CALL TO ORDER
The October 7, 2013 Village Board meeting was called to order by President John Laubmeier at
6:01 p.m.
ROLL CALL
Present: Phil Willems, Gary Walden, Chris Zellner, Sue Springman, Gary Herzberg, Steve
Kraus (arrived at 6:11 p.m.), John Laubmeier
Absent: None

CONSENT AGENDA

Motion by Chris Zellner, second by Gary Herzberg, to approve the Consent Agenda including
all items listed below.

1. Approve September 16, 2013 Village Board Minutes
Motion to approve September 16, 2013 Village Board minutes.
2. Approve Routine Bills
Motion to approve check numbers ranging from 65404 through 65426 totaling $114,481.65 and
check numbers ranging from 65483 through 65496 totaling $9,160.54 and check number 65508
totaling $200.00.
3. Approve Non-Routine Bills
Motion to approve check numbers ranging from 65497 through 65507 totaling $603,336.17 and
ACH check number 1301625 totaling $68,716.29.
4. Approve Resolution Requesting Exemption from County Library Tax
Motion to approve Resolution Requesting Exemption from Dane County Library Tax.
PUBLIC COMMENT

LICENSES/PERMITS
1. Discuss and Take Action on Operator License Applications for Samantha K.
Nelson, John M. Loper, Madison G. Vincent, Megan C. Nolan, and Bobbi S.
Fairchild
Motion by Gary Herzberg, second by Phil Willems, to approve operator license applications for
Samantha K. Nelson, John M. Loper, Madison G. Vincent, Megan C. Nolan, and Bobbi S.
Fairchild subject to successful completion of an approved responsible beverage server training
course.
Motion Passed. For: 6, Against: 0, Absent: 1.
OLD BUSINESS
1. Discuss and Take Action on Move to Amend Request
Motion by Sue Springman, second by Phil Willems, to approve placing Move to Amend non-
binding referendum language on an upcoming ballot and that exact ballot language be provided
for Village Board approval prior to such ballot placement.
Motion Passed. For: 6, Against: 0, Absent: 1.
Steve Kraus arrived at 6:11 p.m.
2. Discuss and Take Action on Proposed Wisconsin Regional Athletic Complex on
Hogan Road
Nila Frye presented her views in opposition of the proposed athletic complex. Deb Glenn
answered questions about the project and voiced concern about receiving conceptual approval
necessary to begin fundraising.
Motion by Sue Springman, second by Gary Walden, that the Village Board voice support, at a
conceptual level, with knowledge of numerous further approvals required, in regards to
development of the Wisconsin Regional Athletic Complex.
Motion Passed. For: 5, Gary Walden, Sue Springman, Chris Zellner, Gary Herzberg, Steve
Kraus; Against: 2, Phil Willems and John Laubmeier.

1. Discuss and Take Action on Ordinance Amending 66-128 Related to Truancy
Motion by Steve Kraus, second by Gary Herzberg, to remove consideration of an Ordinance
Amending 66-128 Related to Truancy from the table.
Motion Passed. For: 7, Against: 0.
Motion by Gary Herzberg, second by Phil Willems, to approve the Ordinance Amending 66-
128 Related to Truancy.
Motion Passed. For: 7, Against: 0.
NEW BUSINESS
2. Discuss and Take Action on DOT Agreement for Highway Improvement Project
(STH 19)
Motion by Steve Kraus, second by Phil Willems, to approve DOT Agreement for Highway
Improvement Project (STH 19).
Motion Passed. For: 7, Against: 0.
3. Discuss and Take Action on Amendment to Agreement for Land Division
Improvements for North Ridge Estates Phase VII
Motion by Phil Willems, second by Steve Kraus, to approve the Amendment to Phase VII North
Ridge Estates Developers Agreement subject to final changes approved by the Village Engineer
and Village Attorney.
Motion Passed. For: 7, Against: 0.
4. Discuss and Take Action on Creative Economy Initiative Strategic Plan
No action was taken.
5. Discussion and Action on Health Insurance Plan Selection
Motion by Gary Herzberg, second by Chris Zellner, to take no action to change health insurance
plans for 2014.
Motion Passed. For: 7, Against: 0.
6. Discuss and Take Action on Village Hall Remodel
Motion by Chris Zellner, second by Gary Walden, to approve project funding from Village Hall
land sale proceeds, authorize the Village Administrator and Village Engineer to select a
contractor at a cost not to exceed $25,000 for the Village Hall office remodeling project, and to
coordinate and see through the project to completion.
Motion Passed. For: 7, Against: 0.
1. Discuss and Take Action on Amendment to Waunakee Code of Ordinances
Section 14-3(b) Vicious Dogs and Animals *The Village Board may convene in
closed session as authorized by Wisconsin Statute 19.85(1)(h) for the purpose of
conferring with legal counsel for the governmental body who is rendering oral or
written advice concerning strategy to be adopted by the body with respect to
litigation in which it is or is likely to become involved. The Village Board may
reconvene in open session.
Motion by Chris Zellner, second by Gary Walden, to convene in closed session at 7:50 p.m. as
authorized by Wisconsin Statute 19.85(1)(h) for the purpose of conferring with legal counsel for
the governmental body who is rendering oral or written advice concerning strategy to be
adopted by the body with respect to litigation in which it is or is likely to become involved. The
Village Board may reconvene in open session.
Motion Passed. For: 7, Gary Walden, Phil Willems, Sue Springman, Chris Zellner, John
Laubmeier, Gary Herzberg, Steve Kraus; Against: 0.
