CITY COUNCIL Regular Meeting August 15, 2016 7:30 P.M. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance to the American Flag was given by those present. CALL TO ORDER: Mayor Gottman called the regularly scheduled meeting of the Vandalia City Council to order at 7:30 P.M. ROLL CALL: Aldermen present were: Rebbe, Crawford, Swarm, Lester, B. John Clark, Hobler, Stunkel and Hubler. MOMENT OF SILENCE: A moment of silence was observed for Charles “Geno” Cearlock, a former police officer for the City of Vandalia and Mickey “Mick” Smith, a former business owner in Vandalia. Our condolences to these families for their loss. MINUTES: A motion was made by Swarm and seconded by Stunkel approving the minutes from August 1, 2016 & August 11, 2016 as presented. Motion carried. REGULAR BILLS: A motion was made by B. John Clark and seconded by Stunkel approving the regular bills as presented. Motion carried. SPECIAL COUNCIL BILLS: A motion was made by Stunkel and seconded by B. John Clark approving the Special Bills as presented: Online Solutions in the amount of $1,800.00 for 1 (one) citizenserve user subscriptions; SCIRP&DC in the 1  amount of $4,117.00 for reimbursement of the staff time, travels & other costs associated with the preparation, local approval & ultimate submission of one joint Fayette Co. Enterprise Zone application; Fayette County Clerk in the amount of $2,640.75 for third quarter animal control; Ameren Illinois in the amount of $3,199.81 for street lights; Illinois South Tourism in the amount of $1,955.00 for 1st quarter advertising; South Central FS, Inc. in the amount of $7,276.52 for fuel; Fayette Co. Treasurer in the amount of $38,205.51 & $118.30 for the Bear Grove Drainage District real estate taxes; Centraz Industries in the amount of $3,240.00 for sewer solvent; Brenntag Mid South Inc. in the amount of $8,274.09 for chemicals; Kaskaskia Springs Water Co. in the amount of $1,732.80 for 4.332 million gals delivered. John Clark Amending AND PERSONNEL, OF THE MUNICIPAL Title 2, Administration And CODE OF VANDALIA Personnel, Of The Municipal Code of Vandalia. Chapter 2.25-Salaries for elected Officials. TRANSFER OF LAKE LOT 44 FROM A motion was made by Hobler and JAMES & PAMELA GOODMAN TO KYLE seconded by Stunkel authorizing the & HEATHER BLACKERBY: transfer of Lake Lot 44 from James & 2  Pamela Goodman, Pocahontas, Il to Kyle & Heather Blackerby, Herrick, IL. All necessary fees have been paid. Motion carried. ORDINANCE #2016-8-15-B: A motion was made by B. John Clark AMENDING SALARIES FOR FISCAL and seconded by Stunkel Approving YEAR MAY 1, 2016-APRIL 30, 2017 Ordinance #2016-8-15-B, Amending Salaries For Fiscal Year May 1, 2016- April 30, 2017. RESOLUTION #2016-8-15-D: A motion was made by Stunkel and AUTHORIZING EXECUTION OF AN seconded by Crawford, Authorizing EMPLOYMENT CONTRACT BETWEEN THE Execution of Employment Contract CITY OF VANDALIA AND ZACHARY A. Between The City of Vandalia And KOPP Zachary A. Kopp to the position of Code Enforcement Official for the City of Vandalia. Motion carried. 3  At this time, Zach Kopp was sworn into office by City Clerk Peggy Bowen. AUTHORIZATION TO HIRE PERSONNEL A motion was made by Stunkel and TO FILL VACANCIES IN CITY seconded by B. John Clark, CLERK’S OFFICE: Authorizing to Hire Personnel To Fill Vacancies in the City Clerk’s Office. Motion carried. ORDINANCE #2016-8-15-E: A motion was made by B. John Clark AN ORDINANCE AMENDING TITLE 10 and seconded by Crawford adopting VEHICLES AND TRAFFIC Ordinance #2016-8-15-E, Amending Title 10 Vehicles And Traffic- Disabled Parking. One single parking space located on the west side of Sixth Street. It shall be the first space south of the intersection of Sixth & Jefferson Streets. John Clark AMENDING TITLE 10 VEHICLE AND and seconded by Stunkel adopting TRAFFIC Ordinance #2016-8-15-F, Amending Title 10 Vehicles And Traffic. Section 10.16.010 Angle Parking is amended, by addition of the following to existing Paragraph A: Fifth Street, between Gallatin Street and Main Street, East side only. APPROVAL OF VANDALIA TOURISM A motion was made by Crawford and COMMISSION MEEETING MINUTES seconded by Swarm approving the FROM JUNE 9, 2016: Vandalia Tourism Commission Meeting Minutes from June 9, 2016 as presented. Motion carried. ORDINANCE #2016-8-15-G:AMENDING A motion was made by Stunkel and VANDALIA MUNICIPAL CODE AT seconded by B. John Clark Amending TITLE V BUSINESS LICENSES & The Vandalia Municipal Code At Title REGULATIONS V Business Licenses And Regulations. The request for no more than five (5) Class A licenses was brought before the council, but after a lengthy discussion a motion was amended by Stunkel and seconded by B. John Clark to add one Class A liquor license to the current three in place. Roll call vote, Hubler, nay; Swarm, yea; Hobler, nay; Stunkel, yea; Crawford, yea; Rebbe, yea; Lester, nay; B. John Clark, yea; Motion carried. 5 yea & 3 nay. ORDINANCE #2016-8-15-H: A motion was made by Stunkel and APPROVING A REAL ESTATE seconded by Crawford adopting PURCHASE CONTRACT: Ordinance #2016-8-15-H, Approving A Real Estate Purchase Contract by and between Bruce Rand Edwards, Seller and the City of Vandalia, Buyer. The Vandalia Fire Department will purchase the former Liberty Utilities building at 224 S. Sixth St. in the amount of $80,000.00. Mayor Gottman mentioned that no tax dollars are being used to purchase the building. The fire department is buying the building using funds given to the department annually through 5  the Hazel Simma Kelly trust. Alderwoman Crawford said she had been asked why the fire department is buying that building instead of working toward building a second fire station on the north end of town. Mayor Gottman along with Mark Meadows, Assistant Fire Chief said that the plans for a second station has been dropped due to the cost to equip two facilities. RELINQUISHING CAMPING LOTS #311 Hobler, chairman of the lake & #312 BACK TO THE CITY: committee, reported that the executor of the estate of Richard Powell was relinquishing Lake lots #311 & #312 at Vandalia Lake. WATER & SEWER COMMITTEE MEETING A motion was made by Swarm and MINUTES FROM 8/01/2016: seconded by Crawford approving the Water & Sewer Committee Meeting Minutes from August 1, 2016 as presented. Motion carried. MAYOR’S REPORT: Mayor Gottman reported that an event center called The Weston House will locate at 1405 Veterans Avenue, in the former Goodwill location. They plan to host weddings, birthday parties and other celebrations. The Goodwill store will move to the strip mall located near Walmart. Mayor Gottman announced that he and LaTisha Paslay met with a possible prospect this past week. Mayor Gottman announced that the Vandalia Bowl has sold. 6  Robert & Debra Richardson are the new owners. RESOLUTION #2016-8-15-I: A motion was made by Stunkel and ABATE FAMILY FUN FEST ON seconded authorizing the request from SEPTEMBER 17, 2016: A.B.A.T.E. Illinois Inc. to sponsor the annual “ABATE Family Fun Fest” on Saturday, September 17th between 7:00 A.M. and 5:00 P.M. and the temporary closure from Third Street to Fifth Street. Motion carried. GO BOND SERIES 2007 TO Mayor Gottman reported on the GO REFINANCE: Bonds Series 2007 that the city could save an estimated $237,000 over the remaining repayment years if the bond is refinanced. City Treasurer Alyssa Matar is working with a public finance specialist on this matter. Mayor Gottman said that we may have to look at a different vehicle for Code Enforcement Official Zac Kopp. Mayor Gottman reported that the City of Vandalia received checks from the State of Illinois in the amount of $122,363.72 for water & sewer usage at the Vandalia Correctional Center. Leaving a balance of $406,836.00 that is owed to the City. STANDING COMMITTEE REPORTS: B. John Clark reported that the Public Works Department will begin oiling roads this week on Fifth & Sixth Street weather permitting. Swarm reported that the EPA inspection was done at the Water Plant with no problems. Swarm suggested that the city consider opening an account with money received from Vandalia Correctional Center Water & Sewer 7  funds for dredging. The city recently paid Metro-Ag, Inc. $108,000.00 for lagoon sludge removal at the Water Plant. Swarm said this could build up a fund that it wouldn’t be so hard on the city at one time. Mayor Gottman reported that there were three break-ins at three local businesses, The VFW, Old Capitol Vending and Tiger Lily. The Police Department has three individuals in custody. Lester reported that he will meet with contractors on getting a quote to move service at 119 E. Jackson. Paslay reported that on August 27th at noon there will be a Governor’s Run for Veterans. This is a motorcycle run being organized by the ABATE Chapter out of Marion, IL A motion was made by Swarm and seconded by Stunkel to have the Code Official, Zac Kopp use the pickup from the fire department that Keith Meadows used as Code Official. Motion carried. COUNCIL MOVES INTO EXECUTIVE A motion was made by Swarm and SESSION AT 8:21 P.M.: seconded by Crawford to move into Executive Session at 8:21 P.M. under 5ILCS120/2 for litigation. PRAYER SERVICE SET FOR FRIDAY Mayor Gottman announced that the EVENING IN BROWNSTOWN: Village of Brownstown will have a prayer service on Friday evening at 6:30 p.m. in Brownstown’s Central Park to recognize all emergency personnel.
