VILLAGE OF WAUNAKEE BOARD MEETING 500 West Main Street November 5, 2012 - 6:00 PM Meeting Minutes CALL TO ORDER The November 5, 2012 Village Board meeting was called to order at 6:00 a.m. by President John Laubmeier. Approve October 15, 2012 Village Board Minutes Motion to approve October 15, 2012 Village Board minutes. Motion Failed. For: 6 - Gary Walden, Chris Zellner, Sue Springman, Gary Herzberg, Steve Kraus, John Laubmeier, Against: 1 - Phil Willems. 2. Approve Routine Bills Motion to approve check numbers ranging from 62314 through 62320 totaling $4,087.30, check numbers ranging from 62389 through 62410 totaling $57,978.60 and check numbers ranging from 62411 through 62417 totaling $5,228.43. Motion Failed. For: 6 - Gary Walden, Chris Zellner, Sue Springman, Gary Herzberg, Steve Kraus, John Laubmeier, Against: 1 - Phil Willems. 3. Approve Non-Routine Bills Motion to approve check numbers ranging from 62418 through 62442 totaling $110,962.78 and ACH check number 1201327 totaling $110,764.41. Motion Failed. For: 6 - Gary Walden, Chris Zellner, Sue Springman, Gary Herzberg, Steve Kraus, John Laubmeier, Against: 1 - Phil Willems. 4. Approve Reallocation of Library Designated Debt Proceeds to Fund Library Entrance Concrete Repair Motion to approve reallocating 2011 debt proceeds designated for library building improvements to cover the library building entrance way concrete work in the amount of $4,797. Motion Failed. For: 6 - Gary Walden, Chris Zellner, Sue Springman, Gary Herzberg, Steve Kraus, John Laubmeier, Against: 1 - Phil Willems. 5. Deny Claim by Victor June Alleging Damages Motion to deny claim by Victor June alleging damages as a result of a tree falling on his vehicle during a storm. Motion Failed. For: 6 - Gary Walden, Chris Zellner, Sue Springman, Gary Herzberg, Steve Kraus, John Laubmeier, Against: 1 - Phil Willems. 6. Approve Modification to Employee Handbook Policy on Outside Employment Motion to direct staff to have the statement “Exceptions to this paragraph may be granted by the Village Board” added to our handbook policies and duly published if required by any appropriate statute. As long as Sue McDade uses personal or vacation time, she is grandfathered in her current approval status until July 1, 2013. Motion Failed. Approve Appointment to Library Board Motion to approve the appointment of Annie Ballweg to the Library Board. Motion Failed. Approve Temporary Class “B”/“Class B” License for St. John Congregation Motion to approve a Temporary Class “B”/“Class B” License for St. John's Congregation. Motion Failed. Cruz Peterson for December 1, 2012 Motion Failed. For: 6 - Gary Walden, Chris Zellner, Sue Springman, Gary Herzberg, Steve Kraus, John Laubmeier, Against: 1 - Phil Willems. 10. Approve Street Use Permit for Waunakee Fire Department for November 11, 2012 Motion to approve a Street Use Permit for Waunakee Fire Department for November 11, 2012. Motion Failed. For: 6 - Gary Walden, Chris Zellner, Sue Springman, Gary Herzberg, Steve Kraus, John Laubmeier, Against: 1 - Phil Willems. 11. Approve Temporary Class “B” License for Waunakee Fire Department for November 11, 2012 Motion to approve a Temporary Class “B” License for Waunakee Fire Department for November 11, 2012. Approve Temporary Operator License Application for Brian T. Adler for November 11, 2012 Motion to approve a Temporary Operator License application for Brian T. Adler for November 11, 2012. Motion Failed. For: 6 - Gary Walden, Chris Zellner, Sue Springman, Gary Herzberg, Steve Kraus, John Laubmeier, Against: 1 - Phil Willems. PUBLIC COMMENT Dennis Heimann, representing the Waunafest Committee, presented the Village with a $500 donation in appreciation for the use of Village parks and the assistance of Village staff during the event. PRESENTATIONS 1. Discuss and Take Action on Proclamation Declaring November as Pancreatic Cancer Awareness Month Motion by Gary Herzberg, second by Steve Kraus, to approve the Proclamation Declaring November as Pancreatic Cancer Awareness Month. Motion Passed. For: 5, Against: 0, Absent: 2. President Laubmeier presented the Proclamation Declaring November as Pancreatic Cancer Awareness Month to the family of Denise Acker on behalf of all those impacted by this disease. OLD BUSINESS Chris Zellner arrived at 6:03 p.m. 1. Discuss and Take Action on Developer's Agreement for Certified Survey Map Along CTH Q Commercial Development Related to Tierney Motion by Steve Kraus, second by Phil Willems, to approve the Developer's Agreement for the Certified Survey Map along CTH Q commercial development related to Don Tierney subject to staff review. Motion Passed. For: 6, Against: 0, Absent: 1. 2. Discuss and Take Action on Main Street Pedestrian Crossing Improvements Several business and property owners appeared to express concern about the proprosed design options for the pedestrian crossing on Main Street. Speakers included Greg Hensen, Lavern Hensen, Roger Endres, Sr., Roger Endres, Jr., Dennis Heimann, Fred Loy, Kevin Reynolds, Mike Kuehn, Joe Koltes, and others who did not identify themselves. No action was taken. PUBLIC HEARING 1. Discuss and Take Action on Certified Survey Map and Rezone Request for Daniel and Jacklyn Kaltenberg for 5439 Easy Street, Town of Westport The public hearing to consider a Certified Survey Map and rezone request for Daniel and Jacklyn Kaltenberg for 5439 Easy Street, Town of Westport, was opened at 7:12 p.m and closed at 7:13 p.m. Motion by Chris Zellner, second by Phil Willems, to approve the proposed Certified Survey Map for 5439 Easy Street and rezone the parcel from County A-1 to Village ER-1 as presented and as recommended by the Town Plan Commission with standard Town restrictions, including no further land division or creation of building sites for created parcel and remaining 80 acres of land (and no home structures on that remaining ag parcel), approval of driveway access area by Town staff and the remainder of new lot to be shown with no public road access allowed, and no annexation unless approved by the Town Board. Motion Passed. For: 6, Against: 0, Absent: 1. 2. Discuss and Take Action on 2013 Budget The public hearing to consider the 2013 Budget was opened at 7:24 p.m. and closed at 7:25 p.m. No action was taken. LICENSES/PERMITS 1. Discuss and Take Action on Application for Operator License for Mason Fey and Allen R. Crahen Motion by Steve Kraus, second by Phil Willems, to approve the Operator License applications for Mason Fey and Allen R. Crahen. Motion Passed. For: 6, Against: 0, Absent: 1. NEW BUSINESS 1. Discuss and Take Action on Resolution Approving an Amendment to the Project Plan of Tax Incremental District No. 2, Village of Waunakee, Wisconsin Motion by Sue Springman, second by Phil Willems, to approve the Resolution Approving an Amendment to the Project Plan of Tax Incremental District No. 2, Village of Waunakee, Wisconsin. Motion Passed. For: 6, Against: 0, Absent: 1. 2. Discuss and Take Action on 2013 Wage Adjustments *The Village Board may convene in closed session as authorized by Wisconsin Statute 19.85(1)(c) for the purpose of considering employment, promotion, compensation, or performance evaluation data of any public employee over which the governmental body has jurisdiction or exercises responsibility. The Village Board may reconvene in open session. No action was taken. 3. Discuss and Take Action on 2013 Wage Adjustments *The Village Board may convene in closed session as authorized by Wisconsin Statute 19.85(1)(e) for the purpose of deliberating or negotiating the purchasing of public properties, the investing of public funds, or conducting other specified public business, whenever competitive or bargaining reasons require a closed session.
