VILLAGE OF WAUNAKEE PLAN COMMISSION MEETING 500 West Main Street July 10, 2023, at 5:30 PM Meeting Minutes CALL TO ORDER Ms. Runge called the meeting to order at 5:30 p.m. ROLL CALL: Present: Kristin Runge, Tricia Braun, Joe Zitzelsberger, Brian Wallace, Chris Thomas, Kevin Phelps, Chris Zellner. Absent: None Also Present: Tim Semmann, Tracy Meinholz, Jared Heyn, Bryan Kleinmaier, Jason Valerius, Alan C. Roberts, A. Currie, R.J. Binau, Carl & Kate Meyer, Mike Lawton, Don Tierney, Matt Schreiner, Sam Kaufmann, Justin Webster, Robert McPherson. MINUTES 1 June 12, 2023 Motion Thomas, second Zitzelsberger, to approve the June 12, 2023, Plan Commission Minutes. Motion carried. PUBLIC COMMENT Alan C. Roberts and R.J. Binau, with the First Presbyterian Church, raised concerns with access to the church property from County Highway Q. BUSINESS ITEMS 1 Discuss and Take Action on a Conditional Use Permit to Allow Multi-Family Use in the C1-D Zoning District at 314 E. Main Street (Item for final action by the Plan Commission) The applicant/owners are seeking approval of a CUP to convert a mixed-use building (residential over commercial) back to a fully residential use containing two housing units – one unit on the upper floor and one unit on the lower floor. The change to a wholly residential use in this district triggers the need for a conditional use review. The building, constructed in 1950, was originally built as a home, with the first floor later converted to an office use. The conversion of the building back to residential use is consistent with other adjacent residential buildings. No external modifications to the building are planned, thereby retaining the residential character of the building and nearby area. There is sufficient parking behind the building - accessed via the alley – to accommodate both units, which will include five bedrooms in total. The public hearing was opened at 5:40 p.m. Justin Webster of 311 Grant Street asked questions regarding number of occupants, parking, and property management and maintenance. The public hearing was closed at 5:42 p.m. Motion Zitzelsberger, second Phelps, to approve the Conditional Use permit for 314 E. Main Street as recommended by staff. Motion carried 7-0. 2 Discuss and Take Action on Kilkenny Farms West Final Plat and Specific Implementation Plan (Item for recommendation to the Village Board) Attached is the Final Plat and Specific Implementation Plan for the Kilkenny Farms West subdivision. Staff has reviewed the submittal and finds it generally consistent with the previously approved preliminary plat; however, there are several technical issues as identified in the staff memos that need to be remedied prior to the Village signing the final plat and issuance of building permits for this development. In addition, approval of a development agreement will be needed prior to the commencement of land disturbing activities and installation of public improvements. A development agreement is expected to come before the Village Board in the coming weeks. Motion Wallace, second Braun, to recommend to the Village Board that it approve the final plat for the Kilkenny Farms West development, subject to final approval by the Community Development Director and Village Engineer with modifications to meet staff comments to the satisfaction of the Village Engineer. Motion carried 7-0. Motion Wallace, second Zellner, to approve the Specific Implementation Plan, subject to final approval by Community Development Director with modifications to meet staff comments to the satisfaction of the Village Engineer and conditioned upon Village Board approval of the final plat. Motion carried 7-0. 3 Discuss and Take Action on an Amendment to Sec. 133-995 of the Zoning Code Regarding Parking Requirements for Certain Residential and Non-Residential Uses (Item for Recommendation to the Village Board) Changes to the Village’s parking standards were introduced in 2020 and further reviewed last year with no action taken. Staff recommends an emphasis on the table found under subsection 8 to further the discussion and to clarify the proposed changes versus the current standards. Verbiage is included in the table under subsection (8) whereby one stall per unit must be enclosed or below living quarters when constructing a multi-family building. This text was included in the proposed draft as it is in use by a neighboring community. Upon further review, staff is comfortable with this provision being removed from the stated requirements as the requirement to provide a minimum amount of enclosed parking will likely add cost to multi-family housing projects. Staff remains in support of the new provision to cap the amount of parking associated with a given use – new subsection (9); however, reminds the Commission that it can authorize exceptions to this standard as is currently stated in the parking ordinance. In addition to adding cost, requiring more parking than is needed can have the consequence of adding to overall stormwater flow and exacerbating the urban heat island effect within the Village. Motion Zellner, second Zitzelsberger, to table the item. Motion carried 7-0. WAUNAKEE/WESTPORT JOINT PLAN COMMISSION UPDATE Staff gave an update. Comments are limited to three-minutes per person and must be delivered at the gallery podium for recording purposes. Accommodations can be provided for those unable to access the podium. VIRTUAL: When public comments are allowed, attendees on Zoom wishing to participate should click “raise hand” if on video or press *9 if on phone call. Attendees will be called on in the order in which hands are raised. Those wishing to provide oral comments remotely must have their full name displayed within the Zoom application and must state address of residence. Anonymous comments will not be allowed. *As permitted by the Wisconsin open meetings law and while not required, the Plan Commission has chosen to allow public comments during their meetings. The Commission Members may not engage in discussion or take action during this period but may consider deferring the subject to a later meeting with notice. State statute and/or Village Code require PUBLIC HEARINGS on certain specified matters where the public can comment. The meeting chairperson will identify rules for providing comments. Other items on the agenda which are not listed for public hearing do not require the Plan Commission to allow public comment, however the meeting chairperson can at their own discretion allow limited public comments.
