CALL TO ORDER AND ROLL CALL There being a quorum, Chair Charles Smyth called the meeting of the Committee of the Whole to order at 7:15 p.m. *Meeting started late due to prior meeting. 2. APPROVAL OF MINUTES OF PREVIOUS MEETING Alderman Aaron Ammons made a motion to approve the minutes from the meeting held on September 12, 2016. Alderwoman Diane Marlin seconded the motion. Motion to approve the minutes was carried by voice vote. 3. ADDITIONS TO THE AGENDA There were none. 4. PUBLIC INPUT Durl Kruse spoke about IDOT statistics and studies for traffic stops. He suggested having police give citizens survey cards when making traffic stops to obtain feedback from those who are stopped. He gave committee members a sample of a police stop survey card. Bishop King James and Rev. Dr. Evelyn B. Underwood did not wish to speak, but asked that their position be entered into the record regarding the Dr. Ellis Subdivision sewer issues. 5. Presentations There were none. 6. Staff Report a. Chapter 20 Right of Way Revisions – PW Assistant City Engineer Brad Bennett presented the Chapter 20 Right of Way Revisions. There were three items the fiber contractor was concerned about. The first was the prohibition of excess spoil material deposited in the right of way. Mr. Bennett said a utility company would be given 10 days after excavation to remove spoil piles and the restoration of the disturbed area would be more aggressively pursued. The second item was utility signage requirements, which will not change. The third item of concern was the One Dig Policy. Mr. Bennett stated that there are exemptions from the One Dig Policy and those will remain the same. He answered questions and concerns from committee members. Mr. Bennett informed committee members that the proposed revisions to Chapter 20 would be Committee of the Whole September 26, 2016 Page 2 of 4 ready at the end of October to present to the committee for a vote at a November council meeting. b. Windsor Road Update - PW Public Works Director William Gray and Assistant City Engineer Craig Shonkwiler presented an update on Windsor Road. Mr. Shonkwiler informed committee members about the condition of the pavement of the closed lanes on Windsor Road, and said the cause of the cracks has not yet been determined. Working through the City Attorney, Stark has been contacted to open Windsor Road fully to traffic. In the request, Stark was asked to fix fractured and faulted panels in the road. Mr. Shonkwiler stated that opening Windsor Road does not mean the city accepts the current condition of the road. They will continue to work with Stark to resolve the issue, and in doing so, future litigation may occur. Police Chief Patrick Connolly introduced newly hired city statistician Melissa Haynes. Assistant Police Chief Sylvia Morgan read a letter from an Urbana citizen who praised three Urbana police officers on their prompt response to a break in and burglary at her home. Community Development Director Elizabeth Tyler announced several upcoming events including a Food Truck Rally on Tuesday September 27 and the Regional Neighborhood Network Conference from September 29 through October 1. 7. Ordinance No. 2016-09-093: An Ordinance Adopting an Amended and Restated Agreement for Loan Guaranty Support by and Between the City of Urbana, a Municipal Corporation and the Urbana Development Group, a Not-For-Profit Community Development Corporation – CD Community Development Director Elizabeth Tyler presented this ordinance. She stated this ordinance included amendments to an existing agreement that Urbana has had with the Urbana Development Group, a not- for-profit Community Development Corporation, since 2008. Carolyn Baxley, an officer with the Community Development Corporation, was present to answer questions from committee members. Ms. Baxley and Ms. Tyler explained that the City has provided loan guaranty to the group for rehabilitation of residential properties that are then marketed as single family, owner-occupied homes. Ms. Tyler explained that there is no money exchanged in the guaranty. After discussion, Alderwoman Marlin made a motion to send Ordinance No. 2016-09-093 to council with recommendation for approval. Motion was seconded by Alderman Jakobsson and carried by voice vote. 8. Ordinance No. 2016-09-094: An Ordinance Approving a Supplement to the Redevelopment Agreement by and Between the City of Urbana, Champaign County, Illinois and 129 North Race LLC in Connection with the Redevelopment Project Area Number two – CD Economic Development Manager Brandon Boys presented this ordinance. He explained to committee members that this ordinance would provide supplemental reimbursement to 129 N. Race LLC, for costs that were not anticipated in the renovation of their investment property at 129 N. Race Street. It would not change the completion date of the renovation. Matt Cho, one of the partners with 129 N. Race LLC was present. Both Mr. Cho and Mr. Boys answered questions and concerns from committee members. After discussion, Alderman Jakobsson made a motion to send Ordinance No. 2016-09-094 to council with recommendation for approval. Motion seconded by Alderman Roberts and carried by voice vote. 9. IDOT Traffic Task Force – Discussion Committee of the Whole September 26, 2016 Page 3 of 4 Committee members discussed sample survey cards provided to them by Durl Kruse. The cards would be given to citizens who are stopped by police officers in traffic stops for violations not resulting in arrest. Committee members discussed the types of questions that would be included on the survey and the method of return, either by mail or electronically. Alderman Roberts made a motion to have the Human Relations Officer look at the sample survey card and provide feedback on the use of a survey card, and what types of questions should be included on it. The motion was seconded by Alderman Jakobsson and carried by voice vote. Alderman Ammons made a motion that the Urbana City Council direct the Urbana Police Department to discontinue the practice of conducting pretextual traffic stops for the purpose of further questioning or investigating the driver and/or passengers unless justified by clear evidence of criminal behavior or an overriding public safety exigency. The motion was seconded by Alderman Roberts. Discussion ensued, during which Police Chief Patrick Connolly and City Attorney James Simon answered questions and concerns from committee members. After discussion, the motion for the Urbana City Council to direct the Urbana Police Department to discontinue the practice of conducting pretextual traffic stops for the purpose of further questioning or investigating the driver and/or passengers unless justified by clear evidence of criminal behavior or an overriding public safety exigency, failed by voice vote. Alderwoman Marlin made a motion to direct the Urbana Police Department and Human Relations Officer compile statistics that would permit an evaluation of the effectiveness of pretextual/investigatory traffic stops as a crime fighting tool as per recommendation 2.4 of the final report of the Urbana Traffic Stop Data Task Force Volume One. Motion was seconded by Alderman Jakobsson and carried by voice vote. 10. Ordinance No. 2016-09-087: An Ordinance Vacating a Certain Portion of Right-of-Way (Barr Avenue west of North Cunningham Avenue) – PW Ordinance No. 2016-09-087 was removed on the floor by staff. 11. Ordinance No. 2016-09-088: An Ordinance Amending Urbana City Code Chapter 20, Section 20-615 (Advertising on or in a Curbana) – PW Public Works Director William Gray presented this item. Barb Stiehl, Assistant to the Public Works Director, provided committee members with information she compiled from other communities that have curbside cafes, or “parklets”. Signage on Urbana Curbanas was discussed, including the advantages and disadvantages. Matt Cho, the sponsor of one of the Curbanas, spoke to committee members about his ideas as to why signs/privacy screens on Curbanas would be useful. After discussion, Chair Smyth suggested keeping this item in committee. Alderman Jakobsson made a motion to keep Ordinance No. 2016-09-088 in committee. It was suggested that examples of the signage/privacy screen be provided so committee members would have a clear idea of what it would look like. Alderwoman Marlin seconded the motion to keep this item in committee. Motion was carried by voice vote. 12. Ordinance No. 2016-09-089: An Ordinance Revising the Annual Budget Ordinance for FY 2016/17 (Existing TIF District Revisions & Central TIF District) – CD Economic Development Manager Brandon Boys presented this ordinance. Alderman Roberts made a motion to send Ordinance No. 2016-09-089 to council with recommendation for approval. Motion was seconded by Alderman Jakobsson and carried by voice vote. 13. Ordinance No. 2016-09-090: An Ordinance Dissolving the Special Tax Allocation Fund and Terminating the Designation of the Downtown Urbana Committee of the Whole September 26, 2016 Page 4 of 4 Tax Increment Redevelopment Project Area within the City of Urbana, Champaign County, Illinois – CD Motion to send Ordinance No. 2016-09-090 to council with recommendation for approval was made by Alderwoman Marlin. Motion was seconded by Alderman Roberts and carried by voice vote. 14. Ordinance No. 2016-09-091: An Ordinance of the City of Urbana, Champaign County, Illinois Removing Certain Properties from the Downtown Urbana Tax Increment Redevelopment Project Area Number Two – CD Alderman Roberts made a motion to send Ordinance No. 2016-09-091 to council with recommendation for approval. Motion seconded by Alderman Brown and carried by voice vote. Alderman Ammons left the meeting after this item, at 10:16pm. 15. Resolution No. 2016-09-062R: A Resolution Deeming Certain Funds In The Special Tax Allocation Fund for the Downtown Urbana Tax Increment Redevelopment Project Area as “Surplus” Funds and Directing the Payment and Distribution Thereof (2016) – FIN Finance Director Elizabeth Hannan presented this resolution. Alderman Jakobsson made a motion to send Resolution No. 2016-09-062R to council with recommendation for approval. Motion seconded by Alderman Brown and carried by voice vote. 16. Resolution No. 2016-09-063R: A Resolution Approving and Authorizing The Execution of an Agreement between Online Solutions, LLC (Citizenserve) and the City of Urbana for Automated Services Related to Building Safety – CD Building Safety Manager John Schneider presented this item and the next item on the agenda. He and Community Development Manager Elizabeth Tyler answered questions from committee members. After discussion, a motion to send Resolution No. 2016-09-063R to council with recommendation for approval was made by Alderwoman Marlin. Motion was seconded by Alderman Jakobsson and carried by voice vote. 17. Ordinance No. 2016-09-092: An Ordinance Revising the Annual Budget Ordinance for FY 2016/17 (Automated Systems for Building Safety) – CD Motion to send Ordinance No. 2016-09-092 to council with recommendation for approval was made by Alderman Roberts. Motion was seconded by Alderman Brown and carried by voice vote. 18.
