ACTION MINUTES OF TULARE
CITY COUNCIL, CITY OF TULARE
February 12, 2019
A special session of the City Council, City of Tulare was held on Tuesday,
February 12, 2019 at 7:30 p.m. in the Tulare Public Library & Council
Chambers, 491 North “M” Street.
COUNCIL PRESENT: Jose Sigala, Dennis A. Mederos, Greg Nunley7:31 p.m., Terry
A. Sayre
COUNCIL ABSENT: Carlton Jones; Greg Nunley(left at 7:34 p.m.)
STAFF PRESENT: Rob Hunt, Mario Zamora, Darlene Thompson, Trisha Whitfield,
Janice Avila, Wes Hensley, Roxanne Yoder
I. CALL TO ORDER SPECIAL SESSION
Mayor Sigala called the special meeting to order at 7:30 p.m.
II. PLEDGE OF ALLEGIANCE
Mayor Sigala led the Pledge of Allegiance and an invocation was given by Jim
Pennington.
III. CITIZEN COMMENTS - Comments from the public are limited to items listed on
the agenda (GC 54954.3a). Speakers will be allowed three minutes. Please
begin your comments by stating and spelling your name and providing your city
of residence.
No public comment.
IV. GENERAL BUSINESS:
Comments related to General Business Items are limited to three minutes per
speaker, for a maximum of 30 minutes per item, unless otherwise extended by the
Council.
(1) City Attorney/Finance:
a. Continued discussion regarding a request from the Tulare Local
Healthcare District Board for funding assistance in the form of a line
of credit and potential approval of financial documents related
thereto. [Submitted by: D. Thompson; M. Zamora] Council Member
Nunley recused himself due to a business conflict and left the meeting.

Vice Mayor Mederos addressed the Council and the public regarding his
previous recusal and read the below statement into the record as follows,
invoking the Rule of Necessity in order to establish a quorum of the Council:

Following Vice Mayor Mederos’ statement Interim City Attorney Mario Zamora
provided a report on the item for the Council’s review and consideration.
Finance Director Darlene Thompson responded thereto. Interim City

Manager Rob Hunt provided a statement for the Council’s review and
consideration regarding the referenced accounts that would be utilized to fund
this matter.
Janet LeBaron addressed the Council in support of the request.
Ariana Tuskee addressed the Council and inquired if the District would be
able to seek more funding after tonight’s decision. She further inquired about
the proposed security value of the District properties. She further stated that
she hopes that with whatever decision is made that it is done with great
thought toward longevity.
Xavier Avila, Kevin Northcraft and Jan Smith addressed the Council in
support of the request.
Comments by Council Member Sayre and Mayor Sigala. Vice Mayor
Mederos declined to participate in discussion. Comments by Finance
Director Thompson regarding funding sources, the process of requesting
expenditures, the allocation of payments and interest. Following discussion, it
was moved by Mayor Sigala, seconded by Council Member Sayre and carried
2 to 1 (Council Member Mederos abstaining pursuant to those rules and
guidelines as set forth in the Tulare City Council Handbook of Rules and
Procedures, Chapter 4, page 17, section B, subsection 3 and 4 due to the
grounds indicated in the publicly read statement which recognized the
potential conflict) to approve the item as presented.
V. ADJOURN SPECIAL SESSION
Mayor Sigala adjourned the special session at 8:16 p.m.
