CITY OF VERONA PUBLIC SAFETY AND WELFARE COMMITTEE DECEMBER 12, 2016 VERONA CITY HALL MINUTES 1. Call to Order: The meeting was called to order by Scott Stewart at 6:04 p.m. 2. Roll Call: Scott Stewart and Heather Reekie present. Evan Touchett absent and excused. Also in attendance: Police Chief Bernie Coughlin, City Clerk Ellen Clark, Steve Turner, Kelly Turner, Christian Turner and Alwyn Fitzgerald, Kate Fitzgerald, and City Attorney Bryan Kleinmaier. 3. Approval of Minutes: Motion by Reekie, seconded by Stewart, to approve the minutes of the November 21, 2016 Public Safety and Welfare meeting. Motion carried 2-0. 4. Discussion and Possible Action Re: An Application for a Combination Reserve “Class B” Intoxicating Liquor License and Class “B” Fermented Malt Beverages License from Black Dog Holdings, Inc., d/b/a Verona Woods Restaurant, 958 Liberty Drive, Verona, WI 53593, Steve W. Turner, Agent. Motion by Stewart, seconded by Reekie, to recommend to the Common Council to approve the application for a Combination Reserve “Class B” Intoxicating Liquor License and Class “B” Fermented Malt Beverages License from Black Dog Holdings, Inc., d/b/a Verona Woods Restaurant, 958 Liberty Drive, Verona, WI 53593, Steve W. Turner, Agent, for the interior sections of the restaurant only, contingent upon satisfactory completion of building and fire inspections by city staff. This license will allow the applicant to sell wine, beer and liquor at the restaurant, which is planned to open in late December. The building at 958 Liberty Drive is not yet ready for building or fire inspection. Staff estimates that the building will be ready for inspection in two to three weeks. Motion carried 2-0. 5. Discussion and Possible Action Re: An Application for a Combination “Class B” Intoxicating Liquor and Class “B” Fermented Malt Beverages License from TavernLife, LLC, d/b/a 5th Quarter, 161 Horizon Drive, Suite 110, Verona, WI 53593, Leann M. Butts, Agent. Motion by Stewart, seconded by Reekie, to recommend to the Common Council to approve the application for a Combination “Class B” Intoxicating Liquor and Class “B” Fermented Malt Beverages License from TavernLife, LLC, effective January 1, 2017, contingent upon surrender of the current license for this property by LBO, Inc. As of January 1, 2017, Ms. Butts will be the new owner of the 5th Quarter, and therefore must apply for a new license. This license will allow the applicant to serve wine, beer and liquor at the business. Motion carried 2-0. 6. Discussion and Possible Action Re: An Application for “Class B” Intoxicating Liquor and Class “B” Fermented Malt Beverages Licenses from Fisher King Winery, LLC, 1105 Laser Street, Verona, WI 53593, Alwyn Fitzgerald, Agent. Motion by Stewart, seconded by Reekie, to recommend to the Common Council to approve a “Class B” Intoxicating Liquor License for the interior sections of the winery only, contingent upon the following: 1. Accomplishment of an occupancy permit 2. The license will be issued for the interior portions of the winery only, with the requirement that the owner seek approval for any changes to the licensed premise description 3. A “Winery Permit” for the licensed premise must be obtained from the Wisconsin Department of Revenue 4. The winery must be capable of producing 5,000 gallons of wine per year in no more than two locations 5. Hours of operation will be restricted to 8:00 a.m. – 9:00 p.m., and a Class “B” Fermented Malt Beverages License for the interior sections of the winery only, contingent upon limiting the hours of operation to not later than 9:00 p.m. or earlier than 8:00 a.m. Fitzgerald requested that the winery be allowed to remain open after 9:00 p.m., with no alcohol being sold after 9:00 p.m. Attorney Kleinmaier stated that this could be a serious enforcement issue, and recommended that if the license is granted this evening, there should be included a condition that the winery must close by 9:00 p.m. In the future, Mr. Fitzgerald may bring in additional information as evidence to present to the committee for their consideration of the option of staying open after 9:00 p.m. Fitzgerald stated that all of their sales are easily tracked with a time stamp. Stewart stated he would like to see us grant the license this evening with the conditions included, and give staff and Mr. Fitzgerald time to gather more information from WisDOR, as well as determine what practices other communities and wineries have regarding this issue. Motion carried 2-0. 7. Adjournment. Motion by Stewart, seconded by Reekie, to adjourn at 6:48 p.m. Motion carried 2-0. Ellen Clark City Clerk
