CALL TO ORDER
The December 5, 2011 Village Board meeting was called to order at 7:04 p.m. by President
John Laubmeier.
ROLL CALL
Present: Phil Willems, Chris Zellner, Gary Herzberg (arrived at 7:10 p.m.), Steve Kraus, John
Laubmeier
Absent: Gary Walden, Sue Springman
Also Present: Todd Schmidt, Julee Helt, Dave Ferris, Kevin Even, Roberta Baumann, Tim
Herlitzka, Bryan Kleinmaier, Bill Frederick, Todd Taves
CONSENT AGENDA
Items under the consent agenda may be acted upon by one motion. If, in the judgment of any
Board Member, a consent agenda item needs discussion, the item may be moved to later on the
agenda for discussion and/or action.

Motion by Phil Willems, second by Steve Kraus, to approve the Consent Agenda including
November 21, 2011 Village Board minutes, check numbers ranging from 59141 through 59173
totaling $53,873.53, check numbers ranging from 59235 through 59242 totaling $9,392.94,
check numbers ranging from 59243 through 59257 totaling $245,320.34, low bid from Brooks
Tractor of $96,491 for a 2012 John Deere 544K front loader after trade-in, and 4.5% sewer rate
increase effective January 1, 2012.
Motion Passed. For: 4, Against: 0, Absent: 3.
PUBLIC COMMENT
There was no comment from the public.
PUBLIC HEARING
1. Discuss and Take Action on Watzke ETJ Certified Survey Map, Town of Vienna
The public hearing to consider an ETJ Certified Survey Map for Watzke Trust was opened at
7:05 and closed at 7:06 p.m.
Motion by Chris Zellner, second by Steve Kraus, to approve an ETJ Certified Survey Map
for Watzke Trust contingent upon approval by the Town of Vienna, and suggesting the Town
deed restrict the property to no further buildings.
Motion Passed. For: 4, Against: 0, Absent: 3.
LICENSES/PERMITS
1. Discuss and Take Action on Application for Operator License for Debora Lynn
Grimesey
Motion by Steve Kraus, second by Phil Willems, to approve the application for an Operator
License for Debora Lynn Grimesey subject to successful completion of an approved beverage
server training course.
Motion Passed. For: 4, Against: 0, Absent: 3.
Gary Herzberg arrived at 7:10 p.m.
NEW BUSINESS
2. Discuss and Take Action on Resolution Awarding the Sale of Waterworks and
Electric System Mortgage Revenue Bonds, Series 2011 in an Approximate
Amount of $3,895,000
Motion by Phil Willems, second by Chris Zellner, to approve a Resolution Awarding the Sale of
$3,845,000 Waterworks and Electric System Mortgage Revenue Bonds, Series 2011.
Motion Passed. For: 5 (Phil Willems, Chris Zellner, Gary Herzberg, Steve Kraus, John
Laubmeier), Against: 0, Absent: 2.
1. Discuss and Take Action on Alternatives for Parkway/CTH Q Intersection and
Simon Crestway/Woodland Drive Intersection
Motion by Gary Herzberg, second by Phil Willems, to proceed with the signal design for the
Simon Crestway/Woodland Drive intersection, and proceed with two alternative designs for the
CTH Q/parkway intersection.
Motion Passed. For: 5, Against: 0.
OLD BUSINESS
1. Discuss and Take Action on Forward Development Group Annexation
Agreement and Related Project *The Village Board may convene in closed
session as authorized by Wisconsin Statute 19.85(1)(e) for the purpose of
deliberating or negotiating the purchasing of public properties, the investing of
public funds, or conducting other specified public business, whenever
competitive or bargaining reasons require a closed session. The Village Board
may reconvene in open session.
Motion by Gary Herzberg, second by Phil Willems, to convene in closed session at 7:40 p.m. as
authorized by Wisconsin Statute 19.85(1)(e) for the purpose of deliberating or negotiating the
purchasing of public properties, the investing of public funds, or conducting other specified
public business, whenever competitive or bargaining reasons require a closed session. The
Village Board may reconvene in open session.
Motion Passed. For: 5 (Phil Willems, Chris Zellner, Gary Herzberg, Steve Kraus, John
Laubmeier), Against: 0, Absent: 2.

3. Discuss and Take Action on MMSD Payment Request *The Village Board may
convene in closed session as authorized by Wisconsin Statute 19.85(1)(g) for the
purpose of conferring with legal counsel for the governmental body who is
rendering oral or written advice concerning strategy to be adopted by the body
with respect to litigation in which it is or is likely to become involved.
Motion by Chris Zellner, second by Gary Walden, to convene in closed session at 7:41 p.m. as
authorized by Wisconsin Statute 19.85(1)(g) for the purpose of conferring with legal counsel for
the governmental body who is rendering oral or written advice concerning strategy to be
adopted by the body with respect to litigation in which it is or is likely to become involved.
Motion Passed. For: 5 (Phil Willems, Chris Zellner, Gary Herzberg, Steve Kraus, John
Laubmeier), Against: 0, Absent: 2.
4. Discuss and Take Action on Administrator Review and Contract Terms *The
Village Board may convene in closed session as authorized by Wisconsin Statute
19.85(1)(c) for the purpose of considering employment, promotion,
compensation, or performance evaluation data of any public employee over
which the governmental body has jurisdiction or exercises responsibility.
Motion by Chris Zellner, second by Steve Kraus, to convene in closed session at 7:42 p.m. as
authorized by Wisconsin Statute 19.85(1)(c) for the purpose of considering employment,
promotion, compensation, or performance evaluation data of any public employee over which
the governmental body has jurisdiction or exercises responsibility.
Motion Passed. For: 5 (Phil Willems, Chris Zellner, Gary Herzberg, Steve Kraus, John
Laubmeier), Against: 0, Absent: 2.
