting Minutes - Final June 3, 2024 be out of the way and able to withstand the weight of a truck; she just needs a nearby place to park her truck. Mayor Page first thanked Ms. Nelson for being a Trotwood resident, then stated that she would discuss the issue with the City Manager and someone would get back to her. Ms. Nelson reminded Mayor Page that when she talked to zoning their solution was for her to develop a parking lot for trucks, which she doesn't understand since there are many lots already available. Clerk Landis stated that Melanie White registered to speak about wifi service and lot splits. Mr. Larry White announced from the audience that Melanie White was unable to attend the meeting. IX. Special Presentations and Recognitions PR20-24 Dayton Metro Library, Trotwood Branch Update Presented by Yoonmee Hampson, Branch Manager Branch Manager Yoonmee Hampson shared information about the library's summer programs. PR21-24 Community Movie Night Charles Wheeler, Marketing Coordinator Parks and Recreation Department Attachments: PR21-24 Attachment Marketing Coordinator Charles Wheeler invited residents to the upcoming Community Movie Night and shared the movie will be Kung Fu Panda 4. PR22-24 Online Park Shelter Reservations Charles Wheeler, Marketing Coordinator Parks and Recreation Department Marketing Coordinator Charles Wheeler demonstrated how to use the online portal to reserve a park shelter. Ordinances OR07-24 AN ORDINANCE BY THE TROTWOOD CITY COUNCIL REPEALING CURRENT SECTION 927.10 “CHARGES AND COLLECTION; DELINQUENT BILLS” OF THE TROTWOOD CODES OF ORDINANCES, AND ENACTING NEW SECTION 927.10 “CHARGES AND COLLECTION; DELINQUENT BILLS; DISCOUNT” TO PROVIDE A DISCOUNT FOR REFUSE COLLECTION TO CERTAIN RESIDENTS. Attachments: OR07-24 OR07-24 Exhibit A City Manager Pope explained that in an effort to mitigate inflation, this Resolution will allow the City to offer a 20% discount on refuse to those who qualify for and participate in the homestead exemption program. Council Member Vaughn asked City Manager Pope if there had been any studies as to the overall impact on the community as far as general revenue lost and the cost to be carried by other taxpayers. City Manager Pope shared that if 15% of the City's current accounts qualified and participated in the homestead exemption program, the lost revenue would be approximately $47,150 in 2025 and $50,686 in 2026. Council Member Vaughn asked if City Manager Pope felt this discount would decrease the delinquent accounts, and that monies the City won't collect due to the discount wouldn't have been received anyway. City Manager Pope shared that he has received many complaints from residents on a fixed income who can't pay there bill so he believes this discount help residents. Mayor Page requested a Motion to adopt Ordinance No. OR07-24. A Motion was made by Council Member Vaughn, seconded by Vice Mayor Brown, and the Motion CARRIED by the following vote: City of Trotwood Page 7 City Council Meeting Minutes - Final June 3, 2024 Aye: 6- Council Member Gales, Council Member Moore, Council Member Clark, Council Member Vaughn, Vice Mayor Brown and Mayor Page Excused: 1- Council Member Finley City of Trotwood Page 8 City Council Meeting Minutes - Final June 3, 2024 OR08-24 AN ORDINANCE BY THE TROTWOOD CITY COUNCIL REPEALING CHAPTER 151 “EMPLOYMENT PROVISIONS” OF THE TROTWOOD CODES OF ORDINANCES AND ENACTING NEW CHAPTER 151 “EMPLOYMENT PROVISIONS,” AND DECLARING AN EMERGENCY. Attachments: OR08-24 OR08-24 Exhibit A Deputy City Manager Kellum explained that one of the revisions to Chapter 151 is simply a housekeeping measure as Council previously voted to include Juneteenth as a paid holiday for employees; therefore, the holiday needed to be added to the policy. Deputy City Manager Kellum discussed a revision to help curtail the abuse of the policy regarding holiday pay. She explained that currently if a person uses sick time the day before a holiday, the policy allows them to receive holiday pay before returning to work the day afterwards. She added that the idea behind benefits is to reward employees for good behavior, not for poor performance or attendance. She recommends adding a provision that employees must work the day before and the day after a holiday in order to receive the benefit and that this is also the generally accepted practice. Another revision explained by Deputy City Manager Kellum is the need to revise vacation time for employees in their first year of service. She explained that currently such employees only earn 40 hours of vacation time. However, in accordance with the Ohio Revised Code, employees with 1 - 4 years of service should earn 80 hours of vacation time. She added that this revision will help with retention and recruitment, and bring the City into line with state law. Deputy City Manager Kellum then discussed injury leave, which is a benefit that is easily abused. She explained that the current policy allows a person who is off with a work-related injury to receive up to 90 days of paid time off without using their accrued sick time, vacation time, and/or personal time. She pointed out that this is the same amount of time allowed under the Family Medical Leave Act (FMLA) and that the policy also includes part-time employees. She pointed out that if the employee does not feel they are able to return to work after 90 days of paid time off, they can then use their earned sick time, vacation time, and/or personal time. Deputy City Manager Kellum stated that this policy could be easily abused. She explained that the purpose of worker's compensation is to rehabilitate an injured employee and get them back to work as quickly as possible, even if in a restricted capacity. Therefore, she is proposing to limit the number of days of paid time off for a work-related injury to 45 calendar days for full-time employees and 30 calendar days for part-time employees and that the Human Resources Department (HR) be responsible for certifying an injury, at their discretion. She added that currently there are no requirements that claims be certified. Deputy City Manager stated that the last recommendation applies to departments with a small staff, or those with only one employee. She explained that there are times when the needs and demands of the job do not allow the employee to take their earned time off so it is being proposed that select management have the option to cash in one week of vacation time. She added that this will also limit the liability when those employees retire. City of Trotwood Page 9 City Council Meeting Minutes - Final June 3, 2024 Council Member Moore asked Deputy City Manger Kellum if employee injuries have been an issue. Deputy City Manager Kellum explained that currently there are a couple of issues that had HR staff not have been aggressive in addressing the City's legal rights, they could have been more serious, then added that she feels this type of behavior can be cancerous. Council Member Moore asked about the certification being at the discretion of HR. Deputy City Manager Kellum explained that HR staff will evaluate each case as to the likeliness that the injury is a result of work-related activity, not due to horseplay; they will talk with supervisors and witnesses, and work with the managed care organization and third-party administrator to make the determination. Council Member Moore asked if there are any exceptions to the number of days granted based on the department or occupation. Deputy City Manager Kellum stated that the benefit is based on the type of injury and that most claims are certified. She reminded Council Member Moore that she wants to be proactive and that this is simply a safeguard for some trending situations. Deputy City Manager Kellum added that each case will be reviewed exercising due diligence. Council Member Moore shared that she doesn't like to see punitive measures taken when only a few are the cause of the problem. Deputy City Manager Kellum explained that the policy already contains a provision that the City Manager has the authority to extend the leave, if necessary. Council Member Vaughn asked if these revisions are consistent with other cities of similar size. Deputy City Manager Kellum answered yes and added that in addition to the department's research, they work with our HR departments. Council Member Vaughn then asked if, with the exception of the City Manager's discretion, employees have other avenues if they disagree. Deputy City Manager Kellum advised that employees can appeal a decision through the worker's compensation system. Council Member Vaughn asked if the Civil Service Commission is involved. Deputy City Manager Kellum said they are not involved in work-related injuries. Council Member Vaughn then asked if an employee still accrues sick time and vacation time when they are off for a work-related injury. Deputy City Manager Kellum explained that employees still accrue such benefits during their absence due to certain legal protections. Council Member Vaughn asked Deputy City Manager Kellum if she has reached out to the unions. Deputy City Manager Kellum replied that she had not. Council Member Vaughn commented that he expects it will be brought up during the next round of negations. Mayor Page requested a Motion to adopt Ordinance No. OR08-24 as an emergency. OR37-23 TO ADD A PART-TIME, NON-UNION POSITION, AND DECLARING AN EMERGENCY. Attachments: OR09-24 OR09-24 Exhibit A Deputy City Manager Kellum announced that the EMT collaboration between Trotwood-Madison High School and the City's newly implemented Explorer Program has two students that have completed and passed the EMT course and they are ready to take the state certification test. She reminded Council that offering this course to high school students is an innovative and proactive way to "grow our own" first responders. She explained that the first step is to add the EMT-B position so that once these students pass the state test, the City can hire them. Council Member Vaughn asked about the vetting of these applications and what steps are required to ensure they are qualified applicants. Deputy City Manager Kellum explained that a background check, driving record check, fitness for duty evaluation, and drug testing are always performed to determine the applicants suitability; she added that psychology exams are only ordered for certain full-time positions. Council Member Vaughn then asked if this is an EMT course or EMT and Fire course. Deputy City Manager Kellum stated that this course is only for EMT. Deputy Chief McInturff confirmed that the course is the same nationally-accredited course taught at Sinclair College; same requirements, same standards, same test, it is simply taught in a remote location. Mayor Page shared that she is excited about this program and appreciates the work that has been done to establish the partnership. After the vote, Clerk Landis added for the record, this ordinance and the previous ordinance, OR08-24, are being adopted as emergencies in order for the provisions to go into effect immediately rather than at the expiration of 30 days per the Charter, and that all other requirements to notice a public hearing were completed. Resolutions R24-46 A RESOLUTION BY THE TROTWOOD CITY COUNCIL EXTENDING THE MORATORIUM UP THROUGH AND INCLUDING DECEMBER 31, 2024, ON THE ACCEPTANCE OF APPLICATIONS FOR, AND THE ISSUANCE AND PROCESSING OF, NEW PERMITS FOR THE BUILDING, DEVELOPMENT, EXPANSION, OR IMPROVEMENTS (MAINTENANCE EXCEPTED) OF THREE-FOUR FAMILY DWELLINGS AND MULTI-FAMILY DWELLINGS IN THE CITY OF TROTWOOD. Attachments: R24-46 City Manager Pope explained that this Resolution will extend the moratorium on multi-family housing to December 31, 2024 so that the City can work to update the land use policy. Council Member Moore asked City Manager Pope to explain the pros and cons of the moratorium. City Manager Pope explained the purpose of a moratorium and in this instance, how it provides the City time to review the land use policy in order to determine how to move forward as a community. He added that the con is that developers cannot pursue multi-family housing until the moratorium expires. Council Member Moore asked when the current moratorium expires and asked for confirmation that his is simply an extension. City Manager Pope confirmed that this is an extension and that the current moratorium expires July 31, 2024. Mayor Page requested a Motion to approve Resolution No. R24-46. Old and New Business XVI. Comments A. Clerk of Council There were no announcements. City of Trotwood Page 13 City Council Meeting Minutes - Final June 3, 2024 B. Council Members: Each Council Member will have three (3) minutes to speak about topics relating to the City of Trotwood that are not on the Meeting Agenda. Council Member Gales thanked the Trotwood Fire Department for installing smoke detectors in her home. She explained that the department came out and assessed her house, then installed several detectors and gave her a folder includes information on how to escape. She recommended that all residents take advantage of this service. Vice Mayor Brown agreed with Council Member Gales and added that she recently learned detectors are needed in each bedroom. She then reminded everyone that it is June and a great time to engage with your neighbors. Vice Mayor Brown mentioned the first concert of the summer series is scheduled for June 29 and she is aware that several neighborhood watch groups are starting to meet. She shared how important it is to attend such meetings in order to know what is going on in your neighborhood and that it provides a way to get to know your neighbors. Council Member Vaughn stated that he hopes everyone keeps in mind what is going on politically, regardless of who you support, remember that we all have to be thankful for the sacrifice of so many that have preserved our rights. He added that we all owe to one another as citizens, to look out for each other and give thanks to those that provide and make sacrifices every day. He shard that believes we all deserve to be free and that people paid the price for us to do so. C. City Manager City Manager Pope shared information from the recent news article about the increase in home values in the City of Trotwood. In addition, he addressed Ms.Crews and reminded her that he has teams out cutting grass, but to be patient because the grass is growing at an incredible pace due to the weather. He acknowledged that he is aware of the significant amount of people working on cars in her area and that some have received legal notices and others have even gone to court. City Manager Pope advised Ms. Orihood that he would talk with her about her concern, which he believes can be resolved by working together. Mayor Mayor Page made everyone aware that this is Older American Month and that they had an outstanding turnout of the senior population at the library where they discussed various resources. She reminded residents that they have a right to come to Council and ask questions and voice concerns. Mayor Page expressed her appreciation for those who come to meetings. Mayor Page reminded everyone to come out and enjoy the Community Movie Night and the upcoming summer concert series. She reiterated that the City sponsors these events in hopes of bringing everyone together. Mayor Page thanked Charles Wheeler for his work on the Spring Fling and for having three bikes to give away.
