Chairwoman Theresa Bachmann, Julie Kyllo, and Stephen Kenney were present. Also in attendance, and representing town staff, were Department of Planning & Zoning Senior Planner, Dorothy Baker and, Clerk to the Board, Jennifer Murphy. Michael Cheselka and Craig Burns were absent. Roll Call Board members Michael Cheselka and Craig Burns were absent. Approval of the Minutes: There being no corrections the April 11, 2023, minutes, were accepted as distributed. WHBR - April 11, 2023 Meeting Mins Regular Business 23-3776 Request for a Certificate of Appropriateness to construct a 6 ft. wood fence on the property located at 246 Lawyers Rd NW, Docket No. PF-995193-WHBR, in the RS-16, single-family detached residential zoning district; filed by Meghan Yurchisin, owner. Senior Planner, Dorothy Baker presented staff’s report, stating that the application is for new fence installation in board-on-board style, metal-capped posts, and a horizontal board along the top. The proposed fence will remain natural with no stain and will face Lawyers Rd NW, extending along the left and right sides of the property. There are currently no plans to fence in the rear property line. Concluding staff’s presentation, Chairwoman Bachmann invited the applicant forward to present. Jerome Yurchisin, owner of 246 Lawyers Rd NW, present representing the application advised that it will be a 4 ft fence. Chairwoman Bachmann invited public comment. Janet Gelb, residing at 104 Windover Avenue NW, stated that the fence that had separated hers and the applicant’s property was removed during construction. She asked if the applicant planned to re-install it. She hoped a wooden fence would be installed that would be similar to the previous fence. Mr. Yurchisin reapproached to discuss further. Further discussion followed. Victor Ruble, residing at 102 Windover Avenue NW, supported the application. He also appreciated the applicant installing temporary fencing during construction. As the other rear-yard neighbor, he had also been interested in a plan for replacing fencing along the rear property line. There being no further discussion, a motion was in order. Commissioner Kenney moved to approve the request for a Certificate of Appropriateness for installation of new fencing on property located at 246 Lawyers Rd NW, Docket No. PF-995193-WHBR, in the RS-16, single-family detached residential zoning district, with the clarification that it will be a 4 ft fence installed as indicated in pink highlighting on the document presented. The owner also has the option to install a 4 – 6 ft. tall, like-minded fence, along the entirety of the property including lots 11B1 and 11C1. Motion: Kenney Second: Kyllo Carried: 3-0 New Business Chairwoman Bachmann welcomed new staff liaison, Dorothy Baker, and thanked Ms. O’Brien for her assistance and technical support.
