CALL TO ORDER
The Village Board meeting was called to order by President Chris Zellner at 6:00 p.m.
ROLL CALL
Present: Phil Willems, Chris Zellner, Sue Springman, Gary Herzberg, Steve Kraus, Bill
Ranum, Sam Ballweg

CONSENT AGENDA
Items under the consent agenda may be acted upon by one motion. If, in the judgment of any
Board Member, a consent agenda item needs discussion, the item may be moved to later on the
agenda for discussion and/or action.
Motion by Phil Willems, second by Bill Ranum, to approve the Consent Agenda including all of
the items listed below.
Motion Passed. For: 7, Against: 0.
1. Approve November 21, 2016 Village Board Minutes
Motion to approve November 21, 2016 Village Board minutes.
2. Approve Schedule of Bills
Motion to approve check numbers ranging from 74083 through 74113 totaling
$712,564.59, 74123 through 74138 totaling $135,317.17, and Exxon Mobil payment of
$3,680.48.
3. Approve Disposal of Surplus Property
Motion to determine property to be surplus and approve disposal of surplus property as
presented.
PUBLIC COMMENT
There was no comment from the public. Administrator Schmidt invited the Board to enjoy
holiday cheer at Rex's Innkeeper after the December 19, 2016 Board meeting. He also
introduced Adam Bentley as the new Assistant Administrator/HR Manager.
PRESENTATIONS
1. Presentation on Future Library Operation Cost Projections
Geoff Vine provided information about operation cost projections for a new library.
PUBLIC HEARING
1. Discuss and Take Action on Request by BrightStar Senior Living to Amend
General Development Plan for Arboretum Office Park, Lot 28, to Allow for
Proposed Assisted Living/Memory Care Facility
The public hearing to consider a request by BrightStar Senior Living to amend the General
Development Plan for the Arboretum Office Park, Lot 28, to allow for a proposed assisted
living/memory care facility was opened and closed.
Motion by Phil Willems, second by Sue Springman, to amend the General Development Plan
for Arboretum Office Park, Lot 28, to allow for BrightStar Senior Living to construct a
proposed assisted living/memory care facility conditioned upon approval of the PILOT
agreement.
Motion Passed. For: 7 - Sam Ballweg, Against: 0.
LICENSES/PERMITS
1. Discuss and Take Action on Operator License Applications for Megan M. Heim
and Mikayla E. Miller
Motion by Gary Herzberg, second by Steve Kraus, to approve operator license applications for
Megan H. Heim and Mikayla E. Miller subject to successful completion of an approved
responsible beverage server training course and review by the Waunakee Police Department.
Motion Passed. For: 7 - Sam Ballweg, Against: 0.
NEW BUSINESS
1. Discuss and Take Action on Resolution Approving Waunakee Area Fire District
Borrowing
Motion by <MOVER>, second by <SECONDER>, to approve 1. Discuss and Take Action on
Resolution Approving Waunakee Area Fire District Borrowing
Motion Passed. For: 0, Against: 7.
Motion by Chris Zellner, second by Steve Kraus, to table consideration of a Resolution
Approving Designated Borrowing of Funds for the Purchase of New Heavy Duty 3000 Gallon
Tender Truck by the Waunakee Area Fire District.
Motion Passed. For: 7, Against: 0.
2. Discuss and Take Action on Proposed Amendment to Kilkenny TIF Agreement
*The Village Board may convene in closed session as authorized by Wisconsin
Statute 19.85(1)(e) for the purpose of deliberating or negotiating the investing of
public funds or conducting other specified public business, whenever competitive
or bargaining reasons require a closed session. The Village Board may reconvene
in open session and discuss and take action on the subject matter discussed in
closed session.
Motion by Steve Kraus, second by Gary Herzberg, to approve the Kilkenny TIF agreement
amendment subject to final approval by the VIllage Administrator, Village Attorney, and Bond
Counsel.
Motion Passed. For: 7 - Sam Ballweg, Against: 0.
OLD BUSINESS
1. Discuss and Take Action on Settlement Agreement with Environmental
Protection Agency and US Department of Justice Regarding Waunakee Alloy
Property and Memorandum of Understanding with Dane County *The Village
Board may convene in closed session as authorized by Wisconsin Statute
19.85(1)(e) for the purpose of deliberating or negotiating the purchasing of
public properties, the investing of public funds, or conducting other specified
public business, whenever competitive or bargaining reasons require a closed
session. The Village Board may reconvene in open session and discuss and take
action on the subject matter discussed in closed session.
Motion by Gary Herzberg, second by Steve Kraus, to convene in closed session as authorized
by Wisconsin Statute 19.85(1)(e) for the purpose of deliberating or negotiating the purchasing
of public properties, the investing of public funds, or conducting other specified public
business, whenever competitive or bargaining reasons require a closed session related to a
Settlement Agreement with the Environmental Protection Agency and US Department of
Justice regarding Waunakee Alloy Property and Memorandum of Understanding with Dane
County. The Village Board may reconvene in open session and discuss and take action on the
subject matter discussed in closed session.
Motion Passed. For: 7 - Phil Willems, Chris Zellner, Sue Springman, Gary Herzberg, Steve
Kraus, Bill Ranum, Sam Ballweg, Against: 0.
Motion by Gary Herzberg, second by Bill Ranum, to reconvene in open session and discuss and
take action on the subject matter discussed in closed session, in particular, the Settlement
Agreement with Environmental Protection Agency and US Department of Justice regarding
Waunakee Alloy Property and Memorandum of Understanding with Dane County.
Motion Passed. For: 7 - Sam Ballweg, Against: 0.
Motion by Steve Kraus, second by Sam Ballweg, to approve the Memorandum of
Understanding between the Village of Waunakee and Dane County, subject to final approval by
the Village Administrator and Village Attorney.
Motion Passed. For: 7, Against: 0.
Motion by Sue Springman, second by Sam Ballweg, to approve the Settlement
Agreement between the Village of Waunakee, the Environmental Protection Agency, and the
US Department of Justice regarding Waunakee Alloy Property, subject to final approval by the
Village Administrator and Village Attorney.
Motion Passed. For: 7, Against: 0.
