CITY COUNCIL Regular Meeting November 5, 2018 7:30 P.M. PLEDGE OF ALLEGIANCE: The Pledge of Allegiance to the American Flag was given by those present. CALL TO ORDER: Mayor Gottman called the regularly scheduled meeting of the Vandalia City Council to order at 7:30 P.M. ROLL CALL: Barker, yea; B. John Clark, yea; Stunkel, yea; Hobler, yea; Lester, yea; Rebbe, yea; Hubler, yea; Crawford, absent. MINUTES: A motion was made by Stunkel and seconded by Hobler approving the minutes from October 15, 2018. Motion carried. REGULAR BILLS: A motion was made by Stunkel and seconded by Hobler approving the regular bills as presented. Motion carried. SPECIAL COUNCIL BILLS: A motion was made by Stunkel and seconded by Hobler approving the Special Bills as presented: IMLRMA in the amount of $162,603.87 for Min/Max Annual Contribution for Insurance for 1-01-2019/01-01-2020; Timmermann & Company in the amount of $30,000 for preparing the audit; ADS Electric Corp in the amount of $1,978.48 for maintenance to stop lights at Kennedy & Gallatin St. Ameren Illinois in the amount of $2,991.12 for street lights; Land of Lincoln Credit Union in the amount of $9,990.79 for 1  payment on the fire truck; Vandalia Asphalt Service in the amount of $2,569.76 for chip mix; Bluff Equipment in the amount of $3,600.00 for lease agreement for a 2018 Kubota tractor; Direct Energy in the amount of $14,265.61 for electric; Allen R. TREASURER’S REPORT: A motion was made by Stunkel and seconded by Barker approving the Treasurer’s Report as submitted for audit. Motion carried. PRESENTATION OF LOOKING FOR Mary Truitt presented Mayor Gottman LINCOLN POSTER: with the Vandalia Looking For Lincoln poster on behalf of the Abraham Lincoln National Heritage Area. 2  Mayor Gottman thanked Truitt for all that she does to promote the city’s tourism. PRESENTATION OF THE CITY’S Dale Timmermann along with Tricia AUDIT FOR 2018: Elam with Timmermann and Co. presented the fiscal year 2018 audit to the council. A motion was made by Stunkel and seconded by Hobler approving the 2018 Audit as presented. Motion carried. TOURISM COMMISSION MEETING A motion was made by Stunkel and MINUTES FOR SEPTEMBER 18, 2018: seconded by Barker approving the Tourism Commission Meeting Minutes from September 18, 2018 as presented. Motion carried. APPROVAL OF 2019 COUNCIL A motion was made by Hobler and MEETING DATES LIST: seconded by Stunkel approving the schedule for the 2019 Council Meeting Dates as submitted. Motion carried. APPROVAL OF 2019 HOLIDAY A motion was made by Stunkel and OBSERVANCE LIST: seconded by Hobler approving the schedule for the 2019 Holiday Observance List as submitted. Motion carried. COUNCIL WORK SESSION MEETING A motion was made by Stunkel and MINUTES FROM OCTOBER 15, 2018: seconded by Barker approving the Council Work Session Meeting Minutes from October 15th as submitted. Motion carried. ZONING BOARD OF ADJUSTMENTS A motion was made by Stunkel and MEETING MINUTES FROM OCTOBER seconded by Hobler approving the 17, 2018: Zoning Board of Adjustments Meeting Minutes from October 17th as submitted. Motion carried. ORDINANCE #2018-11-5-A: A motion was made by Hobler and AUTHORIZING THE EXECUTION OF seconded by Barker adopting Ordinance THE IMLRMA MINIMUM/MAXIMUM #2018-11-5-A, Authorizing The CONTRIBUTION AGREEMENT: Execution Of The IMLRMA Minimum/Maximum Contribution 3  Agreement in the amount of $162,603.87 for the 2019 fiscal year. This contribution includes the following: Worker’s Comp; Auto Liability & Comprehensive General Liability; Portable Equipment; Auto Physical Damage; Property along with the 2019 IML Membership dues in the amount of $825.00. ORDINANCE #2018-11-5-B: A motion was made by Barker and AMENDING CHAPTER 5.08 ALCOHOLIC seconded by B. John Clark adopting BEVERAGE SALES OF THE VANDALIA Ordinance #2018-11-5-B, Amending MUNICIPAL CODE Chapter 5.08 Alcoholic Beverage Sales of the Vandalia Municipal code. As to premises holding a Class E and Class F License, no person under the age of 18 years shall carry, deliver, or serve alcoholic liquor from and after 11:00 p.m. From and after 11:00 p.m. no person under the age of twenty-one (21) years shall carry, deliver, or serve alcoholic liquor. RESOLUTION #2018-11-5-C: A motion was made by Hobler and APPROVING TOWER/LEASE RENTAL - seconded by Clark approving II Resolution #2018-11-5-C, Approving A Tower/Lease Agreement-II HofNet has reorganized its business and is now named Rural Comm, a division of Rural Enterprises; 4  The City of Vandalia negotiated a monthly fee of $350.00 total for both towers with Rural Comm. APPROVAL TO PURCHASE FLAGS FOR A motion was made by Stunkel and DOWNTOWN: seconded by Hobler approved the purchase of American flags in the amount of $2700.00. Motion carried. Mayor Gottman said that the American Legion has been responsible for purchasing and maintaining the flags. The flags will continue to be stored at the American Legion. Mayor Gottman said that Marlin Filer, Public Works Director volunteered his crew to help mount the flags downtown. APPROVE OR REJECT BIDS FOR A motion was made by Barker and SIDEWALK REPLACEMENT: seconded by B. John Clark approving the low bid in Section A which would be Horst Enterprises, Brownstown, IL in the amount of $23,460.00 and the low bid in Section B is Sheldon Schulte, Vandalia, IL in the amount of $13,029.00. Motion carried. ORDINANCE #2018-11-5-D: A motion was made by Hobler and AMENDING THE VANDALIA MUNICIPAL seconded by B. John Clark Amending CODE AT TITLE V BUSINESS the Vandalia Municipal Code At Title LICENSES & REGULATIONS AT V Business Licenses & Regulations At SECTION 5.08.210 LICENSE Section 5.08.210 License Revocation. REVOCATION Attorney Connor explained that if the Mayor revokes or fines a liquor establishment and they would appeal that finding or any findings that this body makes as a result of any liquor violation they have the right to go to the liquor commission for a 5  hearing. When they do, the issue is whether or not we have to retry the whole thing or if we can have what they call an “on the record appeal”. Meaning, the record the city creates with either audio, video or court reporters is the only record that exist they send it to the commission and the commission makes the ruling. These hearings are only held in Chicago. The expense of sending the attorneys’, a court reporter and witnesses would be exuberant. Attorney Connor is suggesting that the council pass this ordinance that we “have on the record appeals”. APPROVE OR REJECT PROPOSED TIF A motion was made by Stunkel and GUIDELINES: seconded by Barker approving the Proposed TIF Guideline. City Administrator Paslay forwarded the TIF guidelines to the TIF attorney for review and she was very pleased with what she read. She suggested a couple changes, the application go first and instead of calling it bids call it project budget. Motion carried. MAYOR’S REPORT: Mayor Gottman reported on his meetings that he attended in October: he attended the Police Pension Meeting with Brian Corrigan, the financial investment firm for the Police Pension Fund; a bus tour from Indiana & Ohio was welcomed to our city by Mayor Gottman; Mayor Gottman attended the Illinois South Board Tourism Meeting; He attended an EDC Meeting; He also attended a meeting at Kaskaskia College; He along with 6  LaTisha met with a representative from John Shimkus’ office; Attended a meeting to finalize Olde Tyme Christmas; He also attended the South Central Illinois Regional Meeting at Blind Society; Mayor Gottman met with the Health Insurance reps for the city. Mayor Gottman publicly thanked Old Capitol Monument Company for donating two men, equipment and a truck to help reset old tombstones at the cemetery at no charge to the city. CITY CLERK: Clerk Peggy Bowen reported that we received our second payment from Meyer Farms from the farm income this year in the amount of $16,000.00. Bowen also urged everyone to go vote tomorrow. CITY ADMINISTRATOR: Reminding everyone that Olde Tyme Christmas is this Friday from 3:00 P.M. to 9:00 P.M. and Saturday from 10:00 A.M. to 2:00 P.M. Anyone interested in the Christmas window display should have it up by 5:00 P.M. on Friday. Come #Shopsmall with us was placed by your spot this evening. She urges everyone to fill out the checklist that you might have went out of town to purchase. Also, the Vandalia Bicentennial Sponsorship was put at your spot this evening. STANDING COMMITTEE REPORTS: Alderman B. John Clark congratulated Mayor Gottman as Second Vice President for the Illinois Municipal League. 7  Alderman Barker also encouraged everyone to attend the Olde Tyme Christmas this Friday & Saturday. The lighting of the Christmas tree is set for 5:00 P.M. & the annual Christmas Parade following the lighting of the Christmas Tree. Mayor Gottman reported that the city did receive bids on the vac truck. Public Works Director, Marlin Filer will meet with the company to see if they can negotiate a price on the truck. Hats off to the Public Works Department for putting the lights up on the downtown buildings. Filer thanked Kelly Devall for donating his bucket truck for a few days to help put up the lights downtown. “Thank you Kelly”. Mayor Gottman publicly thanked John Jr. Harris for donating the Christmas tree on the hill. Mayor Gottman urged everyone to “go vote” tomorrow it is an important election with a lot at stake.
